The most direct and clear way to punish a violator is to write a complaint to the traffic police.

Now it is not necessary to personally go to the department and write a statement there. All you need to do is take a photo of the road situation and fill out the form on the website.

You can and should also use video from a car recorder. In this case, the date, time and your license plate stamps should be displayed on the screen.

Electronic submission of an application and personal application are equivalent and do not have privileges when considered by the traffic police.

But you need to keep in mind that if you file a complaint online, then in the future you may be asked to provide the original photographs in person. Your witness statements may also be required.

Photo and video requirements:

readable license plate number of the offender’s vehicle;
recording the fact of violation: road signs, markings, traffic lights, etc., which reflects the situation that has arisen;
It is desirable that the date of shooting be indicated directly on the photo or video, and the location reflected using GPS/Glonass.

The official period for consideration of your application is 30 days.

What is a written request and when might it be needed?

A request to the traffic police is a statement in which an interested person asks the State Traffic Inspectorate to provide him with the necessary information. The possibility of obtaining information from government bodies is determined by Article 5 of Federal Law No. 59 of May 2, 2006 “On the procedure for considering citizens’ appeals” and paragraph 2 of Article 8 of Federal Law No. 3 of February 7, 2011 “On the Police.” It is important to understand that not all the information you need can be obtained. Thus, the same paragraph 2 of Article 8 of the Federal Law “On the Police” determined that the applicant has the right to receive information only about the activities of the police and information directly related to him (for example, how many vehicles are registered with him). In addition, personal information is protected by Article 7 of Federal Law No. 152 of July 27, 2006 “On Personal Data”. This means that third parties cannot claim to receive information that does not concern them (with the exception of information about police work).

An authorized representative of a citizen (organization) can act as an applicant. As a rule, lawyers act on the basis of a power of attorney. In addition, paragraph 52 of the Order of the Ministry of Internal Affairs No. 1001 of 2008 determined that information about the registration of vehicles and their owners can be legally transferred to the courts, the prosecutor's office, investigative and inquiry authorities.

More often, the request is necessary to obtain a certificate from the traffic police required by one or another authority. For example, when a citizen receives a notice about the need to pay transport tax for a car that he has already sold (disposed of). In this case, he needs to obtain a certificate confirming that the vehicle is no longer registered in his name. In addition, a certificate from the traffic police may be needed when considering (investigating) a criminal case or a case of an administrative offense.

How to properly file a complaint

In the application you indicate:

Region and locality of appeal.
Select the name of the department to which the complaint is sent.
Personal data of the applicant: full name, address, e-mail, telephone.
Were there any appeals on this issue, when and where?
The exact date, time and place of the recorded violation.
Detailed description of the situation.
Grounds for initiating a case: articles of the Code of Administrative Offenses or the Criminal Code, paragraphs of traffic rules.

You attach files to your online application and submit the form by entering the digital code on the website.

If you contact the traffic police department in person, print out the photos or bring the files on a flash drive.

In what cases can a request be sent?

There are 4 situations in which the traffic police can send a request:

If information about the old driver's license is not in the database. In this case, the request is sent to the department that issued the rights.
If you need to check a foreign driver's license . In this case, the request is sent to the state that issued the rights.
If the driver candidate has provided a certificate from a driving school located in another region and information about the certificate is not in the Federal Register of Education Documents. The request is sent to the driving school.
If the medical certificate was received in another region, the request is sent to the organization that issued the certificate.

Grounds for refusal to consider a complaint

Your application may not be accepted if:

The provided files are of insufficient quality, the license plate number of the offender is not readable or is not captured.
Photo and video evidence is not presented at all.
The grounds for the complaint are unclear or missing.
There are errors in the applicant's personal data.
The text contains insults and obscene language.
There are no specifics, the situation is not described in sufficient detail or is described incorrectly.

Also, for each case, the traffic police accepts only one complaint.

You can apply again if you received an official refusal based on your previous application or the problem was resolved, but another violation occurred later.

Online project “Angry Citizen”

On this online platform, residents throughout the country can record emerging problems in the urban auto environment:

In practice, the effectiveness of a complaint depends on the work of the local authorities. According to reviews on the Internet, in some Russian cities, citizens receive formal replies from the traffic police. For example, that police officers came to the place specified in the complaint, but did not find the offender there.

