What is the fine for not allowing a pedestrian to pass?

If a pedestrian had to change their trajectory or speed because of a car, the owner of this car will be fined from 1,500 to 2,500 rubles.

The traffic police officer decides what amount of fine to impose. He will look at the driver's violation history. If the motorist has already received a fine for such a maneuver or is a persistent offender, they will most likely issue a maximum fine of 2,500 rubles. If there are few violations or no similar offenses are noticed on the driver, they will issue a minimum fine of 1,500 rubles.

What to do if you hit a pedestrian

It happens that a driver, thinking that a pedestrian has cleared the road, or simply not noticing him, touches a person with his vehicle or even pushes him. This violation of the rules is not as serious as, for example, hitting a pedestrian, but no less alarming for both parties: the driver is worried about the punishment, the pedestrian is frightened by what happened.

In such a situation, under no circumstances should you leave the scene of the incident. It is worth getting out of the car and asking the person if everything is okay. If he falls or hits himself, even if the collision was very minor, you should suggest that he drive to the hospital or call an ambulance. It is necessary to call a traffic police inspector.

Penalties for accidents with a pedestrian in 2021:

  • In case of minor damage - confiscation of the certificate for 1–1.5 years or a fine of 2500–5000 rubles.
  • Moderate damage - up to 20,000 rubles. or deprivation of rights for 1.5–2 years;
  • If a pedestrian is seriously injured or killed, penalties up to and including imprisonment apply.

When is a fine issued for not allowing a pedestrian to pass?

In almost all cases, when a pedestrian appears on the roadway, the driver is obliged to give way to him. Let's consider all the situations described in the traffic rules:

  1. at a pedestrian crossing;
  2. when turning at an intersection;
  3. when entering and leaving the adjacent territory;
  4. for not allowing blind pedestrians to pass;
  5. for failure to pass on the way to public transport;
  6. on the side of the road - there the pedestrian should not be disturbed by riders on horses.

How to properly let a pedestrian pass

The question posed is extremely interesting to many drivers, since the text of legislative documentation has changed very often in recent years. As a result, this has led to the fact that many drivers simply do not know what order is in force now, and often act intuitively.

If we re-read the described cases, we can conclude that in almost all situations the driver is obliged to give way to the pedestrian. In other words, we are talking about the requirement not to resume movement until the pedestrian has completed his journey across the road.

Fine for repeated failure to allow a pedestrian to pass

There is no such fine. A violation is considered repeated if it is repeated within a year. If a driver fails to let a pedestrian pass three times in a year, the punishment will not increase; the second and third time there will be a fine in the same amount.

When can you avoid a fine for failure to pass a pedestrian 2021

Let's consider situations where a driver has an advantage over a pedestrian. If an accident occurs, the motorist will be innocent.

A pedestrian crosses the road at a red traffic light. At traffic lights, pedestrians are prohibited from crossing to red.

The pedestrian was riding a bicycle. When crossing the road at a pedestrian crossing, the cyclist must step off onto the sidewalk and walk.

When driving in unequipped places. Without a pedestrian crossing, the road can be crossed at right angles to the edge of the road. It is prohibited to linger on the road or interfere with the passage of cars. This is stated in the traffic rules, in the section for pedestrians.

If the car owner's DVR records a pedestrian intentionally stopping on the road, this will help avoid a fine.

When crossing the road in prohibited places. A pedestrian can cross a road where there is no dividing strip or fences. But if a two-way road is separated by markings, a curb or a concrete barrier, crossing it is prohibited. If an accident occurs, the pedestrian will be in the wrong. This is written in the traffic rules.

To prove innocence will help:

  • DVR. The recording can be shown to the traffic police officer who stopped you for the violation. If he refuses to look, later attach them to the complaint and submit to the traffic police;
  • photo and video materials from the camera. Often a traffic police officer looks at only one photo and decides whether to issue a fine. At the Center for Automated Recording of Administrative Offenses in the Field of Traffic (CAFAP), you can obtain the entire series of photographs and even video recordings, if the camera has the technical capability.

A car is a vehicle that poses a serious danger to all road users. It can seriously injure a person or take their life. That is why a fine for failure to allow a pedestrian to pass at a pedestrian crossing has been established at the legislative level in 2021. For such an offense you will have to spend up to 2.5 thousand rubles. A protocol is most often issued by a traffic police inspector when a car does not stop in front of a pedestrian crossing a zebra crossing.

