Fine for stopping in the wrong place: size of the fine, other places where you can’t stop, how to appeal

Every year there are more and more road users. In this regard, the government has to introduce new restrictions, increase parking costs, or completely prohibit stopping in certain places. This especially applies to large cities, where illegally parked vehicles can often create a large traffic jam.

Of course, after 30 minutes of wandering around looking for a parking spot, you want to break all the rules. Should not be doing that. Every sign on the road is placed for a reason, and perhaps the car will interfere with pedestrians or other vehicles. The offense is punishable by a fine and, in some cases, towing of the vehicle.

Signs and road markings

To properly stop the car, the driver must follow signs, road markings, and traffic rules.

If a motorist sees on the road a round sign with a blue background, which depicts a red circle with two crossed out stripes, then he should not stop in this area. This is what the traffic rules article says. Stopping in the wrong place is punishable by a hefty fine, so every driver should carefully monitor the signs.

Sometimes you can see a sign underneath them indicating a certain period. At this time, you should not stop at a specific area. During other periods, any type of transport can stop without fear.

Also on the sign below the sign you can sometimes see vehicles that are subject to the rule. A solid yellow line along the edge of a road or curb also tells motorists not to stop or park there.

Coverage area

In order for the driver not to receive a fine for stopping in the wrong place, he must know the traffic rules well. The “No Stopping” sign applies only to the area after it and only to the side of the road on which it is installed. It turns out that the vehicle stopped in front of him does not violate any rules.

Sometimes you can see a sign under the sign that indicates the duration of the action. If such additional information is not observed, then the sign ceases to be valid:

  • At the crossroads.
  • After the sign “End of all restrictions zone”. It is a round white sign with a black circle and four black stripes.
  • After the end of the settlement.
  • At the beginning of the village.

Where should you not stop?

To avoid getting a fine for stopping in the wrong place, you need to know exactly where stopping your car violates the law.

List of places:

  • At the pedestrian crossing, as well as for 5 meters in front of it. After it, cars can stop without fear of getting a fine.
  • On or near tram tracks. This rule is also very logical. The tram cannot leave the tracks, and therefore cannot bypass any traffic that interferes with it.
  • On a dedicated lane. This refers to special places for bicycles, as well as lanes along which public transport moves.
  • At intersections, as well as at a distance of 5 meters from the edge of the roadway.
  • In places where the driver creates an obstacle to the movement of pedestrians.
  • It is prohibited for a car to block traffic lights or signs for other road users.
  • The driver will be fined if his car interferes with the exit or entry of other cars.
  • On roads where the distance from a solid line to a car is 3 meters or less. Please note that we are talking specifically about a continuous dividing strip.
  • On the road, if there is a dangerous turn nearby. In this case, an emergency situation may arise.
  • On the roadway where visibility is below 100 meters. A major accident is possible if one car enters the oncoming lane to avoid another.
  • In places that are specially designated for parking for disabled people.
  • At stops (except for stops for boarding and disembarking passengers, if this does not interfere with the movement of route vehicles or vehicles used as passenger taxis).
  • On bridges and overpasses.
  • In the tunnels. Visibility is quite low here and there is no room for maneuver.
  • At railway crossings, as well as near them.
  • When driving on the main road, you should not stop if the driver has left the populated area.

You can get a fine not only for stopping. Parking in the wrong place is also punishable. In addition to the previously listed places, you cannot park a car on lawns, in courtyard areas in front of doors and gates, as well as near railway lines.

Vehicle location rules

The rules for stopping or parking a vehicle are specified in clause 12 of the traffic rules. They say that you should only stop on the right side of the lane along which you were moving .
This can be done on the side of the road, if it is provided for by the road design, or on the roadway itself, when there is none.

Please note that parking on the road itself, where a shoulder is provided, will be a violation. The vehicle can be stopped in one row. On the other side, you can only park your car on one-way roads, and such mitigation is only provided for cars up to 3.5 tons.

The placement of the vehicle must occur in accordance with the rules indicated on the signs at a certain place, or in accordance with the markings . This could be parallel parking, at an angle to the road, or with one side of the car on the sidewalk. Please note that the latter method is only valid for cars, motorcycles, and mopeds. If there is no specification, then it is considered that the stop should be parallel to the line established as the boundary.

