Kazakhstanis will be fined for not having the “Spikes” sign

Penalty for the “Spikes” sign (Canceled)

Every time winter comes, the first thing motorists do is to “change the shoes” of their iron horses into winter tires. Some people prefer liposystem tires, that is, winter tires that are not studded, while others, on the contrary, choose tires with studs. Here we will not incline you to either option, since this is not the topic of our article. In this article we would like to address another issue. Will a driver face a fine if his car has studded tires, but does not have a “Spikes” sign attached? This is the letter “Ш” in a triangle, if you’ve seen it.

So let's try to understand this issue.

Is it necessary to install a “Spikes” sign on the rear window if you have studded tires?

Oddly enough, the “grimace” of the law seemed to grin at those who had studded winter tires, but there was no “Spikes” sign on the rear window. This was the case until 2021.

The thing is that such motorists had to attach the “Spikes” sign to the rear window. However, times change, and so do laws. 2021 has arrived and a new decree has been issued.

Exclusion of the “Spikes” sign from the traffic rules

So, in November, namely on the 24th, decree No. 1414 was signed, which excluded in paragraph 8 of the data, paragraph 3

... "Spikes" - in the form of an equilateral triangle of white color with the top up with a red border, in which the letter "W" is inscribed in black (the side of the triangle is at least 200 mm, the width of the border is 1/10 of the side) - on the back of motor vehicles with studded tires;

This is the very turning point when what you read above can be left only for history. It turned out according to the decree that the sign cannot be affixed at will, according to any criteria of tires, time of year, region or something else. The sign Ш was simply excluded from the traffic rules; one might say it has died out in the current legislation like a dinosaur.

This means only one thing, that according to the “List of faults and conditions. “, which states in paragraph 7.15 1 about the mandatory presence of signs listed in the “General Provisions for the Admission of Vehicles. “You can’t find the “Ш” sign, which means you can’t ask for its absence.

There are no identification marks that must be installed in accordance with paragraph 8 of the Basic Provisions for the admission of vehicles to operation and the duties of officials to ensure road safety, approved by Resolution of the Council of Ministers - Government of the Russian Federation of October 23, 1993 No. 1090 “On the Rules traffic."

As a result, from November 2021 it is quite possible to legally drive without this sign.

Fine for the “Spikes” sign on the rear window, or rather for its absence

Canceled along with the cancellation of such a sign from the traffic rules.

All that remains is to leave an image of this sign on the site as a souvenir, so that future generations will know what it looked like and how much they had to tinker with it, so that it nevertheless flashed like a comet in the sky of legislation and went out without a trace, in the black abyss of this vast and dark universe of paperwork .

Question and answer on the topic “Fine for the sign (sticker) “Spikes””

Question: Can a fine be issued for not having a “Spikes” sign on the rear window? Answer: No, from 2021 on November 24 this is illegal! (the norm was introduced by Decree No. 1414 of November 24, 2018).

“#7 Vladislav 02.11.2017 13:19 in parts 2-7 of Article 12.5 of the Code of Administrative Offenses, I did not see the wording “for the absence of a triangle “W”. Question: what standard will the traffic police inspector refer to when drawing up a protocol?”

Is a spike sign required and is it possible to drive with it in the summer?

Attention! As of December 8, 2019, by decree of the Government of the Russian Federation, drivers were removed from the obligation to put the “Spikes” sign on their car. Now its presence is only advisory in nature and is not punishable by fines.

Below is the article before changes on December 8, 2019.

Recently, such an important document for motorists as the Technical Regulations of the Customs Union was ratified and came into force, and from January 1, 2015, changes affected traffic rules. Important changes were also made to the traffic rules on April 4, 2017 (Government Decree (No. 333 of March 24, 2017). First of all, the rules for replacing winter and summer tires, the possibility of their operation and when it is necessary to “change shoes” of the car have changed. Question about The question of whether the “Spikes” sign on the rear window of a car is mandatory and whether there is a fine for its absence is still relevant and causes a lot of discussion and controversy.

