Many car owners who are approaching the deadline for replacing their license are wondering: what is the fine for late replacement of a driver’s license . The fact is that there is no such wording in the Administrative Code. Simply put, there is no penalty for late replacement of rights. The law is indifferent to your punctuality and does not monitor on any basis whether you applied for a replacement or not. However, this is good news only if you don’t drive .

You won’t be able to completely avoid a fine for driving without a license, but you can get off with a minimum of 5,000 rubles. This is what can influence the inspector's decision.

Amount of time from the expiration date. If the driver communicates politely with the inspector and the driver’s license expired recently, a couple of days ago, he may issue a minimum amount. If a driver drives with an old license for several months or years, the fine will most likely be maximum - 15,000 rubles.

Driving history. Inspectors also look at the history of violations: how often the driver receives fines and whether he pays them. If the driver has a lot of violations or is not the first time he has been caught without a license, he will most likely be charged the largest amount.

Grounds and deadlines for replacing a passport

There are several reasons for changing your identity card. If your passport is expired, you will have to pay a fine unless extenuating circumstances apply. The replacement period is 30 days from the date of the reason for performing the relevant actions (registration of marriage, reaching the appropriate age).

How long does it take to issue a driver's license in Russia?

Temporary driver's license and duplicate. Temporary licenses are not issued in Russia today. It is advisable to contact the traffic police at your place of residence or registration a couple of weeks before your license expires. Usually, all stages from applying and collecting documents to obtaining new rights take a little time. The traffic police officer will tell you when they will be issued. In some cases, the period for receiving new ones extends to 1-2 months. To change your license, you will have to go through a medical examination again. While the basic license is being replaced, the driver is issued a temporary document.

Remember: tips for the driver if stopped by traffic police

  1. If the license is expired, there will be a fine. But for the first case and with a recent deadline, it can be only 5,000 rubles.

What happens if you are late in paying a traffic fine?

The regulatory framework in force in Russia in 2021 provides 60 days to pay the fine. To encourage prompt repayment of such debts, those who make payments within 20 days of the penalty receive a discount of half the fine.

If the fine has not been paid within 60 days, it becomes overdue. The fact of delay can be detected in one of three ways:

Doubling the fine amount

Another type of punishment for late payment of penalties for traffic violations is an administrative fine. Its size can reach twice the amount of the driver’s debt, but not less than 1 thousand rubles. If the culprit proves the difficulty of his financial situation, an installment plan for the payment of an administrative fine is allowed, provided for a period of up to 3 months.

Mandatory work

An alternative to imposing a fine and administrative punishment is compulsory work. Their maximum duration is 50 hours.

Imprisonment

The most severe punishment for late payment of traffic police fines is administrative arrest. Its maximum period is set at 15 days. All of the listed types of administrative liability do not negate the possibility of bailiffs carrying out standard security measures, for example, in the form of seizure of the debtor’s property, as well as the collection of an additional 7% of the debt amount.

How many days is it allowed to travel with an expired driving license?

Not at all. In 2021, the current legislation does not provide for any grace period for replacing rights (as, for example, in relation to the MTPL policy, which can be issued within 10 days after purchasing the car).

You should take care of replacing your driver's license in advance. Resolution No. 1097 does not say anything about how many days before the actual expiration of the driving license you can contact the traffic police for a replacement. It seems that it is not necessary to do this on the last day (you can, for example, come a week in advance).

In any case, it is possible to change the driver’s license in general long before the expiration of the term, not on the basis specified in paragraphs. “a” paragraph 29 of Resolution No. 1097, and according to paragraphs. “e” clause 29, that is, simply at your own request. But then it is important to submit a medical certificate in form 003-В/у (if you do not issue it, then the medical certificate will be issued with the same validity period as it was before, and if issued, then for 10 years).

Where to go

You can replace your license due to expiration directly at the nearest traffic police department at the place of registration. In addition, most MFCs now provide a service for exchanging driver’s licenses both ahead of schedule and due to their expiration.

The MFC operates in single window mode. Unlike the traffic police department, you won’t have to stand in long queues here; there are comfortable waiting rooms. To get the necessary service, just visit the MFC, get a coupon at the terminal and wait for your number to appear on the display.

However, in MREO it is no longer necessary to wait in line. An increasing number of regions are adopting the practice of pre-registration for traffic police appointments online through the public services portal. However, until now, visiting the MFC remains the most convenient option for exchanging rights.

