According to the legislation of the Russian Federation, a person has the right to replace domestic passports in the event of their loss or natural wear and tear. This applies to a passport, birth certificate, identification code and any other personal documents.

But there are also certificates that indicate a certain period of validity, after which the citizen is deprived of his powers and privileges. These include: passes, medical certificates, foreign certificates and driver's licenses. Moreover, for the latter type of certificate, depending on whether it meets international standards or GOST of the Russian Federation, the duration period will differ significantly.

For Russian ID

After successfully passing the theoretical and practical exams at a driving school, each citizen receives a Russian-style driving license. There, under indexes 10 and 11, it is indicated when the validity of the driver’s license begins and when it ends. According to generally accepted standards, this period reaches 10 years. But under certain criteria (if the owner is retired or has health problems), the duration of the document may be slightly reduced.

For international rights

When applying for a license to drive a car or motorcycle outside the Russian Federation, a person receives an international certificate, which is considered valid in other countries for 3 years. Next, the driver should renew his foreign driving license, or replace it with a new document (if the application for an extension of the period was submitted too late).

Without fulfilling these requirements, a citizen has the right to travel in his personal car only in those countries that are parties to the Vienna Convention.

In the remaining territorial divisions, the police can issue him a fine for driving without the necessary documents.

Will my license be changed if there are unpaid fines?

The first thing we will find out is the replacement of rights due to their expiration (we will describe the case of damage to rights below). The validity period of the license is 10 years, after which they need to be replaced, for which you need to obtain a medical certificate and pay a state fee for the replacement. But do you need to pay existing traffic police fines for this?

In theory

No no need. There is no such basis in any regulatory act, and the traffic police registration offices do not have the right to demand payment of all fines when replacing licenses. An exhaustive list of grounds for refusal to issue a driver’s license is listed in paragraph 23 of PPRF No. 1097. These include forgery of documents, the presence of information about the applicant’s deprivation and others, but there is not a word about the presence of unpaid fines.

Thus, in theory, if there are fines, the license should be changed.

On practice

But in practice, sometimes inspectors try to demand payment of all traffic police fines and refuse to issue a license. Moreover, the replacement of rights is the most common situation of illegal refusal.

What should I do?

Everything is quite simple: you submit an application for replacement of rights in writing (there is no other way). Accordingly, the refusal must also be written and motivated - that is, the traffic police officer is obliged to indicate the reason for the refusal of this public service. The fact is that there is a direct instruction from the authorities of the Ministry of Internal Affairs that it is illegal to demand payment of all traffic police fines in procedures that do not require this by law. And this is an indication from 2009, but also valid for 2021.

If a written refusal is provided, you will need to write a complaint addressed to the head of the given traffic police department, as well as to the prosecutor's office about unlawful actions of employees. And then demand the replacement of rights only through the courts.

But there is a risk!

Which? The point is that the legislation of 2021 contains penalties for late payment of fines and the legality of prosecution for late payment. There is Article 20.25 of the Code of Administrative Offenses, according to which you can be arrested for up to 15 days, and you can be taken away directly from the registration office, just when you begin to defend your rights according to the instructions above.

This article has a period of attraction; in short, it begins on the 71st day from the date of the decision and is valid for 3 months. That is, roughly, if more than 160 days have passed since your last fine or 70 days have not yet passed, then they will no longer be able to attract you. Again, there is a way out here too. You can send your authorized representative – any person – to receive a driver’s license. To do this, you will need to write a power of attorney for him and have it notarized.

In what cases is the validity period of a temporary residence permit reduced?

In accordance with the law of the Russian Federation (namely, clause 35 of the regulations on the issuance of a driver's license), the validity period of a license for a car or motorcycle can be forcibly reduced. This happens in the following cases:

  • The owner of the document has changed his personal data (a striking example is the change of the maiden name through the registry office. Less often, the change of initials occurs at one’s own request);
  • The papers required to obtain a license were deliberately falsified (this applies to a certificate from a psychiatrist, ophthalmologist or narcologist, as well as a certificate of completion of a driving school);
  • The surface of the ID contains severe mechanical damage and abrasions, due to which identification of the person is not possible (the driver’s photo, his last name or first name are not visible);
  • The driver's license was lost or stolen, about which there is a corresponding statement;
  • Deterioration of the driver's health (loss of vision, development of mental disorders or other disorders in which driving is strictly prohibited).

