Tachographs become mandatory for trucks up to 12 tons: from December 1, the deferment expires for vehicles of unspecified environmental class

From January 1, 2021, several new documents related to automobile legislation come into effect simultaneously. Information about them is available in the “Almanac” section of the pddmaster.ru website.

This article will discuss new documents related to the operation of tachographs . Let me remind you that a tachograph is a special device necessary to monitor the driver’s compliance with the vehicle control regime. Currently, tachographs are installed on trucks and buses.

So, from January 1, 2 new documents related to tachographs are being introduced, and it is them that we will talk about today:

  • New categories and types of vehicles equipped with tachographs from January 1, 2021.
  • What cars require a tachograph?
  • Exceptions where a tachograph is not required: removal of exceptions for individuals;
  • changes made to the list of exceptions;
  • increasing the minimum age for “rare” cars.
  • New procedure for equipping vehicles with tachographs.
  • Cancellation of deadlines for installing tachographs for various categories of vehicles.
  • Which cars do not require tachographs?

    Please note that there is a list of exceptions, i.e. buses and trucks that do not need tachographs:

    • Trolleybuses;
    • Cars carrying out international transportation and equipped with “European standard” tachographs;
    • Military vehicles;
    • Cars of bodies carrying out operational investigative activities (police, FSB, FSIN, etc.);
    • Vehicles registered with state technical supervision (tractors and self-propelled vehicles);
    • Vehicles over 30 years old that are not intended for commercial transportation (for which a recycling fee is not paid);
    • Training vehicles not used for commercial transport;
    • Cars undergoing road tests.

    Please note that earlier this list also included buses providing regular urban and suburban services. However, as of November 20, 2021, these vehicles are no longer included in the exemption list.

    In addition to the vehicles listed above, there is another list of exceptions (based on the type of work performed):

    • Truck-mounted concrete pumps;
    • Truck mixers;
    • Asphalt distributors;
    • Truck cranes;
    • Ambulances;
    • Tow trucks;
    • Fire trucks;
    • Vehicles for public utilities and road maintenance;
    • Vehicles for servicing oil and gas wells;
    • Collection vehicles (for transporting money and valuable goods);
    • Vehicles equipped with lifts with working platforms;
    • Medical complexes on vehicle chassis;
    • Auto shops;
    • Buses for funeral services;
    • Car-homes;
    • Armored vehicles;
    • Specialized vehicles (specially equipped milk tankers, livestock tankers, vehicles for transporting poultry, eggs, live fish, machines for transporting and applying mineral fertilizers);
    • Category C trucks used by agricultural producers for on-farm transportation (transportation within the boundaries of the municipal district in which the vehicles are registered, as well as municipal districts bordering it);
    • Special vehicles;
    • Mobile laboratories and workshops;
    • Mobile television studios.

    This list includes many specialized vehicles. There is no need to install tachographs on them and this will not entail a fine.

    Do you need a tachograph for a dump truck?

    The most popular type of truck used in construction work is the dump truck. Let's consider whether a tachograph is needed for a Kamaz dump truck.

    On the one hand, if a dump truck is used by a construction company building residential buildings, then it definitely needs a tachograph.

    On the other hand, if Kamaz is used for public utilities, then its owner has reasonable questions. Is it possible not to install a tachograph in this case?

    Please note that traffic police officers in many regions interpret the above list of exceptions as follows. Vehicles for public utilities and road maintenance include only vehicles with a specialized purpose. The same applies to vehicles for servicing gas and oil wells.

    In accordance with this interpretation, the traffic police does not require the installation of tachographs, for example, on cars equipped with brushes for cleaning roads. However, the traffic police requires tachographs to be installed on dump trucks used in public utilities and imposes fines for their absence.

    Do you need a tachograph for a personal truck?

    Until November 1, 2021, the installation of tachographs was mandatory only for vehicles used by legal entities and individual entrepreneurs. Those. private owners would not need a tachograph.

    However, from November 1, 2021, the following paragraph was added to the Law “On Road Traffic Safety”:

    Individuals operating trucks whose permissible maximum weight exceeds 3,500 kilograms and buses are obliged to: ... ensure that the vehicles they operate are equipped with tachographs. Requirements for tachographs, as well as the procedure for equipping tachographs, the rules for their use, maintenance and control of their operation are established in the manner determined in accordance with paragraph ten of paragraph 1 of this article;

    Thus, from November 1, 2021, a tachograph is needed

    including personal trucks of category C and personal buses.

    Introduction of tachographs on cars of individuals from November 1, 2019

    Requirements for tachographs

    The use of analog (puck) tachographs in the Russian Federation is not allowed - they should have been dismantled quite a long time ago and replaced with digital control devices. In addition, it is important that the information stored in the tachograph memory is encrypted. This is ensured by the use of various data protection systems that prevent their modification/deletion.

