“Where can I park my car?” - a question that can become a headache for any driver, especially in big cities. Paid parking is growing like mushrooms. How can they be combined with mandatory parking quotas for disabled people? Are all disabled groups considered preferential? In 2021, all issues were finally settled. Along with the existing standards for the first two categories, new parking rules have appeared for group 3 disabled people.
Before amendments
Until recently, parking rules were not clearly defined at the legislative level - who has the right to affix a “Disabled Person” sign to a car, whether documentary medical evidence is needed for this, and whether an inspector can ask for it to be checked. Various conflict situations arose. Such a certificate is not included in the list of documents required to be presented to the traffic police inspector. But he could demand her and fine her for her absence.
In Moscow, there have been far from isolated cases where a certificate of disability of group 3 gave the right to a free parking permit, but the identification symbol “Disabled” did not. And any traffic police officer could impose a fine on a citizen with health limitations, even with a certificate of group 3. In accordance with the previous rules, this indicator could only be installed by persons with categories 1 and 2.
Decree of the Government of the Russian Federation No. 1414 of November 24, 2018 changed the current unhealthy situation regarding parking for group 3 disabled people.
The individual sign was canceled on July 1 - is this true?
Yes. Most resources talk about changes in the law for people with disabilities of all groups. But today there is little specific information on the Internet; it is contained mainly in regulations, and not all car enthusiasts know how to find them correctly. So let's find out what's true and what's not with links to the official new laws!
So, to do this, let’s take a look at the sequence of adoption of regulatory documents, and everything will immediately become clear to us:
- On September 4, 2021, a new Order No. 443N came into force, which regulated that in order to obtain a “Disabled Person” badge, you must contact the ITU with an application, and they will subsequently issue an individual plate with the name and surname, as well as other personal data for placement on the vehicle. means
- over time, shortcomings of such rules for obtaining a badge were discovered: personal information could be read by any passerby, there were problems with checking the presence of data on a disabled person in the ITU database, as a result of which the sneaked information could be placed on any sheet and used illegally,
- in this regard, at the end of last year, a new Order No. 724N was developed, which, among other things, invalidates the previous one under number 443N, and it comes into force on July 1, 2020.
Thus, from July 1, 2021, the Disabled person sign is officially canceled in its individual form - when it was required to be received with a mandatory application to the ITU. Now we are returning to the old rules, when you can just buy a yellow sticker with the image of a disabled person and drive like that.

Where and how to get it?
From what has been described, it follows that the procedure for obtaining the good old badge has returned to its simple course - you can purchase it at any auto store or other place. That is, the sign after the changes from July 1 should not look like this:

According to the traffic rules, it should be yellow with a background with a black image of a disabled person, square in shape with each side exactly 15 cm. That is, in principle, nothing prohibits making it yourself and installing it on the car at the back or front (also according to the traffic rules), and not buy somewhere.
Other changes
Ordinance No. 1414 amends no-parking signs. Before the new rules, exceptions concerned the first two categories of disability. From December 8, 2018, they fully apply to category 3. And also for persons transporting citizens with disabilities, including children.
Now they too can park under prohibitory signs 3.28-3.30:
- No parking;
- on even numbers;
- on odd numbers.
Signs 3.2 and 3.3 remained an exception for persons with disabilities in the first two categories.
Note! Stopping under prohibited signs can only be done if there is a “Disabled Person” sign on the vehicle.
Government revokes parking rights for healthiest people
About 3.4 million disabled people of group III will lose the right to use free parking, Kommersant found out. From July 1, 2021, places marked “Disabled Only” will be accessible only to those from this category of disabled people who have “limited ability to move independently.” The corresponding government decree was signed by Prime Minister Mikhail Mishustin. Disabled people who do not have such restrictions, for example, diabetics, will not be able to use the opportunity to park for free.
Resolution No. 115, signed by Prime Minister Mikhail Mishustin, is related to the new version of the law “On Social Protection of Disabled Persons,” which comes into force on July 1. The current version states that in public parking lots, 10% of spaces must be reserved for vehicles driven by disabled people. The resolution adopted for the first time clarifies: citizens with disability group III can use such places if they have a “limitation in the ability to move independently” or if they received the right to use parking before July 1 (that is, before the resolution came into force) by contacting Bureau of Medical and Social Expertise (ITU) and received the “Disabled” sign.

From data from Rosstat and the Ministry of Labor it follows that about 3.4 million people with disabilities of group III will not be able to exercise the right to park cars in special places. From the moment the norm comes into force, a transition period will operate, the press service of the Ministry of Labor explained to Kommersant: within 6 months, a citizen will be able to transfer data about the car to the federal register of disabled people (for example, through the public services portal) and use the “Disabled” badge issued formerly ITU.
From July 1, 2021, such signs will no longer be issued, but the obligation to use them in a car will remain. The signs can be purchased at any retail chain or gas station.
We would like to remind you that the traffic rules provide for a number of benefits for drivers of cars with a “Disabled” sign. They can stand under a “No Parking” sign and in special parking spaces that are inaccessible to other drivers. If a car with a “Disabled Person” sign is driven by a citizen with disability groups I and II (or it is transporting a disabled person), driving under the “Traffic Prohibited” and “Motor Vehicles Prohibited” signs is allowed. The driver of a vehicle with a “Disabled Person” sign is required to carry with you a document confirming your disability.
State Duma deputies proposed exempting disabled people from road tolls
The procedure proposed by the government should have been implemented back in 2018, when the order of the Ministry of Labor on new identification marks “Disabled” came into force, says Yaroslav Nilov, head of the State Duma Committee on Social Security. Then, as Kommersant reported, the signs became license plates; they can only be obtained from the ITU office. The new order was accompanied by “confusion and confusion,” says Yaroslav Nilov, access to special parking spaces was expanded, which led to their shortage. “The proposed legal structure is more correct,” says the deputy. “A person can have a third group disability (for example, diabetes), but he does not have problems with movement.” The document was also supported by the head of the regional public foundation for wheelchair users “Society without Barriers” Galina Gorbatykh: “It is logical if only those with disabilities can use the places, otherwise these places will be constantly packed.”
Only traffic police officers can issue fines for parking in disabled spaces (5 thousand rubles), cameras cannot be used, notes the coordinator of the “Blue Buckets” movement Pyotr Shkumatov. “Against the backdrop of staff reductions, innovations don’t make much sense,” he says. “In Moscow alone there are more than 1 million disabled people, and there are few inspectors working on the ground.” Most likely, changes to the traffic rules will also be needed, says a Kommersant source in the Ministry of Internal Affairs: it is necessary to clarify the right to use disabled parking spaces. In addition, inspectors will need to provide online access to the federal registry of disabled people.