For the listed criteria, the validity of a driver’s license may be reduced by several years (including up to the number indicated on the cover) or completely.

To renew the document, you need to take repeated exams at the traffic police and, if necessary, courses at a driving school.

When does enforcement of the deprivation of rights order begin?

Let's consider part 1 of article 32.6 of the Code of Administrative Offenses:

1. Execution of the decision on the deprivation of the right to drive a vehicle of the corresponding type or other types of equipment is carried out by confiscating and storing during the period of deprivation of the specified special right, respectively, a driver’s license, a certificate for the right to drive vessels (including small-sized ones) or a tractor driver’s (tractor operator) certificate, if the driver, navigator or tractor driver (tractor operator) is deprived of the right to drive all types of vehicles, vessels (including small ones) and other equipment.

Those. The execution of the decision on deprivation of rights means that the driver’s driver’s license is confiscated. At first glance, it seems that if the certificate is not handed over, then the decision will not be executed.

However, part 1 of Article 32.7 of the Code of Administrative Offenses says something else:

1. The period for deprivation of a special right begins from the day the resolution imposing an administrative penalty in the form of deprivation of the corresponding special right comes into force.

That is, the period of deprivation of rights begins regardless of whether the driver has handed over his license to the traffic police or not. Thus, the decree on deprivation of rights is executed.

Where can I renew my license?

10-15 days before the expiration date of the license, the motorist needs to submit an application for its renewal. The following structures usually deal with this issue:

  • Traffic police department;
  • Multifunctional Center;
  • State services website.

traffic police, the citizen should collect a list of required papers and attach copies of his passport and medical certificate to it. Next, all this is submitted to the responsible traffic police officer, paired with an application, after which the person will be assigned an appointment date for the issuance of a new driving license.

Having arrived on time, you must be dressed in accordance with all the rules for a photograph for an ID (without a headdress, in formal clothes, with light makeup). After taking a photo, a police officer will process it within an hour and give you a ready-made ID.

At the MFC

If you notice that your license is valid until tomorrow inclusive and you do not have the opportunity to go to the traffic police, there is always a backup option - contact the multifunctional center. As in the first case, to create an application you will need to collect all the necessary papers and certificates. After this, an MFC employee will give you a ticket for an appointment with a consultant.

You can show up on the appointed date only after paying a single state fee (regardless of whether you are renewing your license for a moped or a small car, the cost of this service will be the same - 2000 rubles).

At the same time, they will be able to issue you a new driving license no earlier than 5 working days from the date of submission of the application.

Changes to replacing a driver's license in 2021

  3. Then you just have to wait for the documents to be ready. You may be notified of this via call, SMS or email.
  4. Pick up a new driver's license.

The time frame for replacing a device at the MFC ranges from 3 days to 9 days with rare exceptions.

Last year, the procedure for replacing USSR licenses with Russian ones was simplified, but now, starting this year 2021, the procedure for replacing licenses that were issued in the USSR (before January 1, 1992) has become exactly the same as for any foreign certificates. To exchange a driver's license issued in the Soviet Union, the following documents are required:

You can replace rights in three ways:

    . This is the fastest way, despite the need for personal presence. You need to come to the traffic police department with a prepared package of documents - it all depends on the workload of the employees, but in most cases you can get a new license in a couple of hours.
  • Through MFC
    . The method is convenient, since the MFC is now at every step, but it is suitable for those drivers who are willing to wait a little. Accordingly, you should not go to the MFC on the last day of validity of your old rights. From the moment you submit your application until you receive a new certificate, it takes about 10-14 days. This is explained by the fact that MFC employees send the received documents to the traffic police and then receive them back.
  • Through State Services
    . To do this, a person must be registered on the portal.

To replace your driver's license you will need:

  • citizen's passport;
  • application (filled out on site or electronically through State Services);
  • receipt of payment of state duty;
  • medical certificate in form No. 003-В/у;
  • driver's photograph;
  • current rights (to be replaced).

All documents must be originals. Copies are not accepted.

The state fee for replacing a driver's license upon expiration is 2,000 rubles.

Rospotrebnadzor has limited the operation of driving schools during the pandemic, so the registration and examination departments of the regional divisions of the State Traffic Inspectorate in all constituent entities of the Russian Federation have stopped full-fledged training. Changes have also been made to the rules for taking the driving test, but due to the pandemic they cannot be launched this year. The expected month for the changes to come into force is April 2021.

The main changes concern two aspects:

  • cancellation of closed site exams;
  • cancellation of standard city routes.