How Kazakhstanis will be fined for not having the “Spikes” sign

In Kazakhstan, owners of vehicles equipped with studded tires will be fined for not having the “Spikes” sign. The fine will be 3 MCI (6363 tenge), NUR.KZ reports with reference to the press service of the Department of Internal Affairs of the Pavlodar region.

According to the information of the Administrative Police Committee of the Ministry of Internal Affairs of the Republic of Kazakhstan, according to the Traffic Regulations of the Republic of Kazakhstan, namely paragraph nine of section “Basic provisions for the admission of vehicles” of the Traffic Regulations of the Republic of Kazakhstan, the “Spikes” sign must be installed on the car if the vehicle is equipped with studded tires.

The sign itself has a certain standard; it must be a white equilateral triangle with a red border, in which the letter “Ш” is inscribed in black. The side of the triangle is at least 200 millimeters, the width of the border is 1/10 of the side. The sign is glued to the rear window of the car.

“In case of failure to comply with the specified traffic rules requirements, liability is provided for in Article 620 of the Code of the Republic of Kazakhstan on Administrative Offences, “Violation of other requirements imposed on road users,” which provides for liability - a warning or a fine in the amount of 3 MCI (6,363 tenge),” said the deputy Head of the Administrative Practice Department of the KAP Baurzhan Nurakhmetov.

According to him, if a driver is stopped for the first time for not having a “Spikes” sign, the police officer will give him a warning.

If the violation occurs several times, then a fine will follow.

“Here the policeman will proceed from the circumstances of the case. If the driver has already been warned, the employee can check this in the database. A warning is also a type of administrative penalty,” the interlocutor clarified.

The Technical Regulations of the Customs Union “On the Safety of Wheeled Vehicles,” which came into force in 2015, prohibit the use of summer tires in winter and studded tires in summer, and also introduce a limit on the remaining tread depth of tires. So, on summer tires the tread height should be at least 1.6 millimeters, and on winter tires - four millimeters.

The wheels must be marked with a sign in the form of a mountain peak with three peaks and snowflakes inside, as well as the markings “M+S”, “M&S”; "MS".

Accordingly, if all-season tires have these markings, then you can drive them in winter. Otherwise, such tires will be prohibited.

The use of all-season tires in the warm season is not prohibited. In summer, the ban applies only to wheels with spikes.

From January 1, 2021, according to technical regulations, restrictions on the number of studs on tires began to apply.

“The tire must be suitable for the installation of anti-skid studs. The manufacturer must recommend studs designed for installation on a given type of tire based on stud length and top flange diameter. In this case, the protrusion of the stud beyond the tread is 1.2 plus or minus 0.3 millimeters.

By the number of spikes. The maximum number of studs per linear meter is 60 pieces. The requirements apply to tires manufactured after January 1, 2021,” Mirgali Umarov, head of the project support department of the RSE “Kazakhstan Institute of Standardization and Certification,” explained the details of the technical regulations.

The "Spikes" sign is still mandatory

Recently, information about a possible incident has been widely disseminated online. Note that the requirement to glue such a sign on the rear window of a car if studded tires are installed arose back in the days of the Soviet Union.

Only recently did Russia decide to introduce real penalties for violating such a requirement. At some point, news began to appear on the Internet that the traffic police themselves asked to remove such a requirement from the rules, because the sign can already be considered irrelevant. But how it all ended remains unknown.

Drivers in Russia will continue to be fined for not having a “Spikes” sign.

In some regions of Russia the first frosts have already hit and snow has fallen. With the arrival of cold weather, drivers began to “change shoes” for their cars. The question immediately arose: is it necessary to attach a “Spikes” sign to the rear window of a car with studded tires? There is persistent information circulating in the automotive community that recently this traffic rule has ceased to apply and traffic police officers no longer issue fines for this violation. However, it is not. The draft law to abolish the mandatory “Spikes” sticker is still under discussion. This was pointed out to Znak.com by the Federation of Car Owners of Russia.

Sticker "Ш" on the rear window

The new version of the traffic rules came into force on April 4, 2021. Then a whole list of signs was mandatory, including “Spikes”. It is an equilateral white triangle with a red border, in which a black letter “Ш” is inscribed. The absence of this sign on a car with studded tires was included in the list of faults for which the operation of the vehicle is prohibited.

