When is a fine imposed for driving on the side of the road?

The amount of the fine for driving on the side of the road is established by the Code of Administrative Responsibility of the Russian Federation. Penalty for driving on the side of the road

Driving on the left shoulder of the highway in violation of the markings in 2021 is punishable more seriously. Driving on the side of the road is prohibited. This is what paragraph 9.9 of the Traffic Rules talks about. True, as is usually the case, every rule has exceptions. They exist in this case too.

Who can drive on the side of the road?

Cyclists over 14 years of age may ride on the side of the road. But only if there are no bicycle and bicycle pedestrian paths, a lane for cyclists, or the ability to move along them or along the right edge of the roadway (clause 24.2 of the Russian Traffic Regulations). There is clause 25.2 in the traffic rules, which allows horse-drawn carts (sleighs), riding and pack animals to move along the side of the road, but only in one row and possibly to the right. In addition, these categories of transport should not interfere with pedestrians.

The word “roadside” is also found in paragraph 8.8 of the traffic rules. It states that the driver of a car can pull onto the side of the road to make a U-turn outside the intersection if the roadway is not wide enough to perform the maneuver. In this case, the driver must give way to passing and oncoming vehicles.

What are the dangers of driving on the side of the road?

In all other cases, driving on the side of the road falls under Part 1 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation, which prescribes that a driver for violating the rules for placing a vehicle on the roadway should be punished with a fine of one thousand five hundred rubles.

Avoiding obstacles

What to do if the roadway consists of one lane and a shoulder and an obstacle has formed on it?

First, let's define what an obstacle is. An obstacle is (clause 1.2 of the traffic rules) a stationary object in the traffic lane (faulty or damaged vehicle, defect in the roadway, foreign objects, etc.) that does not allow further movement along this lane. A traffic jam or a vehicle stopped in this lane in accordance with the requirements of the Rules is not an obstacle.

In this case, the driver must move in the detour direction indicated by the mandatory signs. If they are not there, you should go around the obstacle along the side of the road. If this is not possible, then drive in the oncoming lane.

A little about the rules

  • The car moves without changing lane. To get ahead of another vehicle, the car simply increases its speed;

Current traffic rules confirm that overtaking and ahead are not identical concepts. If overtaking can only be done on the left side, then overtaking is possible both on the left and on the right.

Overtaking is not a maneuver that involves getting ahead of a vehicle without crossing existing road markings. Also, a situation where a car is ahead on the right side, but the overtaking person does not go into oncoming traffic, cannot be considered overtaking. This is relevant if the maneuver is performed on a two-lane road, where one lane is directed in each direction. It is difficult to get ahead in one lane; overtaking is mainly carried out here. If there are more lanes, then it is better to get ahead of the car, that is, not to end up in the oncoming lane.

Punishment for driving on the side of the road in St. Petersburg and the region in 2021 is also regulated by federal legislation. The violator may be fined 1,500-5,000 rubles depending on the side of the road on which the movement was carried out and the fact of crossing the solid line. Sometimes deprivation of a driver's license is applied. They can be confiscated for up to six months. If a St. Petersburg resident drives onto the side of the road in violation of the markings again, the duration of the punishment will be 1 year. For example, cameras that automatically record violations have been operating in large cities for a relatively long time. It should be noted that many drivers are skeptical about this, but those violators who have already received fines for driving on the side of the road in the amount of 1,500 rubles think completely differently.

Indeed, unconditional punishment with a ruble is much more effective than talking with traffic police inspectors. The violator received a fine and will be required to pay it off so as not to get into trouble with the law. If the driver does not comply with the markings or does not take into account the signs, Article 12.16 of the Code of Administrative Offenses of the Russian Federation applies. It involves a fine of 500 rubles. If a person does not turn on the turn signal, Part 1 of Article 12.14 of the Code of Administrative Offenses of the Russian Federation comes into force. The amount of the penalty is exactly the same as for the previous offense.

When driving on the side of the road in 2021, the degree of danger for the driver and other road users increases. Dust rises and visibility deteriorates.
