Inclusion of vehicles used for the transportation of dangerous goods in the Register of Vehicles of Rosavtodor

The RosBezopasnost company is a specialized organization accredited by the Federal Road Agency (Rosavtodor) for the right to assess the vulnerability of OTI and vehicles and has a staff of qualified employees who can provide high-quality advice on the inclusion of road vehicles transporting dangerous goods in the Register of Transport Infrastructure Facilities and vehicles (Register of OTI and Vehicles). You can order a consulting service on including a vehicle in the Register of Motor Vehicles and Motor Vehicles, subject to subsequent ordering of a service to develop a transport safety passport for a motor vehicle used for the transportation of dangerous goods. The RosBezopasnost company provides this service in all regions of the Russian Federation, including for road transport vehicles operated in Moscow and the Moscow region.

Inclusion of vehicles transporting dangerous goods in the Register

To include a vehicle used for the transportation of dangerous goods in the Register of Transport Infrastructure Facilities and Vehicles (Register of Transport Infrastructure and Vehicles) - the subject of transport infrastructure (carrier) is obliged to send complete and reliable information about the vehicle (truck) to the Federal Road Agency (Rosavtodor). ). The procedure and form for providing information are determined by the Federal Road Agency (FDA). The information required to include a truck in the register is established by Order of the Ministry of Transport of Russia dated September 15, 2020 No. 377 “On approval of the Procedure for maintaining the register of transport infrastructure facilities and vehicles”:

  • full name of the vehicle (make, type, model, etc.);
  • information about the subject of transport infrastructure: in relation to a legal entity (name, location, address of the legal entity within the location of the legal entity, state registration number of the entry on state registration of the legal entity and date of entry into the Unified State Register of Legal Entities), in relation to an individual entrepreneur (last name, first name , patronymic (if available), taxpayer identification number, main state registration number of an individual entrepreneur according to the Unified State Register of Individual Entrepreneurs (USRIP), in relation to individuals (last name, first name, patronymic (if available), place of residence, taxpayer identification number (if available));
  • location of the vehicle (if any);

A registration number is required for all road transport vehicles for the development and approval of a vehicle safety data sheet. It is also worth noting that the presence of a transport safety passport for a vehicle used for the transport of dangerous goods is a prerequisite for obtaining a special permit for the transport of dangerous goods.

What information is contained in the vehicle registry?

Let's consider paragraph 7 of the rules for maintaining the registry:

7. The state register contains the following information:

a) information about the vehicle:

  • details of the vehicle passport (electronic vehicle passport);
  • state registration number;
  • identification number (VIN);
  • brand and (or) model (commercial name);
  • category (subcategory) of a vehicle established by the technical regulations of the Customs Union “On the safety of wheeled vehicles” and the Federal Law “On Road Safety”;
  • type;
  • year of issue;
  • model, number, type, power and engine displacement;
  • identification number of the main component of the vehicle (body, frame, cabin);
  • chassis number;
  • body (cabin) color;
  • environmental class;
  • equipped with equipment to supply the engine with gaseous fuel;
  • steering wheel location;
  • curb weight (weight without load) and technically permissible maximum weight (gross weight) for a vehicle intended for the transport of goods or equipment installed on it;
  • manufacturer;

b) information about the registration action:

  • date and name of the registration action;
  • details of the registration document;
  • the division of the State Road Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation that carried out the registration action;

c) information about the owner of the vehicle:

  • for legal entities - full and abbreviated (if any) name of the organization, main state registration number of the entry in the Unified State Register of Legal Entities, reason code for registration with the tax authority, taxpayer identification number, registration address;
  • for individual entrepreneurs - last name, first name, patronymic (if any), date and place of birth, taxpayer identification number, insurance number of an individual personal account, main state registration number of the entry in the Unified State Register of Individual Entrepreneurs, registration address;
  • for individuals - last name, first name, patronymic (if available), date and place of birth, taxpayer identification number (if available), number of the main identification document, insurance number of an individual personal account, registration address at the place of residence and (or) place of stay;

d) information about changes in information contained in the state register.

So, the state register of vehicles is a database that contains information about all cars in the Russian Federation. The registry stores information about both the car itself and its owners.

Note. Information about cars registered with the State Traffic Safety Inspectorate before January 1, 2021 should be transferred to the register automatically.

The operator of the registry is the State Traffic Safety Inspectorate.

9. Information contained in the state register is subject to permanent storage; its destruction or seizure is not allowed. If the information contained in the state register changes, the previously entered information is retained.

Paragraph 9 of the rules states that the register contains information not only about the current state of affairs in relation to the selected car, but also the entire previous history of this car.

For example, if the previous owner completely repainted the car and changed its color, then information about this will be stored in the registry.

What status can an entry in the registry have?