At the same time, the designated norm contains a contradiction in the interpretation of the concept of “give way.” At the same time, disputes arise among drivers, traffic police officers, and judges.

The term was formally established in clause 1.2 of the SDA. Thus, the term “give way” refers to the driver’s actions aimed at:

  • maintaining its static position relative to traffic participants who have priority;
  • stopping the car to give the right of priority maneuver to persons having priority;
  • refusal to perform a maneuver that may interfere with traffic participants who have priority.

At the same time, failure to comply with these conditions leads to a violation if persons with advantage had to change the speed or direction of movement. It is this formulation that has become a weak point in the legislation. It is almost impossible to prove that it was the fault of the driver who did not give way that the other participant changed his direction of movement or his speed. Therefore, on November 29, 2014, clarifying amendments were made to the relevant paragraphs of the traffic rules.

Now, in accordance with the standards, the passage of intersections is carried out in accordance with the following requirements:

  • The driver of a car, approaching an unregulated crossing, must give way to all pedestrians moving along it, as well as those entering it. (clause 1 of the traffic rules )
  • The person driving the car is obliged to slow down following the vehicle in front approaching the zebra crossing. (clause 2 of traffic rules )

In order not to break the rules and not to part with an impressive amount of money, you need to competently let pedestrians pass at the crossing. To do this you will need:

  • Pay close attention to road signs and markings.
  • Slow down before approaching a zebra crossing.
  • Look around the sidewalks.
  • If a pedestrian is approaching a crossing and will be there before a car has passed, you should brake.
  • If the pedestrian does not have time to reach the crossing before the car crosses it, the driver can move on without changing the speed or, if necessary, increase it.
How can you prove your innocence to the inspector?

Firstly, it is worth carefully understanding the circumstances of what happened. A video recorder, which is installed in almost every car, will help in this matter. If you provide evidence of your innocence to a traffic police officer, he may simply let the driver go. Otherwise, you will have to appeal the decision later.

Secondly, if the driver agrees with the violation, he can try to appeal to circumstances of extreme necessity. Such circumstances include transporting children to the hospital or women in labor. In addition to these situations, other situations falling under the definition of Art. 2.7 Code of Administrative Offences. It consists of intentions to eliminate a danger to a person’s personality or his rights, if the harm caused is less significant than the harm prevented.

  • Consent with the violation.
  • Correction.
  • Self-appearance.
  • Providing assistance during the proceedings.
  • Initiative compensation.
  • Violation in a state of passion or due to difficult family circumstances.
  • Pregnancy.

Also, a judge or inspector may decide to mitigate the fine based on other circumstances that objectively affect the driver’s behavior. Don't be afraid to defend your position. During the investigation, the following factors should be identified as distractions from the roadway:

  • poor visibility (specify how many meters);
  • weather conditions;
  • poor condition of the road surface;
  • numerous advertisements along the roadway;
  • deviation of a pedestrian’s speed from the average (fast step, run).
Individual cases

In most cases, the pedestrians themselves become the offenders. In some cases you can skip them:

  • If the pedestrian traffic light is red.
  • If, when braking sharply in front of a zebra crossing, there is a risk of a vehicle colliding with a car moving behind. At the same time, it is important not to forget to honk at the pedestrian so as not to hit him.

Some drivers forget to give way to pedestrians crossing the road at the wrong zebra crossing. At the same time, sometimes you need to yield even if a pedestrian crosses in the wrong place. In this case, the pedestrian participant:

  • crosses the roadway, and the car moves around a bend (clause 13.1. Traffic rules);
  • crosses the roadway in the adjacent territory, and the car drives into the yard (clause 8.3. Traffic rules);
  • crosses the road in the adjacent territory, and the vehicle leaves the yard (clause 8.3. Traffic rules);
  • blind (clause 14.5. Traffic rules);
  • walks towards public transport next to the stop (clause 14.6. Traffic rules).

The cameras are located at intersections where pedestrians are most often hit. The device calculates the trajectory of the car and the pedestrian as soon as the car is in its visibility range. If the camera notices that a pedestrian has changed speed, direction or stopped, the driver will receive a fine. Every driver should know how to behave if a person is hit at a pedestrian crossing.

The main thing is not to panic and not to leave the scene of the accident. Remember, there will always be witnesses who remember the license plate number of your car, and it won’t be difficult to find you.