This is important to know:

Where is it prohibited to stop?

to stop where sign 3.27 is installed .
It automatically detects a parking ban as well. Valid only for the side on which it is installed. The attention of motorists can be accentuated by a yellow line along the side of the road , on the curb, or simply along the edge of the road. She also talks about prohibition.

The restriction ends after the intersection, that is, if there is no duplicate sign after it, then parking is permitted further. In addition, the “End of all restrictions” sign also applies to the end of the stop ban.

The sign can be installed independently or it can be accompanied by explanatory signs . For example, a restriction may apply only to a certain type of transport, most often it is freight, or time limits may be defined when exactly the ban begins to work.

Established traffic rules restrictions

There are situations when stopping is prohibited regardless of the presence or absence of a sign. These include vehicle placement:

  • on rails intended for tram traffic, and also in such a way that the placement of the vehicle interferes with the movement of this type of public transport;
  • at crossings where railway transport passes;
  • on overpasses, bridges, overpasses. For this type there is a reservation: the number of traffic lanes must be less than 3;
  • on sections of the road where the gap between the stopped vehicle and the solid line, the other side of the road or the dividing line will be less than 3 m;
  • at crossings intended for pedestrian traffic, as well as in front of them at a distance of less than 5 m;
  • on a road where there are dangerous turns in the immediate vicinity, regardless of the direction of travel, as well as in extreme climatic situations when visibility becomes less than 100 m;
  • at intersections and at a distance of less than 5 m from them;
  • in places closer than 15 m from a public transport stop or places intended for taxis;
  • in any places where stopping will create difficulties for other traffic participants: signs will be closed, the road will be blocked for pedestrians, the entrance to the adjacent territory will be blocked;
  • on a special dedicated lane for bicycles.

Prohibitions in other legal acts

Restrictions on stopping are provided not only by traffic rules. The Water Code of the Russian Federation stipulates that stopping and parking is prohibited , otherwise there will be a fine.
We are talking about parking near bodies of water, on a non-hard surface . Since it is quite difficult to determine what is classified as this species, there are distance restrictions:

  • 50 meters from a 10-kilometer river, reservoir;
  • 100 meters from a river up to 50 km long;
  • 200 meters from the river from 50 km;
  • 500 meters from the sea and Lake Baikal.

Using the shore as a parking place, even if you came there to relax or fish, may be punishable under Art. 8.42 of the Administrative Code with a fine of 3000-4500 rubles.

Stopping restrictions also exist on grass-covered roadsides, called lawns. This prohibition is established, as a rule, in regional administrative codes; the size of sanctions varies depending on the subject.

Forced stop

Sometimes unforeseen situations happen on the road that can lead to the need for a forced stop. These include breakdowns in the vehicle that prevent further movement or poor health of the driver himself. These circumstances are compelling reasons for violating the ban, as they can create a threat to other road users.

Serious car breakdowns that make it impossible to continue driving include the following defects:

  • in the brake system;
  • in the helmsman;
  • in windshield wipers in the presence of heavy precipitation.

When stopping, in this case, it is prohibited to open the doors if they will interfere with the movement of other vehicles. You can leave the car only in a situation where the driver has made sure that it will not continue driving in his absence. If you stop driving in an inappropriate place, the driver must do everything possible to correct the violation, that is, try to move the car .

Fine for stopping in the wrong place
If this cannot be done, then you must further follow paragraph 7 of the traffic rules: turn on the warning triangle and set the sign. It must be placed at such a distance from the car that, under specific conditions, will allow motorists approaching from behind to react and change lanes. The law provides for a minimum size of 15 m for stopping in populated areas and 30 m outside them.

Penalties for public transport drivers

Stopping a bus in the wrong place is also punishable by fines. In this case, you will have to pay 3,000 rubles. Typically, such orders from the traffic police are received by minibus taxis, which stop at the request of passengers. In case of repeated violation, penalties will increase to 5,000 rubles.

Not only stopping a bus in the wrong place is punishable. You can also receive a fine if you park at night in non-designated areas. The driver will have to pay 5,000 rubles to the state.

It is worth noting that the listed fines are issued not by traffic police officers, but by employees of state transport supervision, as well as representatives of state control in the field of passenger transportation.