10. In the state register:

  • the “valid” status is assigned to a registry entry containing information about a vehicle registered with the state;
  • the “archival” status is assigned to a registry entry containing information about the removal of a vehicle from state registration, or about termination of state registration due to invalidation of registration, or about a technical error;
  • the status “suspended” is assigned to a registry entry containing information about the temporary termination of a vehicle’s permission to participate in road traffic.

The very first field that contains an extract from the registry (we will discuss obtaining an extract below) is the status of the record, which can take the following values:

  • active;
  • archival;
  • suspended.

Only a vehicle whose entry has the status “ valid ” can be operated normally.

In principle, the “archived” and “suspended” statuses also do not contain anything criminal. However, when buying a car, it makes sense to find out from the seller the reasons why such a status is established.

For example, if the seller stopped registering a car in order to retain a nice license plate, then renewing the registration of the car will not pose any special problems.

For what period is information on registration actions with vehicles available?

The register is formed for all operations with motor vehicles, information about which is contained in the traffic police database. New information will also be uploaded to the register as quickly as possible. At the same time, it must be taken into account that old vehicle registration cards contained in the traffic police database may contain incomplete data and have an incorrect status (<archived> instead of <current> and vice versa). This is a legacy of an era when there was no single online database; each region maintained its own database and sent information to the federal system daily. Naturally, existing errors can be transferred to the new registry.

What extracts from the register can I get?

13. Access to information contained in the state register (except for information with limited access) is provided by the operator of the state register upon request for an extract (hereinafter referred to as the request).

Depending on the composition of the requested information, as well as the subject requesting it, the extract may contain an expanded list of information about the vehicle (hereinafter referred to as the extended extract) or a shortened list of information about the vehicle (hereinafter referred to as the abbreviated extract).

The statement is issued on paper or in the form of an electronic document using the Internet information and telecommunications network, including the federal state information system “Unified Portal of State and Municipal Services (Functions)” (hereinafter referred to as the Unified Portal), the official website of the operator of the state register, as well as through a unified system of interdepartmental electronic interaction and other technical means of communication.

There are 2 options for statements:

  • shortened - anyone can get it;
  • extended - it is issued only to a limited number of people (more information about this is given below).

You can get an extract:

  • on paper (if you contact the traffic police in person);
  • in electronic form (via the Public Services portal, the traffic police website, etc.).

How it will work

However, if we collect the responses of specialists from the Ministry of Internal Affairs and draw analogies with similar federal information resources, we can assume that the vehicle register will have the following features:

  • it will be created on the existing basis of the traffic police;
  • a separate website will be allocated for it;
  • when filling out an application for an extract from the register, the user will need to log in through State Services (to prevent anonymity);
  • for some cars the information will be closed (departmental, etc.);
  • When submitting an application, you will need to indicate several key characteristics of the car/owner, for example, name/make or number/make/color.

Separately, we note that the traffic police database now provides the following information (subject to the VIN of the vehicle):

  • history of vehicle registration in the traffic police, i.e. information about former and current owners;
  • data on vehicle participation in accidents (the database contains records from 2015);
  • information about the theft (whether the car is wanted or not);
  • You can also find out through the traffic police about the presence of restrictions on registration actions with a specific vehicle.

Obviously, all these opportunities will remain in the new register, but, we repeat, the Government Decree, which will clarify the operating procedure of this resource, is still being developed. In any case, closer to the entry into force of the law, it will definitely be presented to the general public, and then it will be possible to discuss the innovations in detail. For now these are just assumptions.

Abbreviated extract from the register

Clause 22 of the rules for maintaining the register:

22. An abbreviated statement in the form according to Appendix No. 2 is issued based on requests from any person.

An abbreviated statement is issued upon request containing the vehicle identification number, or the identification number of the main component of the vehicle (body, frame, cab), or chassis number.

Anyone can receive an abbreviated statement about the car . To do this, he will need to know the VIN number of the car or the number of the body, frame, cab or chassis.

The extract form is given in Appendix 2 to the rules:

Appendix 2. Abridged statement

This is exactly the type of statement you can get if you want to check the car before purchasing.

The abbreviated statement does not contain information about the personal data of the car owner and other personal information.

Note. The contents of the abbreviated extract almost completely coincide with the information that can be obtained using the “Checking registration history with the traffic police” service.

The abbreviated statement additionally contains information about the environmental class of the car, as well as the status of the entry in the register.

What is the categorization of a vehicle for transporting passengers?

Speaking from the point of view of current legislation, categorization is a procedure for assigning a particular status to a car, i.e. categories, let’s take a closer look at what it includes:

  1. To begin with, the assignment of a category is carried out by an authorized body on the basis of documents provided by the owner.
  2. For vehicles that carry passengers, there are four assigned categories.
  3. The issued document is a legal basis for the use of transport on regular trips, for private transportation of passengers and for the provision of other transport services.

