How to legalize HBO in 2021?

Let's consider Section 4 of Chapter V of the Technical Regulations of the Customs Union On the safety of wheeled vehicles:

75. Verification of compliance with the requirements for vehicles in operation in the event of changes to their design is carried out in the form of a preliminary technical examination of the design for the possibility of making changes and subsequent verification of the safety of the design and technical inspection of the vehicle with changes made to the design.

During the preliminary technical examination, it is ensured that after changes are made to the design of the vehicle, its compliance with the requirements of these technical regulations that were in force at the time the vehicle was put into circulation will remain.

During the safety check of the vehicle design, it is ensured that after changes are made to the design of the vehicle, its safety meets the requirements of these technical regulations.

First of all, please note that this paragraph deals with two types of checks:

• Preliminary (before installing HBO);
• Safety check (after installing LPG).

A preliminary check must be carried out before gas equipment is installed on the vehicle. Those. First of all, the driver must “obtain permission” to install LPG. Technical examination is carried out in a specialized organization, and permission must be obtained from the traffic police MREO.

After this, you can contact an organization that installs gas equipment. We will not consider the technical side of the issue. It is important that after installation the organization gives you copies of certificates for the installed gas equipment.

Finally, a design safety inspection (in the same organization where the preliminary inspection was completed). Procedure for registration and installation of HBO

Registration of gas equipment is a rather labor-intensive process. It will not be possible to install and then register the HBO on your own. The law specifies that certified organizations must be involved in converting cars to run on gas.

The installed system must also have documents confirming its quality and safety. In this regard, it is recommended to begin the installation process of gas equipment with the selection of a suitable organization. It is recommended to give preference to reputable companies that have the necessary certificates.

In each region of Russia there are several organizations that have long been involved in converting cars for LPG. It is recommended to contact such companies, despite the somewhat inflated prices compared to “young” competitors.

After a company that will install gas equipment has been found, you need to proceed according to the following algorithm.

1. Obtain a certificate from the selected organization confirming the possibility of installing gas equipment.
2. Submit an application to the traffic police with a request to install gas equipment (employees can conduct an additional inspection of the car) and obtain permission to carry out the conversion.
3. With an application containing a permit from the traffic police, you need to go to the selected company and select an LPG kit for installation on your car.
4. After this, the organization’s employees will install the equipment and provide the owner of the machine with the relevant documents. He, in turn, must ensure that the organization issues a complete package: a passport for the cylinder, a service agreement, certificates for equipment, certificates F-2a and F-2b.
5. Next, the organization inspects the converted vehicle and issues a conclusion stating that the gas equipment was installed according to existing standards, the vehicle is not dangerous during operation, and changes have been made to the design of the vehicle.
6. With the received documents, you must go to a regular service station to have your car inspected.
7. At the end of the procedure, you must contact the traffic police, provide the necessary documents, pay the state fee and receive a PTS and STS with notes that the car has been converted to use gas.

Large companies involved in the installation of gas equipment can offer their clients. It involves the preparation of all necessary documents by a company employee. The average cost of re-equipping a car in Russia is about 40,000 rubles.

If the car manufacturer has provided for the presence of gas equipment in the vehicle configuration and there is a corresponding entry in the factory title, then there is no need to register gas equipment.

When is it not necessary to undergo verification?

Let's consider paragraph 77 of section 4 of chapter V of the technical regulations:

77. Vehicles are not subject to inspection in the following cases:

1) when installing components on a vehicle:

• intended for this vehicle and have undergone conformity assessment as part of this vehicle, which is confirmed by the documentation of the component manufacturer;
• provided by the vehicle manufacturer in the operational documentation;

2) when serial changes are made to the design on the basis of design documentation developed and approved in the prescribed manner, if on its basis an assessment of the conformity of the changes made was carried out.

If the manufacturer provides for the installation of gas equipment on a car (modifications of this model equipped with gas equipment are produced from the factory), then the technical examination does not need to be completed.

Note. Nevertheless, information about HBO should in any case be included in the registration documents of the car.

Fine for HBO without documents 2021 in Russia

It is issued after reviewing the protocol on the violation drawn up by the traffic police officer. The reason for drawing up a protocol may be:

• lack of documents for self-installed gas equipment;
• The car owner missed the deadline for the next periodic inspection of the equipment.

Illegal modification of a car or violation of technical inspection deadlines for gas equipment pose a danger to the driver himself, his passengers and other road users.

Therefore, in addition to an administrative fine, traffic police officers can take other measures, for example, deregistering a car with unregistered gas equipment.

Current legal framework (article)

Owners of a car with an unregistered gas equipment pay a fine based on Part 1 of Art.

In this case, the action consists of illegally (not complying with established rules) installation of cylinders in a car. Termination of such action may be:

1. removal of illegally installed cylinders;
2. registration of cylinders in the manner prescribed by law;
3. putting the documentation on the cylinders and the car in order.