By leaving the scene of an accident, you will not escape responsibility, but you will be able to toughen your punishment.

Procedure if a pedestrian gets hit by the wheels of your car at a zebra crossing:

  1. stop the vehicle and get out of the car;
  2. do not turn off the DVR;
  3. call an ambulance and the police;
  4. install an emergency sign;
  5. provide assistance to the victim;
  6. take photographs from the scene of the accident;
  7. wait for the patrolmen;
  8. report the incident to the insurance company.

What to do if you receive a fine for not allowing a pedestrian to pass

Depending on the situation, there are three options: challenge the fine, pay half or the entire amount.

Challenge the fine. The driver has the right to appeal the decision of the traffic police, even if the basis for the fine was photo and video materials from traffic cameras. Reasons why a fine can be challenged:

  • the traffic camera made a mistake - the car had the wrong license plate or the pedestrian was too far away;
  • the markings or sign were not visible - for example, due to fog or snowfall;
  • the driver was absent from the scene of the violation.

The driver can appeal the decision within 10 days from the date of the document. The date can be viewed on the paper order or when checking the “Traffic Police Fines”.

The grounds for appeal are best supported by the dash cam footage. Write it down on a flash drive or disk and submit it to the traffic police officer along with your complaint. If the traffic police refuses, the driver has the right to go to court

Pay with a discount. If the driver agrees with the ruling, he can save on paying the fine. The law allows you to pay a fine with a 50% discount in the first 20 days from the date of the decision. If a driver receives a fine of 2,500 rubles for not allowing a pedestrian to pass, in the first 20 days he can only pay 1,250 rubles.

Pay the full amount. If the letter arrived late and the driver received the letter for 21 days, he has another 40 days to pay the fine, but at full cost. What to do if you receive a fine

Some drivers are perplexed when they receive notices of fines for not allowing pedestrians to pass at crossings, and some even go to court, disagreeing with the decision of higher authorities. However, if a traffic violation was committed, it is better to just pay and not create unnecessary trouble for yourself.

A driver can be fined in different ways. The document is presented:

  • By mail to the addressee. In the mailbox you can find an envelope with a letter from the inspection.
  • To an email address - a more modern method.
  • On the spot, right on the road or at a pedestrian crossing by a traffic police inspector.

Payment

There are several ways to pay the fine:

  • In the bank. The advantages are reliability of payment and the fact that another person can pay the fine on behalf of the violator. The downside is possible queues.
  • At the Russian Post office. The method is the same as in a bank.
  • Through mobile banking.
  • On the traffic police website. You can pay the fine using electronic wallets or a bank card. We need information about the vehicle registration certificate.
  • Via Qiwi terminal. To do this, you need to select “payment”, “Staff traffic police payment of fines”, indicate the necessary information and deposit funds, and then pick up a payment receipt.
  • Through State Services, if you have a fully officially confirmed account.
  • Using electronic payment systems, also selecting “traffic police fines” there, indicating payment methods, details, type of fine, and so on.

Sanctions

If the fine for not allowing a pedestrian to pass on the road is not paid within the prescribed period, the person fined can face serious consequences. The driver is given 60 days to pay the fine. If by 61 days the funds have not been received to the specified details, the defaulter will be obliged to:

  • pay this fine in double amount;
  • perform community service for 50 days;
  • serve the arrest within 15 days.

Important! If the offense was recorded on camera, there will be no arrest.

Remember

  1. Giving way to a pedestrian means stopping and not moving so that his speed and trajectory do not change.
  2. The fine for not allowing a pedestrian to pass is from 1,500 to 2,500 rubles.
  3. You can receive a fine if you do not allow a pedestrian to pass at a crossing, on the side of the road, when entering and leaving the adjacent territory, as well as for not allowing a blind pedestrian to pass.
  4. A fine can be avoided if a pedestrian did not cross the road according to the rules: he walked on a red light, did not get off his bike at an intersection, crossed the road in unequipped or prohibited places.

  6. The deadline for paying a fine for not allowing a pedestrian to pass is 70 days from the date of the decision.

Important! Amendments adopted on October 11, 2017 completely prohibited overtaking at any pedestrian crossing. Before the amendments were made, vehicles could be overtaken if there was no pedestrian at the crossing. Overtaking is now completely prohibited. If this rule is violated, the driver also faces a fine for not allowing a pedestrian to pass.