Parking rules in force in the courtyard of a residential building

The driver must comply with current traffic regulations, namely:

Rule of lawDescription
clause 12.4 of traffic regulationsIt is prohibited to park the car in such a way that it blocks the passage or disrupts the movement of other vehicles, as well as pedestrians.
clause 12.2 of traffic regulationsIf signs 8.6.2 – 8.6.9 are missing, then parking on the sidewalk is considered illegal.
Regional lawsAt the regional level, they can establish their own rules regarding prohibiting parking on the lawn. For example, increase the fine.
clause 17.2 of traffic regulationsIt is prohibited to leave a car in the yard with the engine running for more than 5 minutes.
clause 12.2 of traffic regulationsVehicles weighing more than 3.5 tons can only be parked in specially designated areas with a designated area and a sign.

If the parking area does not fall under any of the listed criteria, then parking of vehicles is allowed even next to the entrance. You need to carefully read the traffic rules, strictly follow them, and also be vigilant when you park your car or park it. And the existing signs and marking lines will help you follow simple rules.

Stop in the yard

Unfortunately, the only way to force drivers not to break the law is through fines. Violation of parking rules in Moscow and St. Petersburg entails a fine of 3,000 rubles. The law does not provide for forced evacuation of the car in this case. All that remains for the traffic police officers is to issue a fine to the violator. Stopping in other cities also entails a fine of 1,500 rubles.

In order not to receive sanctions, the driver only needs to follow several rules:

  1. Do not park the car with the engine running near the windows of a high-rise building.
  2. Do not block the exits and entrances to the entrance, as well as to the service parts of the building with a car.
  3. Do not interfere with traffic.
  4. Do not impede access to the entrance of emergency services.
  5. Do not obstruct access to trash cans. It is allowed to stop the car at a distance of 5 meters from the containers.

Financial penalties for illegal parking

The amount of punishment is constantly changing; authorities increase the amount of the fine at certain intervals in order to encourage citizens not to break the law.

The following sanctions are fixed for 2021:

Amount, rub.Committed offense
5 000You will have to pay the driver who parked his car in a place intended for a disabled person. In addition, vehicles are evacuated from the parking area.
1000If the driver parked the car at a pedestrian crossing, or the distance to it is less than 5 meters. In case of a forced stop, this norm does not apply.
1000When the vehicle was parked less than 15 meters from the bus stop.
1500This punishment faces a motorist who parks his car on tram tracks.
2000The citizen violated the parking rules, which created an obstacle to the movement of other vehicles.

This is only a small part of the possible violations. The amount of punishment depends on various factors, citizens should take into account; residents of Moscow and St. Petersburg have been significantly increased. However, in some cases, drivers will be able to reduce the amount of the fine.

If you pay a fine for violating parking rules within 20 days from the date of the decision, you will be able to receive a discount of 50 percent. Here, drivers must remember that data on violations recorded using cameras comes much later. Therefore, the grace period may be missed.

However, such an indulgence does not apply to all violations; for example, in the event of a repeated stop at a railway crossing, the driver will have to pay a fine in full.

Citizens should know their rights, for example, forced evacuation from a parking area is possible only in cases where there is a sign “Tow Truck Operating.” After all, drivers who violate traffic rules will have to pay not only a fine, tow truck services, but also the period while the car was stored in the parking lot. In addition, as a result of forced evacuation, scratches and dents may appear on the car, and then it will be problematic to prove whose fault the car was damaged.

Also, citizens can regularly check for financial sanctions on the official website of the traffic police, or through the mobile application. This way, the deadlines will certainly not be missed.

Stopping on the sidewalk

You should not block the movement of pedestrians on the sidewalk with your car. Stopping in the wrong place in Moscow and St. Petersburg can result in a fine of 3,000 rubles. Penalties in other cities amount to 1,000 rubles.

If there are markings, as well as a permit sign, you can stop according to the following rules:

  • A collision with only the front wheels on the pavement.
  • Hitting with rear wheels only.
  • Stopping the vehicle in accordance with the sign.
  • Collision with two right wheels.
  • Collision with two left wheels.

If drivers are not afraid of the size of the fine for stopping in the wrong place, then representatives of the State Traffic Inspectorate can also take the car to the impound lot.

When can you be fined for stopping on tram tracks?

Trams have been one of the main modes of transport for several decades. Now they have been replaced by buses, but in some cities tram tracks are still successfully operated. They look like rails and are usually located on the left edge of the passing lane.

According to the traffic rules, drivers of cars and trucks are prohibited from interfering with tram transport - a fine is provided for this.