Traffic inspectors received the right for such a violation not only to issue a fine of 500 rubles, but even to prohibit further driving of the car until the fault is corrected, that is, until the driver places the missing sign on the rear window.

Not all motorists liked this innovation. Moreover, the Ministry of Internal Affairs began to understand that installing the “Spikes” sign is not always advisable. As a result, on May 15, 2021, draft amendments to the traffic rules appeared, which provide for the complete abandonment of the “Spikes” sign.

The authors of the bill noted that due to the dynamic characteristics, the movement of the car now depends on other reasons, and the requirement for the “Ш” sticker has lost its relevance. The explanatory note states that the movement of a vehicle is now influenced by factors such as the degree of vehicle load, the presence of modern electronic systems that promote braking or stabilization, and others.

Motorists discussed this news for a long time, and by the fall they became confident that they no longer needed to worry about the sign. But, as it turns out, it’s premature to throw this sticker into the trash bin. On the eve of the winter season, regional traffic inspectorates began to clarify that the “Spikes” sign had not been canceled. Such messages, in particular, were made by the traffic police in Syktyvkar and Petro, traffic inspectors note.

Draft amendments to road rules

The portal of draft regulations indicates that on May 29, 2019, the public discussion of the bill on “spikes” ended. Since then, the draft amendments have been in “under consideration” status. The document is stuck at the stage of “forming the final version of the text of the draft normative legal act.”

In this regard, State Duma deputy Sergei Boyarsky recently sent an official request to the Minister of Internal Affairs of the Russian Federation Vladimir Kolokoltsev with a request to clarify when the requirement to stick the “Spikes” sign on cars will finally be lifted and, accordingly, fines for its absence will be abolished. The parliamentarian has not yet received a response.

The head of the Russian Federation of Car Owners, Sergei Kanaev, told Znak.com why the adoption of amendments to the traffic rules was delayed. According to him, the bill published on May 15 states that it is necessary in principle and punishment for its absence. "But

The traffic police only advocates the abolition of liability for the presence of such a sign. That is, to remove the fine. But the “Spikes” sign itself should be left as a recommendation, the department believes.

And for this reason, there was a failure at the stage of discussing the draft amendments to the traffic rules,” the expert explained.

According to him, it is really not worth canceling the rule for drivers to stick a “Spikes” sign on their car, since motorists driving behind should be warned about the presence of studded tires on the car in front.

“We are now talking about leaving the traffic police officers, who were mercilessly fined for the absence of this sticker, without a “feeding trough”. But you will still have to install the “Spikes” sign (on a recommendation basis) - at least so that you are not held responsible for the accident. For example, in a case where the cause of the accident was a car with studded tires, but no sign. Still, the sticker changes the situation on the road,” Kanaev said.

Thus, if in the near future a traffic police inspector wants to fine a motorist 500 rubles for not having a “Spikes” sign, he will have every reason to do so. Therefore, for now it is better to buy a glass sticker and wait for the official announcement of the adoption of amendments to the traffic rules.

No more "Sh". The “Spikes” sign has been officially abolished in Russia

The cold weather has arrived, and seasonal queues line up at tire shops. Car owners change summer wheels to winter ones. It is high time! It’s just not clear whether it is necessary to put a warning sticker on the rear window stating that the car is equipped with tires with spikes.

Owners of studded tires are rejoicing: from December 8 of this year, they can legally rip off the “Spikes” sign from the rear window. The fact is that from this day onwards, a decree of the Government of the Russian Federation with amendments to the traffic rules, signed by the Prime Minister of the Russian Federation Dmitry Medvedev, will come into force.

Why was it cancelled?

The sign indicating studded tires has long become something of an anachronism. Previously, its purpose was to warn the vehicle behind that the owner of the letter “W” would brake almost instantly on an icy road. At the same time, the car behind, if it is moving on non-studded wheels, will take much more time to stop, which means it can easily “fit” into the rear of the car in front. Thus, the “Spikes” sign warns other road users that they need to be more careful and stay away from such a car.