Photo or video?

You definitely need one of these. A simple report of a traffic violation, even indicating all identifying data (license plates, or even passport details) and the presence of witnesses to the violation, most likely will not entail punishment due to insufficient evidence. The only option here is the confession of the violator himself, which is very unlikely.

Recruitment by photo

Taking photographs is not always conclusive evidence of violation and may work 50/50. So, based on the photo, it will definitely not be possible to attract the driver for some non-compliance with the Rules, the most common of which is, for example, violation of parking and parking. The driver involved will simply state that he was moving at that moment, although, most likely, he will not even go so far as to question the driver.

Recruitment by video

Video recording of almost any violation can more likely lead to the prosecution of the violator.

But in both cases, the license plate number of the car must be clearly visible and it is highly desirable that the face of the driver (or passenger, if you are complaining about him) is visible for identification.

It is impossible to attract the owner of a car just based on a photo or video of a violation, because a complaint from a citizen with an active position is not a basis for this. You should not confuse your application for a violation and non-compliance with traffic rules caught on a self-recording camera. The difference is that according to the law, a violator can be prosecuted only in case of auto-fixation (Note to Article 1.5 of the Administrative Code - presumption of innocence).

It works like this: even if the owner of the car is called to the traffic police to testify about your complaint, and even if he appears on a subpoena or a call from the traffic police, he can declare that either he was not driving at all, or testify against himself or his loved ones he does not want relatives, according to the article of the Constitution of the Russian Federation. Thus, they will not be able to subject him to a fine or other punishment.

But it is much easier to attract, for example, a driver of a regular shuttle bus, especially in Moscow and large cities, because you will definitely indicate the date and time of the deviation from the traffic rules in the application attached with the video, and the traffic police will most likely provide information about the driver, who was driving the bus at the time. The same applies to many situations where drivers of legal entities are brought to justice for violations.

Application “Moscow Assistant”

With the introduction of paid parking, the Moscow City Hall launched a project - a special application for monitoring compliance with traffic rules and payment for parking.

There are requirements for a smartphone:

GPS must work;
50 MB of device memory is required;
camera from 5 MP.

To use the program, you need to register in the system through government services of the city of Moscow.

After registration, you can very quickly and easily submit reports of violators. To do this, you just need to photograph an illegally parked car and upload the photo to the application.

There is no need to manually enter the car license plate number and other data.

The information goes directly to the Moscow Administrative Road Inspectorate.

The activity of city residents is encouraged by the mayor's office: you receive points that you can exchange for tickets to cultural events, travel tickets, parking in paid zones, etc.

Your account is linked to your account on the Active Citizen platform.

You send a complaint in the “Moscow Assistant” application, and points for displaying civic position are awarded through “Active Citizen”, in your profile.

Is it possible to submit a complaint anonymously?

As of 2021, it is not possible to file a complaint about traffic violations anonymously.

This applies to a personal visit to the site, and filling out an electronic application form on the traffic police website, and sending it through other services.

Human rights activists fear that anonymity will trigger a surge in fabricated statements driven by revenge or other interpersonal motives.

In addition, in some cases additional evidence is required regarding the situation that has arisen.

All this makes it impossible for applicants to remain anonymous.

Other ways to cancel an application to visit the State Traffic Inspectorate

If the user was registered with the traffic police through the State Services service, this does not mean at all that he will have to cancel through the same portal. Of course, it is more convenient to complete the procedure through this site, but we should not exclude cases when this method is inappropriate for some reason.

If there is no access to the Internet, the user can refuse a visit to the traffic police in several alternative ways:

Call the institution or specialist to whom the citizen planned to come. It is necessary to verbally cancel the visit. The organization's telephone number can be found on the State Traffic Inspectorate website, on the Internet. Here you should select your department and find out the phone number.
Personal visit to a citizen. This method will take more time and effort. The citizen must come to the department employee and warn about failure to show up for the appointment.

Some time after the call, a notification about cancellation of the application will appear in the citizen’s personal account. The procedure is much easier to carry out via the Internet. However, you need to remember that there are situations when this option is inappropriate, for example, during technical work on the portal.
