Driving through a prohibiting traffic light signal or a traffic controller's prohibiting gesture, except for the cases provided for in Part 1 of Article 12.10 of this Code and Part 2 of this Article, entails an administrative fine in the amount of one thousand rubles. …. 3. Repeated commission of an administrative offense provided for in Part 1 of this article shall entail the imposition of an administrative fine in the amount of five thousand rubles or deprivation of the right to drive vehicles for a period of four to six months.
  • Article 12.12 2. Failure to comply with the requirement of the Traffic Rules to stop in front of a stop line indicated by road signs or road markings, when there is a prohibiting traffic light signal or a prohibiting gesture from a traffic controller, entails the imposition of an administrative fine in the amount of eight hundred rubles.
  • Article 12.15 4. Driving, in violation of the Traffic Rules, onto a lane intended for oncoming traffic, or onto tram tracks in the opposite direction, except for the cases provided for in Part 3 of this article, shall entail the imposition of an administrative fine in the amount of five thousand rubles or deprivation of the right to drive vehicles. for a period of four to six months.
  • Article 12.37 2. Failure by the owner of a vehicle to fulfill the obligation established by federal law to insure his civil liability, as well as driving a vehicle if such compulsory insurance is known to be absent, entails the imposition of an administrative fine in the amount of eight hundred rubles.

Amendments to the Administrative Code occur as follows:

  • a legislative draft is formed and discussed at a meeting of deputies;
  • the bill passes three readings with a temporary interval in the State Duma, where arguments are made about the effectiveness of the proposal;
  • if the bill is supported by all deputies, the innovation is adopted;
  • approval of a law with an assigned number by the President of the country;
  • published on the official portal of legislative documents;
  • after 10 days or after the time period specified in the law, the act comes into force along with new fines.

It is worth noting that at present there are no corresponding legislative changes either on the official website of legal documents or on the portal of the Government of the Russian Federation.

Will there be new fines in November?

There will be no new fines for traffic violations from November 20, 2021! The information about increasing fines is fake.

Every year, closer to autumn, information begins to be thrown into the Internet space regarding the increase in fines. Information about an imaginary tightening of legislation appears on forums, thematic websites, and social networks. Anxious users relay the false data on their social platforms, and eventually the internet is abuzz with headlines about rising fines. The two main themes of the false reports are:

Why such rumors are spread across the network is unknown, but the fact remains that such information was leaked to the media. The planned increase in traffic police fines is not expected in the future, that's for sure. Anyone can follow all interesting updates in legislation on the portals of legal documents.

But we need proofs!

Of course, you don’t have to trust us either. Therefore, the false information about the entry into force of new fines in November 2021 must be proven. This can be done quite simply if you know the main thing - how changes to the Code of Administrative Violations officially come into force - and only it regulates penalties for traffic violations.

So, the procedure for amending the Code of Administrative Offenses is as follows:

  1. first, deputies develop a draft law, which is submitted for discussion to the State Duma,
  2. then the new law must undergo as many as 3 readings in the State Duma, during which the feasibility of the project is actively discussed at hearings; an indefinite but considerable time always passes between readings,
  3. if the draft law is not rejected at all 3 stages of readings - that is, the majority of deputies vote for the bill, then it is adopted by the Duma,
  4. then the law, which has already been assigned its own number, is signed by the President of Russia,
  5. now it must be published on the official portal of legal information,
  6. after 10 days or after a longer time specified in the text of the project itself, the Federal Law on Amendments comes into force, and only then new traffic police fines begin to apply.

And now the main thing! You will not find any draft laws of this kind anywhere: neither on the Government portal in the proposed drafts, nor on the official publication portal (clause 5 of the order of entry into force above), nor anywhere else.

How can you prove it?

Everything is very simple. The most useful knowledge that can be obtained about traffic police fines is how to correctly check the information and where to look for it. And you can check which new and old fines are in effect today in the following most reliable way (you will understand why “the most reliable” below). Although, this is not the easiest way.

What fines come into effect in November?

  1. All fines, as well as terms of deprivation of rights, administrative arrests and other punishments and security measures for drivers and others are contained in the Code of Administrative Offences. Yes, there are also regional Codes of Administrative Offences, but we will not consider them here, simply because the vast majority of sanctions are contained in the Federal Code.
  2. If we are talking about new traffic police fines and changes to current ones, then they, accordingly, should be made by appropriate amendments to our Code of Administrative Offenses. The Code itself was introduced by the relevant law more than 18 years ago. And it is precisely its Article 1.1 that indicates that all changes to this legal act are made by federal laws.
  3. What is federal law? First, its draft is developed by some deputy or group of deputies. For example, once the LDPR proposed in a bill to abolish the fine for tinting completely.
  4. Then the project is registered in the State Duma and submitted for discussion.
  5. Then there are 3 readings by other deputies and, accordingly, voting for or against its adoption. If at least one of the readings the majority of votes are against, then the project will be rejected, and the new fine will never come into force.
  6. If the draft is approved in all readings, then several more formal stages will pass before the new law comes into force. We are interested in one of them. According to Article 6 of Federal Law No. 5, the entry into force of changes occurs after some official publication.
  7. We go to Article 4 of the same Federal Law and see that such publication is considered to be the placement of a new law on official legal information portals, including Pravo.gov.ru.

And it's all! Now we just have to try to find the relevant law on changes to the Code of Administrative Offenses of the Russian Federation on this portal. And you will not find a single one that would introduce new traffic police fines either from November 1 or from November 20, 2021. That is why all these new punishment tables are nothing more than fakes.

Yes, this is not the easiest way to verify the veracity of information about the November sanctions. There are also simpler ones, but conditionally less reliable.

Of course, there are legal resources that promptly update databases in accordance with incoming changes in legal acts or the entry into force of new laws.

But they also have some problems. So, you can look at the current penalties, but knowing when any penalty will come into effect in the future (even tomorrow) can be a challenge. As we see, in November there was no increase in the sanction to 3 thousand. Well, here's the fine for driving while drunk:

Article 12.8, part 1. Driving a vehicle while a driver is intoxicated, if such actions do not constitute a criminal offense, entails an administrative fine in the amount of thirty thousand rubles with deprivation of the right to drive vehicles for a period of one and a half to two years.