From the point of view of the law, the sign no longer has any other functions. However, motorists, seeing a rear-wheel drive car on studded tires in front of them, tried not to stop behind such a vehicle at a traffic light. The reason is that the studs have an unpleasant property - they can “fly out” during a sharp start with slipping. This means that the windshield of the car behind is at risk...

And although the likelihood that a spike from under a car moving in front will “fly” into your head remains, legislators considered the “Spikes” sign to be no longer relevant. With the development of the automotive industry in recent decades, many other factors have appeared that affect the movement and braking of a car much more than studded tires. So now this sign cannot indicate how the car will behave on the road at one time or another, and practically does not carry any meaning for other road users.

The punishment is still in effect

Just don’t rush to run headlong to the car to remove the sticker from the rear window. The “Spikes” sign has not yet been officially canceled. And traffic police continue to vigorously fine drivers for not having the required sticker. Moreover, it must be carried out in accordance with GOST.

The “Spikes” sign is a white equilateral triangle with a base of at least 20 cm and a red border. And in the middle there should be a black letter “W”. The maximum sign size can be any. But even the smallest option still turns out to be quite large, so many drivers complain that the sticker only interferes with normal visibility and control over the road situation. And without her, everyone will definitely be better off.

Meanwhile, for the absence of a sticker with the letter “Ш” on a car with studded wheels, you may well be fined under Part 1 of Article 12.5 of the Administrative Code of 500 rubles. However, given that the resolution to cancel the sign has already been adopted and will come into force in the near future, the traffic police inspector may well limit himself to a verbal warning.

There are fewer absurdities in traffic rules

November 2021 turned out to be unexpectedly rich in various innovations, important and not so important, that affected traffic rules.

In addition to o, the term “pedestrian” was more widely represented. In particular, disabled people using a motorized wheelchair were included in this category.

Until this moment, an absurd situation had developed when people in wheelchairs without a motor were classified as pedestrians, and if the wheelchair was modern and equipped with a motor, then it turns out that the disabled person automatically became a driver. Now the conflict has been resolved.

In addition, disabled people of all groups (and not just I and II, as before) received more parking opportunities. Signs prohibiting parking both permanently and separately on even and odd dates no longer apply to cars driven by disabled people (regardless of the disability group). Such cars must be affixed with a special “Disabled” sign, which is issued only in specialized medical institutions.

The Decree of the Government of the Russian Federation also makes certain adjustments to the rules for registering an accident if there were no casualties or injuries and the damage was caused only to property. In this case, you can use a simplified collision registration scheme - the European protocol. If previously, according to clause 2.6.1 of the traffic rules, drivers in the event of disagreements about the circumstances of an accident were required to call traffic police officers, then since the summer of this year they have been allowed to draw up documents without the police even in the presence of disagreements. The truth is that the amount of damage does not exceed 100 thousand rubles (or 400 thousand rubles for Moscow and St. Petersburg).

We really hope that such innovations will appeal to the majority of Russian motorists! Good luck!

The fine for the absence of a “Spikes” sign has been canceled

Among the list of traffic rules identification signs, the “Spikes” sign was perceived ambiguously by drivers for a long time: the requirement to install it when using studded tires was not always considered mandatory. At the same time, studs have a significant impact on safety, and changes in traffic legislation could not fail to take this into account.

Until recently, the presence of the “Spikes” sign on cars with studded tires was mandatory, and its absence was subject to a fine of 500 rubles or a warning.

From December 8, 2021, the “Spikes” sign is excluded from the traffic rules (note – Government Decree No. 1414 of November 24, 2019). That is, now the presence of the “Spikes” sign on vehicles is not mandatory, and accordingly, a fine for its absence is no longer imposed.

However, there are quite good reasons why we recommend that drivers continue to mark their vehicles with the “Spikes” sign in the winter when driving on studded wheels. Below you will find answers to the following questions:

  • Why was the mandatory use of the “Spikes” sign canceled?
  • Why should you continue to use the “Spikes” sign?
  • What size should the “Spikes” sign be and where is the best place to glue it?
  • Additional information about the cancellation of the fine for the absence of the “Spikes” sign.
  • Why o?