The first point means the exclusion from the general program of the practical stage on knowledge of traffic rules, which is carried out on a closed race track before the start of the theoretical exam and the main practical exam on city roads. This also means that exercises such as the snake, parking and boxing will no longer be part of the training program. This does not mean that on-court training is canceled entirely. Some of the exercises will simply be transferred to real roads.

The second point involves making changes in the design of exam routes when testing basic driving skills. According to the new rules, the exam will be held in parking lots and roads with limited traffic. However, examinees will be required to perform standard exercises such as turning a U-turn, parallel or perpendicular park, starting up a hill, etc., without modification.

Until the end of 2021, the law allows you to use a driver’s license, even after its official expiration date. But the document cannot be expired before February 2021. If the rights have not been renewed, the owner will be fined, the amount of which is established by law. However, a person can count on a deferment or transfer of the fine if he can prove the existence of compelling circumstances that prevented the timely renewal of the certificate.

The Federal Highway Safety Act sets the validity period for national driver's licenses. Rights are valid from the moment of transfer until the expiration of the period specified therein. If the validity period of the certificate is not specified, it is valid for 10 years from the date of issue.

You can drive the vehicle, including until the last day of the validity period. But it is better to take care of exchanging documents in advance. Indeed, in 2021, an expired certificate will be fined from 5,000 to 15,000 rubles. Instead of a fine, the court may impose administrative detention for up to 15 days or forced labor from 100 to 200 hours.

Driving licenses are issued for 10 years. They will be valid for the same amount of time, even if the validity period of the rights is not specified.

You can drive with your old license until the last day, and then apply for a new one. But it’s better to do this in advance - the traffic police writes on its website that you can submit documents at any time. If you provide a current medical certificate, your license will be granted for another 10 years.

Knowing for how long a driver's license is issued, a motorist can prepare in advance to receive a new one. To do this, he will need the following documents:

  • Internal passport;

The traffic police recommends replacing your expired driver's license by December 31

If a driver is stopped, and he tells the officer who stopped him that he forgot his license at home, the inspector has no right to believe him. The passport data will be checked against the information base; its duration depends on the quality of the connection. A positive test result will not relieve you of a fine. In order for the inspector to check passport data, the driver must have a general passport with him. If it is not there, detention may follow until the identity is established. If the driver did not manage to change his driver’s license in time, there is no need to make the excuse that he forgot it at home. The check will reveal the expired period, and an attempt to deceive will lead to a fine at the upper limit.

Some people start to worry when there is more than a year left before the deadline. This is premature; six months is the optimal time to start worrying about a replacement. If you put everything off for a month, then you can simply forget about it. Delaying may result in wasted time. Starting everything on the deadline day is risky; even a week in advance you will have to work hard to get it done. The registration itself takes a maximum of a couple of hours, if there are no inaccuracies in the documents. When changing your license, the most time consuming part is issuing a medical certificate. It is valid for 12 months, so it is better to apply for it in advance.

The previous restriction for foreigners, which allowed the use of a foreign driver's license for only two months, has now ceased to apply. Foreign rights are considered valid until the date written on them. The state that issued this certificate must sign as well as ratify the Vienna Convention. If a driver with such a license intends to work for hire, he should check whether his country is on the permit list.

So what is the penalty for driving a vehicle with an expired license? As of 2019, for such a violation you will have to pay from 5,000 to 15,000 rubles. Community service and administrative arrest are also provided.

If your documents have expired and you are stopped by a traffic police officer, it is impossible to find a loophole to get out of this situation. Even if all deadlines have expired on the current day, you will be fined for driving in violation to the fullest extent of the law. You can try to appeal the decision of the State Traffic Inspectorate representative, but there is practically no chance of winning.

Here we should take into account the concept of “knowingly”, which is of key importance in determining the severity of the offense and punishment. For example, if a vehicle was transferred to another motorist on September 30, 2021 under a general power of attorney for a whole year, but his driver’s license expired on November 1, this will have nothing to do with the owner, since he did not violate the law.

At the same time, if the right to drive a car was granted to another person on September 30, while the owner of the vehicle did not check his driver’s license, and it turned out that his documents were invalid as of September 28, then an administrative offense has been committed.

When changing your last name, it is not necessary to reissue your driver's license, since the document does not become invalid in this case. This means that the driver will not be fined.

But to be sure, it is still better to have a photocopy of the document confirming the change of surname (for example, a marriage certificate). If the inspector has questions, you can document your words.