    The type of device that must be mounted on the vehicle depends on where the flights will be carried out:

    • On international routes, the use of AETR recorders is permitted. Their design meets the requirements of European agreements, therefore, if there is permission to operate international flights, the bus is equipped with just such a tachograph.
    • If the company operates only within the Russian Federation, then the buses must be equipped with a CIPF tachograph, equipped with a cryptographic data protection module. This module is subject to regulatory (every 3 years) replacement and ensures encryption of incoming information using classified algorithms. It is these tachographs that are installed on equipment operating on intracity, suburban or intercity routes, as well as on service buses transporting enterprise employees.

    Note! Current legislation directly prohibits the export of cryptographic equipment, including recorders with CIPF modules. An attempt to export such equipment is subject to criminal prosecution, which is why equipment with CIPF tachographs is not used on international flights.

    A tachograph of the appropriate type must be correctly installed in the bus, connected to the speed sensor and on-board networks, calibrated, configured and activated. You will not be able to install and connect the equipment to the bus yourself. All work must be performed by an organization that has the appropriate permits (primarily a license from the FSB of the Russian Federation).

    Operating a bus without a tachograph: possible consequences

    The current legislation of the Russian Federation provides for administrative penalties for the absence of a tachograph on a bus, which must be equipped with a control device. In addition, Rostransnadzor or traffic police officers fine for:

    • Operating equipment with a faulty/uncalibrated device.
    • Driving a bus without an individual driver card.
    • Violation of legal requirements for driving/rest periods.

    The maximum fine for a driver is 3 thousand rubles, for an official - up to 10 thousand rubles. In addition, releasing equipment on a flight without a tachograph of the established type may be regarded as a violation of licensing conditions, therefore the penalties will be more severe:

    • Up to 20 thousand for individual entrepreneurs or officials.
    • Up to 100 thousand - for legal entities.

    In some cases (for example, in case of repeated violations or other aggravating circumstances), operating a vehicle without an installed tachograph may cause the suspension of the activities of a transport enterprise for up to 3 months.

    Most buses that carry passengers on a commercial basis or are used to transport employees to and from work will be required to be equipped with tachographs. In order to comply with all legal requirements on time and not get caught up in the wave of hype, you should take care in advance about purchasing the device and its correct connection from a certified organization.

    Is a tachograph required for commercial transport in a personal vehicle?

    Quite a common question. The driver buys a truck or bus for commercial transportation, but does not intend to register an individual entrepreneur or legal entity. Is a tachograph needed in this case?

    Starting from November 1, 2021, the issue can be resolved quite easily, because... tachographs must be installed on all category C trucks and category D buses. That is, it does not matter who the owner is.

    In addition, in the situation described above, the driver faces punishment for another violation - carrying out business activities without state registration (Article 14.1 of the Administrative Code):

    1.

    Carrying out entrepreneurial activities without state registration as an individual entrepreneur or without state registration as a legal entity -

    shall entail the imposition of an administrative fine in the amount of five hundred to two thousand rubles.

    The size of this fine is comparable to the fine for not having a tachograph.

    Fines for tachograph

    In accordance with the Code of Administrative Offenses of the Russian Federation, Article 11, paragraph 23, the responsibility for tachographs is as follows: “Driving a vehicle for the transport of goods and (or) passengers without a technical control device that ensures continuous, uncorrected recording of information about the speed and route of the vehicle, about the working hours and rest for the driver of a vehicle (hereinafter referred to as the tachograph), if its installation on a vehicle is provided for by the legislation of the Russian Federation... entails the imposition of an administrative fine on citizens (drivers) in the amount of one thousand to three thousand rubles; for officials (mechanics, engineers, managers) - from five thousand to ten thousand rubles.” "

    If a vehicle is detained by traffic police officers, in accordance with Article 27, paragraph 13 of the Code of Administrative Offenses of the Russian Federation, a vehicle not equipped with a tachograph must be stored in a specialized parking lot until the cause of the detention is eliminated

    The use of faulty and intentionally blocked tachographs, the absence of a driver card, is equivalent to the absence of a tachograph, and therefore entails liability in accordance with Article 11.p.23 of the Code of Administrative Offenses of the Russian Federation.

    The procedure for equipping vehicles with tachographs

    Tachographs approved for use in Russia

    In order not to fall under administrative liability, the vehicle owner and driver must know which tachographs need to be used at the moment.

    The fact is that the legal acts used for this area change quite often, and the latest change came into force at the beginning of 2021.

    Therefore, it is simply necessary to understand the types of tachographs, the principle of their operation and the requirements for them.

    Also important is information about which models of the device can be used in the Russian Federation at the moment.

    What types of (washers) are there?

    In general, tachographs are divided into two types - mechanical (washer) and digital, which work more reliably.

    Mechanical ones record all information on paper disks, while digital ones record data on the driver’s card, which makes forgery or destruction of data more problematic.