When the “Spikes” sign was declared mandatory to designate cars with studded tires, the logic of the legislators was that a car with such tires brakes much more sharply. Therefore, the driver following you must be aware of your spikes in order to maintain a sufficiently large distance.

In fact, contrary to this logic, the braking distance of a car depends primarily on its weight, the presence of electronic safety systems and weather conditions. The mere presence or absence of studs on a tire, if it has any effect, is far from primary.

Perhaps 30 years ago the “Spikes” sign had some meaning, when everyone drove all-season tires and studs were quite rare. Then, probably, cars with spikes really braked noticeably sharper than all other cars. But nowadays this is no longer the case.

The “Spikes” sign has lost its original meaning, since today more than 70% of motorists, that is, the vast majority, drive studded tires. Therefore, if you need to mark some cars in traffic with winter tires, then it would be more logical to stick the sign on cars with Velcro rather than with studs.

Why then stick the “Spikes” sign on your car?

The use of studded tires in winter created not only safer and more comfortable conditions for drivers and passengers of such “re-shod” cars, but also certain problems for other road users, especially those driving behind.

The main danger from cars with “spikes” is small crushed stone, which can fly out from under the studded wheels and damage the car driving behind, or even injure the driver. And a spike flying out of a tire can also seriously damage the windshield.

It is for the reasons mentioned above that we recommend that all conscious drivers continue to mark their cars with the “Spikes” sign when using studded tires.

By the way, experienced motorists can recall cases when traffic police inspectors concluded that cars colliding “in single file” on a slippery road were mutually at fault only because the car ahead on spikes did not have the “Spikes” identification mark installed. And no appeals to the fact that the rear car did not keep the required distance helped.

Another thing is that the use of new technologies in the production of car tires has made it possible to create models of winter tires that are not only not inferior in braking efficiency to studded ones, but also superior to them in many situations (studs or Velcro - which is better?). Therefore, an increased distance to the car in front must be maintained by cars with spikes too.

What size should the “Spikes” sign be and where should it be placed?

Before the abolition of the mandatory use of the “Spikes” sign, with the beginning of the winter season in car dealerships, the stock of stickers with its image was often insufficient.

In this regard, the independent production of a sign was very relevant and many car enthusiasts needed information about the shape, size and color scheme of the sign.

  1. In accordance with the old version of the Road Traffic Rules, the “Spikes” sign is an equilateral triangle with the letter “W” inside it.
  2. The triangle is positioned with the apex up, and the length of the side is at least 20 cm.
  3. Along the sides of the triangle there is a border, the width of which is ten percent of the length of the side.
  4. Color scheme: the sign has a white background, a red border, and the letter “Ш” is black.

Where can I download the “Spikes” sign and how to print it correctly?

If you have the opportunity to use a color printer, the “Spikes” sign can be downloaded from this link and then printed. It is advisable to do this on thick paper, for example, photo paper with a density of up to 150 g/m2, otherwise the sign will turn out to be short-lived.

If only a black and white printer is available, then we suggest downloading the black and white “Spikes” sign, and the printout will need to be modified: use a brush with red paint or a red felt-tip pen to color the edge of the sign.

Cause oh

Before explaining the reasons for canceling the sign, it is worth understanding why it was introduced in the first place.

The fact is that traffic rules were approved decades ago, when the design of cars was significantly different from modern transport. At that time, studded tires were not common. A car with studded tires braked much more sharply, and other road users should have been warned about this feature.

A lot of time has passed since then. The braking distance of a car is now more influenced by other factors:

  • electronic control systems, vehicle weight, weather conditions, road conditions.

In addition, the number of cars with studded tires has increased significantly. There are so many of them that the “Spikes” sign needs to be glued to almost every one.

Before the sign was abolished, traffic police officers could not only fine people for not having one, but also blame the owners of studded wheels for collisions with other cars. According to their logic, a driver who hits a car from behind is not to blame if this vehicle has studded tires and is not equipped with a state warning sign. This opinion is fundamentally wrong, for the reasons already described above.

Thus, the Decree of the Government of the Russian Federation on o was absolutely justified and expected. It was especially expected during the last year, since it was during this period that fines for not driving a car were introduced.