If the inspector decides to act in accordance with Law No. 3-FZ, then he will have to issue a requirement to the driver to stop the actions that constitute an offense. Such requirement must be fulfilled within 10 days after receipt of the request.

Also, an arrest for 15 days may be initiated against him.

Periodic inspections of gas equipment

The driver of the vehicle must undergo periodic checks of gas equipment and gas cylinders:

9.8.3. Gas cylinder equipment on vehicles in specially authorized organizations is subjected to periodic testing at intervals that coincide with the frequency of inspection of cylinders established by the cylinder manufacturer and specified in the passport for the cylinder (cylinders). Based on the results of periodic tests, specially authorized organizations issue a certificate of periodic testing of gas-cylinder equipment installed on the vehicle.

Typically such inspections are carried out every 2 years. In this case, the driver must receive a document indicating the date of the last inspection and the date of the next inspection. Most often, the inspection is carried out by the organization that installed the equipment.

9.8.6. Not allowed:

9.8.6.1. Use of gas cylinders whose periodic inspection period has expired.

9.8.6.2. Failure to secure components of gas equipment.

9.8.6.3. Gas leaks from elements of gas equipment and at their connections.

The use of gas cylinders that have not passed periodic inspection is prohibited.

Registration of gas equipment with the State Traffic Inspectorate

Registration of a vehicle after installation of gas equipment is no different from the usual registration, which we described here.

Fine for illegal installation of gas equipment on a car

The operation of gas equipment includes paragraphs 7.14 and 7.18 of the list of malfunctions and conditions under which the operation of vehicles is prohibited:

7.14. The technical parameters indicated on the outer surface of gas cylinders of cars and buses equipped with a gas power system do not correspond to the data in the technical passport; there are no dates for the last and planned inspection.

7.18. Changes have been made to the design of the vehicle without permission from the State Road Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation or other bodies determined by the Government of the Russian Federation.

Clause 7.14 refers to periodic checks of gas equipment, clause 7.18 - to the operation of a car with illegally installed gas equipment.

Punishment for these violations is provided for in Part 1 of Article 12.5 of the Code of Administrative Offenses:

1. Driving a vehicle in the presence of malfunctions or conditions under which, in accordance with the Basic Provisions for the admission of vehicles to operation and the duties of officials to ensure road safety, operation of the vehicle is prohibited, with the exception of malfunctions and conditions specified in parts 2 - 7 of this article , —

entails a warning or the imposition of an administrative fine in the amount of five hundred rubles.

Thus, the fine for using HBO without documents is 500 rubles .

Note. If a change in the design of the vehicle is detected, the traffic police may cancel the registration of the vehicle.

Penalty for installing HBO

The most common penalty for unregistered gas is the imposition of an administrative penalty. It also applies in the following cases:

• the gas was not registered in the prescribed manner with the traffic police;
• the registration certificate and PTS do not contain information about the installed gas equipment;
• gas equipment does not have documents confirming safety testing;
• HBO does not comply with current standards;
• the equipment was installed without following the accepted rules for its installation;
• the number on the surface of the cylinder differs from the numbers indicated in the PTS and the certificate for the installed gas equipment.

The fine for HBO is prescribed in Art. 12.15 part 1 of the Code of Administrative Offenses of the Russian Federation. Its size is 500 rubles. Other penalties are not provided for by this article of the Code.

Despite this, a driver driving a car with an unregistered gas equipment may be subject to administrative arrest. His car will be impounded.

When drawing up a protocol, the inspector issues an order to the driver, according to which he must eliminate the cause of the violation (register the gas equipment properly, undergo a technical inspection) within 10 days. If this requirement has not been met, then when stopped again by a traffic police officer, the motorist will be held accountable under Art. 19.3 Code of Administrative Offenses of the Russian Federation. It involves arresting the offender for 15 days and towing the car to an impound lot.

Driving a car with an unregistered LPG, in addition to a fine for gas, risks being denied the sale of fuel. The traffic police instructs gas station employees to check that drivers have documents confirming the legal installation of equipment before leaving. If they are absent, refueling may be refused.

If you purchased a car with an LPG installed, you should study its registration documents. If HBO is included in the documents (legalized), then the car can be registered with the traffic police without any problems.

What to do if HBO was installed before the law was passed?

According to Art. 12.5 of the Administrative Code of December 30, 2001 N 195-FZ (as amended on August 3, 2021), traffic police fines for gas equipment in 2021 in Russia are issued for any of the above violations.

Thus, the driver will be punished in cases where:

1. There is no mark on the installed gas equipment in the vehicle registration certificate.
2. There is a mark, but there are no documents confirming that the gas equipment has undergone inspection.