But before going to the MFC, you must visit a medical facility to undergo a medical examination.

Medical examination when replacing rights

In 2021, when replacing an expired license or for an early replacement with an extension, you must undergo a medical examination. To undergo an inspection, the driver has the right to contact either the state. a clinic at your place of residence, or an accredited private medical center.

To conduct a medical examination, the organization must have a special license to conduct such activities.

Attention! When replacing due to a change of surname, the validity period of the license will not change unless there is a medical certificate.

A category B driver must undergo inspection:

  • Therapist or general practitioner,
  • Ophthalmologist,
  • Psychiatrist, psychiatrist-narcologist.

How to behave with a traffic police officer at the time of a stop if you have an expired license?

Judging by paragraph 84.13. Order of the Ministry of Internal Affairs No. 664 of August 23, 2017, one of the grounds for stopping a vehicle by an inspector is the need to check the documents required to be provided by drivers in accordance with clause 2.1.1. Traffic regulations, that is:

  • driver's license;
  • OSAGO policy;
  • STS;
  • in established cases - a waybill or license card.

Moreover, stops can also be made outside stationary posts.

Based on clause 89 of Order of the Ministry of Internal Affairs No. 664, after a stop the inspector is obliged to:

  • approach the driver and introduce yourself;
  • briefly report the reason for the stop;
  • state the demand for the transfer of documents to him.

The requirement to hand over a driver's license to a traffic police officer is absolutely legal, so it is almost impossible to hide the fact of driving with an expired license. As follows from clause 1, part 1, art. 28.1. of the Code of Administrative Offenses, the discovery by a traffic police officer of sufficient data indicating the presence of an offense is grounds for initiating an administrative case.

After the initiation of the case, a protocol is drawn up on the imposition of a fine for expired rights (under Part 1 and Part 3 of Article 12.7. This is done in most cases, since the persons specified in paragraph 5 of Part 2 of Article 23.3 are often not present at the scene of the violation Administrative Code - that is, the heads of the traffic police, their deputies, traffic police company commanders, their deputies, which means there is no basis for drawing up a resolution without a protocol - Article 28.6 of the Administrative Code). In 2021, all comments can be indicated in the text of the protocol (Part 4 of Article 28.2 of the Administrative Code). Refusal to sign will not give anything - the traffic police officer will simply make the appropriate mark.

Almost nothing depends on communication with the employee (since the actions or words of the driver do not affect the procedure - they still draw up a protocol, then send it within 3 calendar days for consideration to the authorized person (Part 1 of Article 28.8.), then the case is considered in general order (Chapter 29 of the Administrative Code).

In any case, when stopped, the driver is recommended to communicate with traffic police inspectors politely and comply with all their legal orders. If the motorist is absolutely sure that he is not guilty, but the traffic police officer still draws up a report, it’s okay – after all, there is always the possibility of an appeal (Chapter 30 of the Code of Administrative Offenses).

Normative base

The legal basis for imposing penalties for driving with an expired license in 2021 consists of the following legislative acts:

  • Code of Administrative Offences;
  • Federal Law No. 196;
  • Government Decree No. 1097 of October 24, 2014 (stating that the VA must be replaced after the expiration of its 10-year validity period, as well as on the documents provided for the purpose of replacement);
  • Order of the Ministry of Internal Affairs No. 995 of October 20, 2015 (on how the state service for replacing a driver’s license is provided);
  • clause 43.1. Part 1 Art. 333.33. The Tax Code of the Russian Federation - on the amount of the state duty for replacing the VU for all reasons (including upon expiration), which in 2021 is 2000 rubles.

Validity period of the certificate

As we have already said, the certificate is valid for 10 years, and the certificate itself indicates the exact date when it will become invalid and it will be necessary to replace it. If we are talking about international rights, their validity period is 3 years and they are valid strictly within the framework of the validity period of Russian rights and cannot exceed them.

The following are the reasons why rights are also invalidated:

  • if due to damage or wear, the information on them is not readable;
  • were obtained using documents found to be counterfeit;
  • availability of a new certificate;
  • if the rights were stolen;

And also if:

  • the owner's health status has changed;
  • due to changes in the citizen’s personal data.

These are the very reasons why the certificate will have to be changed before the required 10 years.