Fines for stopping on tram tracks

Stopping on the tracks is strictly prohibited, with the exception of several cases:

  • If the car breaks down. In such a situation, you need to put up an emergency stop sign and do everything to remove it as quickly as possible: for example, call a tow truck or roll it to the right edge of the roadway. If there is a tram behind a stationary vehicle, it simply will not be able to go around it, and the passengers in it will have to wait for evacuation. A long wait is fraught with a huge disruption to public transport;
  • If there is a traffic jam ahead. In such a situation, the car driver will not be able to do anything, and he can only wait until he can get out of the jam, just like the tram driver.

By stopping we mean keeping the car stationary on the tracks for trams, even for up to 5 minutes. If passenger vehicles move along them, movement should be non-stop, except for the cases listed above.

Stopping and parking on the lawn

Every motorist should know that issuing a fine for this offense is not carried out by the State Traffic Inspectorate, but by the city improvement inspectorate.

Of course, the driver cannot always fully assess whether the stopping area is a lawn. It is especially difficult not to break the rules in winter, when behind a layer of snow it is not clear whether the asphalt is finished. Therefore, most often lawns are fenced with special borders.

The driver will be required to pay a fine. How many stops in the wrong place a driver makes, so many orders can come. The amount of the fine depends on the damage caused to the lawn, as well as the status of the owner. For example, a fine of 3 thousand rubles may be issued to an individual. A legal entity will pay more. The maximum fine is 500 thousand rubles.

Stopping the car in the second row

According to the Traffic Rules, stopping and parking of four-wheelers is allowed only in one row. The only exceptions are extended sections of the road - special “pockets” or parking lots. The reason for such rules is clear - cars will interfere with other vehicles, causing traffic jams and accidents. What fine for stopping in the wrong place will be issued by the traffic police depends on the city. For residents of the capital and St. Petersburg it is 3 thousand rubles, for other cities it is 1500 rubles.

Parking and parking rules

At the legislative level, a temporary stop of transport is regulated by a set of Traffic Rules, specifically paragraph 12. According to subparagraph 1 of the twelfth paragraph, parking a car on the right side of the side of the road or the edge of the roadway is legal. Parking on the sidewalk is allowed if there are special warning signs.

Guided by paragraph 4 of the same law, parking a car in the following locations is prohibited:

  • Tram and railway tracks
  • Bike paths
  • Under bridge spans and overpasses
  • Places where road signs and traffic lights are installed
  • Public transport stops
  • Paths for pedestrians
  • Roadways where the distance between the dividing strip and the sidewalk is less than 3 m
  • At intersections and three-way intersections

Violation of the rules for stopping and parking a vehicle is automatically classified as an administrative offense.

Attention! In a place where a prohibition sign is located, parking a car is a violation of the rules, regardless of the availability of free spaces and conditions on the roadway.

In addition, parking of vehicles along main intercity roads and railway connections is strictly prohibited.

Stopping in areas designated for disabled drivers

Disabled motorists have some advantages when parking and stopping a vehicle. As a rule, places are allocated for them in close proximity to the entrances to buildings. The state is trying to make life easier for these people, because it is not always possible to find a parking space, and it is often located very far from the entrance. If it is not at all difficult for a physically healthy person to reach the final destination, then for disabled people this path is really not easy.

Unfortunately, not all drivers understand the situation, or maybe they simply don’t know the traffic rules. Such violators will have to pay a fine of 5 thousand rubles. In some cases, traffic police officers may call a tow truck.

Payment of fines and discounts

On the State Services portal, as well as on the website of the State Traffic Inspectorate, each driver can check whether he has been assessed any penalties. In addition, receipts always arrive by email to the car enthusiast. If the fine is not paid within 60 days, penalties may be assessed. When towing a car, you will also have to pay extra for the tow truck, as well as for the car being in the impound lot. You should not delay paying the fine for stopping in the wrong place. Payment within 20 days from the date the receipt is issued gives a 50 percent discount, which significantly reduces the total payment amount.

Responsibility

The amount of sanctions for violation of the restrictions described above is provided for in Art. 12.19 Code of Administrative Offences. Basically we are talking about an administrative fine for an incorrect stop, but in some cases it can be deprivation of control, and placing the car on a parking ticket.

