What is the categorization of a vehicle for transporting passengers?

Speaking from the point of view of current legislation, categorization is a procedure for assigning a particular status to a car, i.e. categories, let’s take a closer look at what it includes:

  2. For vehicles that carry passengers, there are four assigned categories.

Why is categorization necessary?

Legislatively, the introduction of mandatory categorization was carried out in order to solve the following problems:

Types of categorization of vehicles for transporting passengers

The assignment of a particular category to a vehicle is made by the authorized body with reference to the current legislation.

It is worth noting that the law currently spells out a list of categories of vehicles that are subject to the procedure, or more precisely:

  • Motor transport
  • Buses
  • Electric ground transport (trolleybuses and trams)

The execution of the state function of categorizing transport infrastructure facilities and vehicles (hereinafter referred to as TTI and vehicles) of road transport, urban ground electric transport and road facilities is carried out by the Federal Road Agency (hereinafter referred to as Rosavtodor). What transport cannot be divided into categories?

Still referring to the current legislation, we can identify a category of transport, which cannot be divided into categories.

Today, in the Federal Law “On Transport Security” you can find regulatory documentation, according to which the categorization procedure is not provided for:

  1. Car trailers, including semi-trailers, and trailers whose purpose is to transport dangerous goods.
  2. Vehicles of category M1. Or, more simply put, simple passenger cars and even those that carry out registered transportation of passengers, i.e. act as a taxi.
  3. Any vehicles, regardless of category, that are used exclusively for registered transportation.
  4. Vehicles that provide transportation for students to an educational institution and to their place of residence, however, in this case, this applies to transport with categories M2 and M3.

It is worth remembering that amendments to legislation are made regularly, which means that the list may be replenished or may lose some items. Therefore, it is worth regularly monitoring and, if necessary, clarifying the information so that no problems arise with the law.

Which vehicles carrying passengers and luggage are subject to inclusion in the Register of OTI and Vehicles

In accordance with the current legislation, the subject of transport infrastructure (carrier) is obliged to submit information for inclusion in the Register of OTI and Vehicles in relation to motor vehicles used for regular transportation of passengers and luggage or transportation of passengers and luggage on order (buses, etc.). In accordance with the technical regulations of the Customs Union “On the safety of wheeled vehicles” TR CU 018/2011, approved by decision of the Customs Union Commission dated December 9, 2011 No. 877, vehicles used for the transport of passengers are divided into the following categories (classes):

  • Category M1 - Vehicles used for the transport of passengers and having, in addition to the driver's seat, no more than eight seats - passenger cars.
  • Category M2 - Vehicles used for the transport of passengers, having, in addition to the driver's seat, more than eight seats, the technically permissible maximum weight of which does not exceed 5 tons.
  • Category M3 - Vehicles used for the transport of passengers, having, in addition to the driver's seat, more than eight seats, the technically permissible maximum weight of which exceeds 5 tons.
  • Vehicles of categories M2 and M3 with a capacity of not more than 22 passengers in addition to the driver are divided into class A, intended for the carriage of standing and seated passengers, and class B, intended for the carriage of seated passengers only.
  • Vehicles of categories M2 and M3 with a capacity of more than 22 passengers in addition to the driver are divided into class I, having a dedicated area for standing passengers and allowing a quick change of passengers, class II, intended for the carriage of predominantly seated passengers and having the ability to transport standing passengers in the aisle and ( or) in an area not exceeding the area of ​​a double passenger seat, and class III, intended for the carriage of exclusively seated passengers.

Necessary documents for the procedure

In order to carry out the procedure for categorizing a car, you will naturally need a certain package of documents that should be submitted to the authorized body.

  1. A copy of a document confirming the existence of a specific carrier, i.e. certificate of registration of an individual entrepreneur, or a corresponding package of documents for a legal entity.
  2. A copy of the technical equipment passport

  4. All documents related to the vehicle, which reflect as much information about it as possible. Such as: cost, hazard class of the car, capacity (or, more simply, the maximum number of passengers that it can carry according to information from the manufacturer).

Individually, the package of documents undergoes changes depending on who applies to the authorized body, the direct owner of the car or its lessee.

If the initiator of the appeal is the direct owner, then the following items are added to the list:

  • A copy of state registration, certified by a notary
  • Extract from the cadastral passport about the transport infrastructure facility

If the submission of papers is carried out by the tenant, then he will be required to:

  • A copy of the agreement between the owner and the applicant on hiring or renting a vehicle
  • An extract from the cadastral passport will also be required.

The procedure for categorizing general equipment

In accordance with current legislation, the categorization procedure must be carried out in relation to OTI defined by Federal Law No. 16-FZ of 02/09/2007 “On Transport Safety”. The responsibility for organizing the categorization of a transport infrastructure facility rests with the transport infrastructure entity (TI). STI is a legal entity, individual entrepreneur and individual who is the owner of a transport infrastructure facility or uses it on another legal basis (lease agreement, operational management agreement, etc.).

Direct categorization of hazardous materials is carried out by the competent authority and consists of the following main stages:

  • submission by the STI to the competent authority of an application for categorization, containing information about the transport infrastructure facility and the subject of the transport infrastructure, as well as complete and reliable information about the quantitative indicators of the categorization criteria;
  • verification, if necessary, by the competent authority of the information provided by the STI through interdepartmental interaction with government bodies and organizations that own such information, and, if necessary, obtaining additional information from transport infrastructure entities;
  • Based on the assessment of the application and information submitted by the STI, the competent authority makes a decision on assigning a category to the transport infrastructure facility;

The result of categorization is the assigned (modified) OTI transport security category.

IMPORTANT

When engaging a specialized organization to conduct an assessment of the vulnerability of OTI, it is necessary to take into account that, in accordance with the current regulatory legal acts (LLA), the information contained in the results of the conducted OU (DOU) of OTI is restricted access information, which is processed in the manner established by the Government of the Russian Federation. These documents are marked “For official use only.” In some cases, they may be classified as classified. The responsibility for protecting and ensuring the safety of this information rests with the subject of the transport infrastructure.