Responsibility for violating the rules
Due to the negligent attitude of car owners to the placement of their vehicles, penalties have been tightened. The issue of depriving such unfortunate drivers of their rights and initiating criminal cases against them is under consideration.
Violation of parking rules for disabled people of group 3, as well as for other citizens, entails a fine in the amount of:
- 5,000 rubles - individuals. If the car is parked in a space for people with disabilities.

- up to 500,000 rubles - legal entities.

New parking rules for disabled people in Moscow in 2021
More recently, representatives of the Russian Ministry of Internal Affairs prepared new amendments that were made to the Traffic Rules. They will start working soon. Thus, the most popular amendments were regarding people with disabilities driving a car.
Changes related to the “Disabled” sign
According to the new amendments to the Rules of the Road, a car driven by a disabled person or transporting a disabled person of any group, in the case where the identification sign “Disabled” is present on the vehicle, has the full right to park next to the signs “Parking prohibited” and “Parking prohibited.” on odd and even numbers."
However, at the moment there are a number of exceptions, according to which other cars can park in the area covered by these signs, despite the established rules. In Moscow, it is allowed to use the active zone of prohibiting parking signs for vehicles of the Russian Federal Postal Service, taxis with a taximeter and vehicles that transport a person with disabilities of any group.
In addition, the 2021 amendments also provide for a new use of the “Disabled Person” sign, which is attached to the car. The new edition of the Road Traffic Rules states that this sign is placed on cars that transport disabled people of any group, and not as was the case last year, when such designating signs were placed on cars with disabled people of groups 1 and 2. However, according to statements from some people from the State Duma, such badges would need to be issued in a special order, when a disabled person would have a badge with a number and his last name, and it would have to be obtained from social security authorities.
This innovation is due to the fact that cars registered in the name of disabled people are growing in number and enjoying new benefits, but the number of disabled people throughout the country is rapidly falling.
Wheelchair user - pedestrian
Also, according to the new amendments, a disabled person who moves using a wheelchair is equivalent to a pedestrian. Such amendments were explained by shortcomings in the rules, since in previous years disabled people who moved in self-propelled wheelchairs in pedestrian areas were fined. After numerous complaints, the problem was corrected with the release of new amendments to the Traffic Rules.
The "Spikes" sign is not required
Thus, according to the new amendments to the Road Traffic Rules, the driver is no longer required to put a special warning sign on the rear window of the car, as was the case in 2021. Let us remind you that this sign looks like a white triangle containing the letter “Ш” in black. Also, for the absence of such a sign last year, drivers were issued a fine of 500 Russian rubles.
The authorities of the Ministry of Internal Affairs came to the decision to abolish the mandatory “Spikes” sign due to the impracticality of its use. As stated in the official statement, this sign has already lost its relevance due to the fact that the dynamic characteristics of the vehicle are determined by other parameters, such as the degree of vehicle load, as well as braking or stabilization devices. The message also talks about the fact that the “Spikes” sign greatly blocks the driver’s view, and this in other cases can create an emergency situation on the road.

Which signs do not apply to disabled people?
Some traffic signs do not apply to people with disabilities, no matter whether they are driving or in the passenger seat. Cars with people with disabilities of the first two groups, as well as with children with disabilities, can pass under signs prohibiting movement (including vehicles driven by an engine).
Vehicles with a “Disabled Person” sign may also park in the area covered by signs prohibiting parking for other motorists. This measure is designed to make it easier for people with disabilities to get from their car to the institution they need.
In some cases, after such parking, the owner of the vehicle may receive a receipt to pay the fine. This happens when parking is recorded by an automatic camera, which does not yet know how to recognize the presence of a badge on the car. Having received a fine, you need to contact the contacts indicated in the letter and protest it. To prove your innocence, you need to provide a document confirming your right to traffic rules benefits for people with disabilities (ITU conclusion). Typically, in this case, an appeal leads to the cancellation of the fine.
Parking for disabled people of group 3: changes from July 1
By Resolution No. 115 of February 10, 2020, the Government determined in which cases disabled people of the third group have the right to free car parking. This is possible under the following circumstances:
- if a disabled person of group 3 has limited ability to move independently (grade 1, 2 or 3);
- if the “Disabled Person” identification badge was received before 07/01/2020 by a citizen entitled to free parking.
If a disabled person of group 1 or a disabled person of group 2 is driving in a car, parking is permitted for any illness that caused the disability.