As a general rule, parking in the wrong place will result in a fine of 500 rubles. If the stop occurred under a sign stating that only disabled people , then the healthy driver will have to pay 5 thousand rubles and pick up the car from the parking lot .

If a stop occurs at a pedestrian crossing or sidewalk , the offender will be held liable for 1 thousand . The same amount of administrative liability is determined for parking at public transport or taxi stops.

Fine for stopping in the wrong placeWhen the stop occurred
on tracks intended for tram traffic or not on the outer lane, the traffic police officer issues a protocol in the amount of 1.5 thousand. When the stopped car created an obstacle for other participants, the amount of the sanction is determined as 2 thousand, in addition, The vehicle is being towed.

Please note : in federal cities, stopping is prohibited and the fine is higher. Variations go from 2500 to 3000 thousand.

Article 12.10 provides for more severe punishment for stopping at a railway crossing . The sanction may be in the form of a penalty in the amount of 1 thousand rubles or in the form of deprivation of rights for a period of 3 to 6 months.

A traffic police officer can hold you accountable by writing a report. If a vehicle is towed, then in addition to the administrative penalty, you will need to pay for the services of a tow truck and a parking fine. In addition, administrative liability can be applied based on data from CCTV cameras.

If you make a settlement with the budget within 20 days from the receipt of the protocol, you can save money. Art. 32.2 of the Code of Administrative Offenses provides for the opportunity to pay a penalty for an amount less, exactly half.

How to appeal a fine for stopping in the wrong place?

If the driver does not agree with the fine issued, he can always challenge it. Each motorist has a ten-day period to appeal the decision. True, you will need to identify an error, for example, a time or date discrepancy, incorrect application of traffic rules, etc. The complaint may be filed at a later date. Then, along with it, you will need to write a statement indicating a valid reason why the complaint was not filed in a timely manner.

The complaint is filed with the traffic police department where the decision was issued, or with the court at the location of the traffic police authority. Within 10 days after this, the driver must receive a response from the traffic police. If the complaint was filed with the court, the response will be received within two months.

When filing a complaint with the authorities, it is better to take care of witnesses, video from the recorder or other evidence of innocence in advance. Often vehicle owners are simply afraid to file a complaint, but in vain. In judicial practice, there have been many cases when drivers won the case. Traffic police officers are the same people who can sometimes make mistakes and misinterpret the situation.

Don't break traffic rules. Even if the driver is not afraid of losing some money and time to pay fines, it is worth thinking about the fact that the rules were invented for a reason. There are other road users, as well as pedestrians, whose movement is impeded by an illegally parked vehicle.

Checking for fines

You can avoid concerns about the presence of fines accrued on a transport unit by periodically checking the status using the vehicle registration number online on the website of the same name of the State Traffic Inspectorate or on the State Services Portal.

The presence of a fine for illegal parking in Moscow can be checked when the number of its registration certificate is attached to the vehicle number.

The amount of the fine for unpaid parking in Moscow

Attention! Failure to pay within two months (sixty calendar days) after the decision is issued will additionally impose penalties on the driver. 5 thousand rubles in 2021 .

Payment procedure

Towing a car to a parking lot for illegal parking in 2018 also involves additional material costs, the amount of which depends on the cost of tow truck services. The length of time a vehicle spends in the impound lot also affects the final amount of the penalty for illegal parking.

It is convenient to pay a fine for illegal parking using online services for checking the existence of penalties.

Is there a discount?

All districts of the Russian Federation are subject to Article 12 of the Code of Administrative Offenses of the Russian Federation, according to which there are cases of preferential repayment: • Parking in places for disabled people • Parking on the territory of pedestrian crossings and sidewalks • Parking in the courtyards of high-rise buildings • Intentional entry to the first part of the railway or tram tracks • Parking at public stops • Parking in other prohibited places.

What traffic fines can be paid with a 50% discount? Those listed above, for which payment was made within 20 days from the date of the decision on the fine.

Is it possible to challenge a fine?

If the car owner considers the actions of the State Traffic Inspectorate employees to be unlawful, the fine can be challenged. How to challenge a parking fine? You need to start by drawing up a complaint against the decision on the offense and supporting a copy of the decision itself. In the Moscow Region, it can be sent to the State Public Institution “Administrator of the Moscow Parking Space”. It is extremely important to do this within 10 calendar days from the date the fine was imposed. A response regarding the legality of a parking fine will be received within three business days.