Extended extract from the register

14. An extended extract in the form according to Appendix No. 1 is issued:

a) the owner of the vehicle in respect of whom an extended extract is requested, his legal representative or representative acting on the basis of a power of attorney;

b) courts, prosecutorial authorities, investigators, inquiries in connection with criminal, civil cases, cases of administrative offenses in their proceedings, bailiffs in connection with the exercise of their functions of executing judicial acts or acts of other bodies, as well as tax authorities, customs and other authorities and persons in cases and in the manner provided for by the legislation of the Russian Federation, or on the basis of agreements concluded with the operator of the state register to perform the functions assigned to them;

c) law enforcement agencies of foreign states and international police organizations in accordance with international treaties of the Russian Federation.

Unlike a shortened statement, an extended statement can only be obtained by the owner of the vehicle , as well as representatives of some government organizations. This is not surprising, because the extended statement contains much more information about both the car and its owners:

Appendix 1. Extended statement

To receive an extended statement, it is not necessary to indicate the vehicle’s VIN number:

15. An extended statement is generated based on one of the following information:

a) the name of the legal entity, or the main state registration number of the entry in the Unified State Register of Legal Entities, or the taxpayer identification number - for the owner of the vehicle - a legal entity;

b) insurance number of an individual personal account or last name, first name, patronymic (if available) and date of birth of the owner - for the owner of the vehicle - an individual or individual entrepreneur;

c) vehicle identification number, or identification number of the main component of the vehicle (body, frame, cabin), or chassis number;

d) state registration number of the vehicle.

Subparagraph d says that an extended statement can be obtained simply by car number .

List of exceptions not subject to categorization

Let us turn to Order of the Ministry of Transport No. 196 “On establishing a List of transport infrastructure facilities and vehicles that are not subject to categorization by type of transport” dated July 23, 2014.

II. Vehicles

Automobile transport

Motor transport vehicles of category M1 carrying out passenger transportation on request

Motor vehicles carrying out transportation on order for the purpose of providing funeral services

Car trailers, car semi-trailers used for the transport of dangerous goods

Vehicles of categories M2 and M3, used to transport students from their place of residence to their place of study and back, free of charge

The list of exceptions includes the following vehicles:

  • Passenger cars carrying passengers on request (taxi).
  • Vehicles for funeral services.
  • Trailers and semi-trailers for the transport of dangerous goods.
  • School buses.

Note. Category B trucks, which can also be used as taxis, are not included in the list of exceptions, because they belong to category N1.

How long does it take to issue an extract?

24. The operator of the state register issues an extract:

  • in the form of an electronic document - within no more than 3 working days from the date of receipt of the request, unless a different period is established by the legislation of the Russian Federation. Upon request sent in electronic form in an automated manner using the Unified Portal, an extract is issued in the form of an electronic document immediately, but no later than the next business day after the day the corresponding request was sent;
  • on paper - within no more than 10 days from the date of receipt of the request, unless a different period is established by the legislation of the Russian Federation.

Dates for issuing statements:

  • 10 days - on paper;
  • 3 working days - electronically without using the State Services portal;
  • immediately , but no later than the next working day - through State Services.

How to obtain an extract from the register through State Services?

The fastest way to receive an extract is to order it through the Public Services portal. However, at the time of publication of this article (February 5, 2021), such a function has not yet been implemented in State Services, that is, it does not work.

3. The Ministry of Internal Affairs of the Russian Federation, together with the Ministry of Digital Development, Communications and Mass Communications of the Russian Federation, within 6 months from the date of entry into force of this resolution, ensure the opportunity for citizens to obtain information contained in the state register of vehicles through a personal account in the federal state information system “Unified portal of state and municipal services (functions)”.

Paragraph 3 of Government Decree No. 1874 states that the function will be implemented in public services within 6 months, that is, until July 1, 2021 . As soon as this happens, this article will be updated.

Results of the procedure

Based on the results of the categorization, the car is included in the appropriate register within 30 days based on:

  • Decisions on assigning the appropriate category
  • Decisions on inclusion in the register of categorized vehicles
  • Solutions for changing vehicle category

Operating a car without carrying out the categorization procedure is prohibited by law, which means that this process should not be neglected, because otherwise serious problems with the law may arise.

Storing information about statements in the registry

33. Information about all requests received and extracts issued on their basis is stored in the state register.

In addition to information about the vehicles themselves, the register also stores information about all issued extracts. That is, if someone requested information about your car, a corresponding entry will appear in the registry.

However, even the owner of the car cannot obtain information about this. Apparently it will be kept for official purposes.

Types of categorization of vehicles for transporting passengers

The assignment of a particular category to a vehicle is made by the authorized body with reference to the current legislation.

It is worth noting that the law currently spells out a list of categories of vehicles that are subject to the procedure, or more precisely:

  • Motor transport
  • Buses
  • Electric ground transport (trolleybuses and trams)
  • Railway transport

At the same time, each individual type of vehicle provides individual features of the procedure and sometimes its own exclusive package of documents.