You can also contact the traffic police, where, at the request of the car owner, changes will be made to the driver’s license and new full names will be indicated. But since replacing personal data will require the production of a new certificate, you will have to pay a state fee of 2,000 rubles or 3,000 rubles for a new certificate.

The amended rights are granted for the same period of validity as the previous ones, and not for ten years. For this reason, if there is little time left before the required change of driver’s license (for example, 1 year), you should not rush to re-register it just because of a change of name, so as not to have to do the same thing again in a year.

Documentary evidence of the right to drive a car is issued for a period of 10 years. When it expires, the driver must contact any traffic police department or MFC to replace the driver's license. The limitation on the validity period of the license was not established by chance - this ensures that motorists undergo a medical examination, since without a recent medical certificate, it is impossible to replace the license.

Administrative liability for this violation is established by Art. 12.7 Code of Administrative Offenses of the Russian Federation. At its core, driving a car with an expired document is equivalent to driving without a license and entails:

  • Removing the driver from control and detaining the vehicle - the car will be sent to the impound lot using a tow truck. In this case, the violator will have to pay both the cost of the tow truck and the time the car is in the impound lot.

In order to exchange a used license for a new one, in addition to a one-time fee, the driver will need to pay the following expenses:

  • Medical certificates (from a narcologist and a psychiatrist inclusive) - will cost about 1000 rubles;
  • Photos - within 200 rubles.

If an inspector refuses to extend the validity period of a driver’s license without additional payment for services, then this can be perceived as a direct violation of the law.

For this, according to the Constitution of the Russian Federation, a police officer can receive a significant fine or even lose his position.

How long is a driver's license valid?

A driver's license confirms the qualifications of a car enthusiast, providing access to driving a car. The validity period of a driver's document is regulated by:

  • Government Decree No. 1097, adopted in October 2014;

It is not possible to replace or extend the assigned validity date. In this situation, the car owner will have to obtain a new driver's license.

What is considered the last day of validity of the VU?

With the arrival of the last day of validity noted on the driver’s license, the document loses its validity.

Note! The date mentioned is considered inclusive.

If the VU says that it was issued on August 1, 2021, the validity ends the next day - August 2.

How long the license is valid depending on the nationality of motorists

When determining the validity period of a driver's license, it is important to consider the category to which the owner belongs. Various nuances are possible, depending on the nationality of the motorist and the legality of his presence on Russian territory.

For Russian citizens

National driver's licenses for a Russian citizen, according to the regulations noted above, are valid, respectively, for ten or three years for a national or international driver's license.

For foreign citizens

The duration of validity of a temporary residence permit for foreigners located on Russian territory, in addition to the national legislation of the Russian Federation, is regulated by international conventions.

As you can see, all of the above reasons are significant and therefore require immediate renewal of the certificate. After all, you cannot drive a car without a license.

Responsibility for driving with an expired document

In accordance with the Code of Administrative Offenses (namely Article 12.27), the use of an expired driving license is equivalent to driving without a license, for which the law provides for an impressive fine of 5 to 15 thousand rubles. At the same time, if a driver applies to the traffic police department with an expired license, the Code of Administrative Offenses deprives him of all responsibility, since if a person was not seen with an invalid license while driving, he is not considered an offender.

One conclusion can be drawn: knowing how long a driver’s license is valid is not enough. The main thing is to remember their expiration date and submit an application for a new document on time. Otherwise, the citizen will face serious fines, which may increase even more by 2021.

In addition to contraindications, the Ministry of Health has also developed a list of restrictions, that is, if you have certain diseases, a person can drive a vehicle equipped with additional devices.

For how many years is a driver's license issued after age 60?

  • date of birth of the driver (driver candidate);
  • address of permanent registration;
  • date of issue of the document;
  • directly the medical report resulting from the examination;
  • a list of categories of vehicles that, in the opinion of medical specialists, a given person is allowed to drive;

And one more important point: the current administrative legislation does not provide for a fine for overdue driver’s license. This only means that you cannot drive a vehicle if you have an invalid driver's license.

In this case, there is a fine of 5,000 to 15,000 rubles and a ban on operating the car and sending it to the impound lot.

Agree, the sanction provided for in the article is quite serious. This is understandable: you are driving a car without actually having any license to do so. But in this case, you can use a trick: do not present the expired document to the traffic police inspectors, say that you forgot it at home.
