How to determine a parking spot for disabled people

There are such places in almost all public spaces, for example along the road, in the courtyard of a new building or near a shopping center. By law, there must be at least 10% of the total number of such places. If there are 50 parking spaces, then 5 will be reserved for people with disabilities. If there are less than 10 seats, then at least one will be for disabled people.

According to traffic regulations, parking for disabled people is marked with a blue sign with a “Disabled Persons” sign, and markings are drawn on the asphalt.

Parking spaces for disabled people

The law provides for the mandatory allocation of parking spaces for people with disabilities on a free basis near commercial and social facilities. For ignoring this rule, the parking lot owner faces a heavy fine, which is why most parking lots have special spaces for people with disabilities.

According to current legislation, parking zones for these citizens must be located as close as possible to the entrance, distinguished by an appropriate sign.

These seats can only be used by disabled people of the first and second groups or motorists carrying a passenger with a disability group in their car.

However, in order to be legally able to park in a “free” space, a motorist with a disability must obtain proof of his or her status. To do this, you will need a certificate of disability, as well as a certificate certified by a seal.

IMPORTANT. A disabled person is not required to place a sticker on the car window indicating his or her status. Moreover, the presence of such a sticker is not proof of the status of a person with disabilities. If a healthy person sticks a badge on his car and uses it for personal purposes, he may face a fine of up to 5,000 rubles.

In the case where a disabled person is a passenger, the driver has the right to occupy a parking space if the required documentation is present. It is allowed to use a sticker during transportation, but on further trips without a beneficiary passenger, it must be removed without fail.

If the transportation of a disabled person is permanent, the best option would be to issue a document allowing parking in the spaces designated for persons with disabilities. The online resource of government services allows you to do this.

Parking permits can be obtained by disabled people themselves, their legal representatives, social workers and motorists carrying disabled people in their cars.

Who uses disabled parking?

Drivers with a confirmed disability. According to the rules, a disabled driver drives and presents to the inspector a certificate confirming his disability. This gives him the right to stick a yellow “Disabled” sign on his car and park in special spaces. From July 1, 2020, such a sign is optional.

The rule applies to disabled people of groups I and II and part of group III - people who cannot walk on their own.

Accompanying people. A disabled person is not required to drive and is often physically unable to operate a car. If a disabled person or a disabled child is being transported by a healthy person, you can also put a sign on the car and enjoy preferences.

In both cases, the car must be registered in the Federal Register of Disabled Persons. You can enter the register through the State Services website, after which you will need to fill out an application, indicate the number, make and model of the car.

With the information signs described above, a mandatory sign is installed, which in the traffic rules is assigned the number 8.2.1 and the name “Area of ​​Operation”. It displays a number and arrows in one or both directions, which, together, regulate the distance allocated for the placement of vehicles for people with physical disabilities.

If the sign is installed, but there are no markings on the canvas or a prescriptive sign indicating the size of the preferential area, then you need to be guided by the SNiP standard for parking lots. He says that in the absence of an information sign and other identifying landmarks with the exact meaning of the sign's coverage area, parking spaces are a plot measuring 3.5 m wide and 6 m long. If the driver notices an empty parking space, but under the 6.4 traffic rules sign, then he must take into account the distance allocated by law in both directions from it.

Who has the right to park?

According to changes in legislation, starting from 2021, only cars equipped with a special sign can stop a car in an area marked with a “Parking for the Disabled” sign. Also, the driver of a vehicle at any time must be ready to show the traffic police officer a certificate or certificate confirming the presence of a disability of the first or second category. If people with disabilities are transported by a healthy driver, then they must also have documents. Persons with category 3 disabilities are prohibited from using this parking space. In case of violation of the current legislation, a large fine is provided.

Fines

Just a couple of years ago, the fine for such violations was only about 200 rubles, as a result of which cars were parked anywhere and anyhow. In 2021 and 2021, everything has changed and drivers who ignore traffic rules and occupy preferential parking spaces will be fined in the amount of 5,000 rubles. Such an offense is registered on the basis of Article 12.19 of the Code of Administrative Offenses of the Russian Federation. A protocol on an administrative offense can be drawn up upon the fact of a violation; no other photo or video evidence is needed. This means that during legal proceedings the court can limit itself only to the testimony of a traffic police officer. As an additional measure, forced evacuation of the offender’s vehicle to a specialized impound area may be used. Moreover, the latter can be taken from there only after full payment of the fine.

A motorist who parks his car in such a parking space is required to have in hand documents or a certificate of the required type confirming the fact of having a disability. Simply sticking a yellow disabled sign on the windshield or rear window will not be an argument for a traffic police officer.

If the driver decided to “cheat” and falsify a certificate confirming his disability and was caught doing so, an administrative penalty in the amount of 5 thousand rubles will be imposed. When the question concerns motorists who periodically transport persons with musculoskeletal disorders, then if they are not in the car, the latter does not have the right to stop in such a place.

Important! If a disabled person does not have a properly issued permit, he cannot use a preferential parking space, otherwise a fine will be issued.

Stopping and parking under the sign

Citizens with disabilities of the first and second groups can freely use parking spaces specially equipped for them, as well as stop their car at public places and even where stopping and parking is strictly prohibited (crossed out round sign). People with physical disabilities are allowed to drive on roads with a “No Traffic” sign installed.

Regarding the stopping of vehicles in preferential places driven by healthy citizens, there is no direct prohibition on such manipulation in the traffic rules. Moreover, if a vehicle is parked for a disabled person for the purpose of loading/unloading for a period of up to 5 minutes, this is not a violation.

What is the fine for parking in a disabled space?

Parking without a reason. The fine for parking under a “Disabled” sign is 5,000 rubles. In this case, the police have the right to impose an additional punishment - to send the car to the impound lot. Then the violator will have to pay additionally for the work of the tow truck and parking.

If the driver appears on site before the tow truck leaves, the car must be removed and only a fine issued.

Sticker of sign without documents. If the driver or passenger does not have a certificate of disability, the yellow sign on the body cannot be used by law. The fine for such a violation is also 5,000 rubles.

Penalties for violating parking rules

According to Article 12.19.2 of the Code of Administrative Offences, for violating parking rules in spaces reserved for disabled people, a fine of 5,000 rubles is imposed. Moreover, it is possible that the offender’s car will be towed to an impound lot. So you will have to pay not only a fine, but also the work of a tow truck and storage of the car.

There are often cases when a traffic police inspector issues a fine to a disabled person who seems to have parked in the right place. This can happen if the driver does not have documents confirming his disability with him. If the vehicle is not equipped with “Disabled” signs, then the vehicle parked in a disabled space may be towed, and the owner may be fined, even if he is a person with disabilities. Also, a parked car without special signs can be recorded by a camera, and the fine will be sent by letter.

In the capitals, all cars equipped with the “Disabled” sign are entered into a special register. The owner of a car that is not included in the register and parked in a space for disabled people will be fined, even if the car has signs and all the necessary documents.

When can you challenge a fine for parking in a disabled spot?

You can appeal the decision within the first 10 days from the moment you received it. To do this, you need evidence, for example, a photo showing that the sign was not read, or a certificate stating that the driver had the right to park.

To appeal a fine, write a statement to the head of the traffic police department, whose officer issued the fine. You can find out the addressee by calling the phone number indicated on the paper order. Attach a photo of the unreadable sign or disability document to the letter and send by mail. The complaint will be reviewed within 10 days and a response will be given.

Amount of fine and punishment