    At the moment, mechanical devices are prohibited; this rule began to work in July 2021, and drivers can only choose the digital version.

    However, the operation of puck devices was then extended until 2021. There are also tachographs with a CIPF or AETR unit, which are used for different types of transportation, depending on the license available.

    How it works

    The tachograph receives information from a speed sensor, which is installed on the gearbox, as well as using a GPS signal transmitted from a satellite.

    After the ignition key is turned and the driver card is inserted, the device begins to work and records not only the speed and route, but also the driver’s working time.

    All data that accumulates during a trip is copied to the driver’s digital card, as well as to the memory of the tachograph itself, so it acts as a black box.

    The driver's card requires downloading data once a month, and information is removed from the tachograph itself every three months, as required by the regulations.

    After this procedure, carried out by special loaders, the data is transferred to the carrier and stored on its equipment for a year.

    In addition to contacting the car owner, responsible persons can obtain information both from printouts of reports from the tachograph, and through the use of the driver’s card.

    Requirements for this device

    If a tachograph is installed on a car of a company that has a license for international transport, then it must comply with AETR standards, and it also allows analogue options.

    Thus, international carriers do not have to worry about replacing devices with digital ones.

    For those companies that carry out transportation only within Russia, as well as buses with more than 8 seats, you should choose only tachographs with CIPF units.

    They operate more clearly and allow more information to be recorded while simultaneously functioning as an aircraft black box.

    The device itself, according to the CIPF system, has cryptographic protection, which allows you to save data in different conditions.

    To exclude modifications by enterprises or drivers themselves, the law requires the installation of seals on the tachograph that must not be broken.

    In addition, during installation, you should connect the tachograph to the GLONASS system, and after that, carry out all the necessary service actions.

    In particular, during operation it is necessary to carry out a calibration procedure every two years, and the CIPF unit is changed every three years.

    If this is not observed, then the car simply cannot be driven and must be taken off the route until the problem is eliminated.

    According to regulations, which are constantly changing and updated, in Russia at the moment, for vehicles carrying out purely domestic transportation, equipment with cryptographic information protection devices is used.

    It provides greater data reliability, allows you to save it even in difficult situations, and at the same time makes the reading process as simple as possible.

    But at the same time, international transportation requires slightly different equipment, and this is thought out in regulations. Therefore, you should still find out the list of models for different situations.

    In this country

    Since the installation of tachographs with a cryptographic information protection system is mandatory for vehicles that travel around the country and carry cargo or transport passengers, the list of devices is narrowed.

    But at the same time, there is the option of installing not only Russian equipment, but also some options from foreign manufacturers.

    At the moment, the following tachographs can be installed on cars to travel around Russia:

    • STRIKE TachoRUS (two options);
    • KASBI DT-20M;
    • Mercury TA-001;
    • TCA-02NK;
    • Drive 5/Drive Smart;
    • Intellic GmbH - EFAS V2 RUS;
    • Siemens DTCO (VDO) 3283 (the only foreign version).

    For international transport (without cryptographic information protection)

    For international transport, you can use much fewer tachometers; alternatively, it could be the Austrian EFAS technology or the same DTCO 3281 from Siemens.

    The fact is that the use of devices with CIPF is simply prohibited, since according to the law, the data on such tachographs cannot be exported outside the country.

    Then the question arises - how to move around the country with a device without CIPF, but at the same time moving to the territory of the European Union.

    The answer is quite simple, and lies in the fact that cars equipped with the AETR system and licensed for international transport can move without problems across the territory of the Russian Federation.

    If the car owner wants to install a device with different systems running simultaneously, then this will simply be impossible, because different encryption methods cannot be combined.

    Therefore, more and more often you can come across the question of where to purchase a permit for a puck tachograph, and, oddly enough, it can only be obtained from a government agency.

    Transport subject to control

    The laws of the Russian Federation regarding road safety clearly stipulate which vehicles must be equipped with tachographs.

    Such standards were developed to provide greater safety and the ability to determine the cause of an accident if one occurs.

    In addition, the owner of a vehicle can also benefit from installing a tachograph if he has a hired driver.

    Such a device allows you not only to track your route, eliminating detours and non-work trips, but also periods of rest.

    All tachographs provide information on the smoothness of movement, fuel consumption and other issues, and drivers who do not treat their work equipment with care will be identified.

    There is a fairly narrow list of cars that must be equipped with tachographs, but nevertheless, they make up a fairly large range of all vehicles in Russia.

    Thus, such monitoring devices should be installed on:

    • trucks used to transport dangerous goods;
    • buses with more than 8 seats;
    • trucks with a gross weight of more than five tons;
    • trucks weighing more than 3.5 tons that transport non-hazardous goods.

    It can be concluded that the requirement to install monitoring equipment applies to all vehicles, which can be dangerous if used incorrectly.

    In addition, taking into account the GLONASS system, the manager will always know where his cars are and what condition the driver is in.
