The need for technical inspection

If you carefully study the traffic rules of the Russian Federation, you will notice that the diagnostic card is not included in the list of documents required to drive a car. Therefore, many people immediately become confident that there is no need to waste time on undergoing mandatory maintenance. But this belief is not entirely correct.

The technical inspection procedure itself involves a detailed diagnosis of the vehicle in order to identify its weak points, which, during operation, can cause a serious accident. This includes:

  • Electrical equipment (head optics, turns, side lights and windshield wipers);
  • Chassis and steering;
  • Locks of the luggage compartment, doors and engine compartment lid;
  • Brake system;
  • Condition of technical fluids.

But the listed criteria are very important when applying for an MTPL policy, which refers to the list of documents required for driving a vehicle.

Based on this, it follows that by ignoring the maintenance, the motorist will not be able to conclude an agreement on the protection of civil liability. Therefore, routine diagnostics can be called a mandatory procedure. Let’s look at the fine for driving without a technical inspection in 2021, in accordance with the new rules, and how much time the driver has to receive a ticket.

Conditions and terms of passage

According to the current law of the Russian Federation, any equipment can undergo maintenance, regardless of its category and age. To do this, its owner only needs:

  1. Correct all existing deficiencies in the electrical equipment, braking system and steering of your vehicle;
  2. Make an appointment at the traffic police;
  3. Drive the vehicle to the observation deck at the specified time;
  4. Provide the necessary documents to the State Traffic Inspectorate employees (passport, PTS, certificate of registration of a car or motorcycle with the MREO, etc.).

Vehicle maintenance

Next, the citizen just has to wait until the maintenance is completed (on average, this procedure lasts about 30-40 minutes) and pick up his diagnostic card. Each re-inspection of the vehicle will need to be carried out no later than after:

  • 365 days – for cars up to 2012;
  • 24 months – for cars from 2012 to 2021;
  • 3 years – for vehicles from 2021 to 2021.

Moreover, the listed time frames apply not only to category B, but also to any other self-propelled equipment, from motorcycles to passenger buses. ○ Who is required by law to have a vehicle inspection?

Part 2 of Article 12.1 of the Code of Administrative Offenses of the Russian Federation states:

  • “Driving a passenger taxi, bus or truck designed and equipped for the transport of people, with more than eight seats (except for the driver), a specialized vehicle designed and equipped for the transport of dangerous goods that have not passed state technical inspection or technical inspection shall entail the imposition of an administrative fine in the amount of five hundred to eight hundred rubles.”

Thus, the absence of a diagnostic card for passing a technical inspection is necessary only for some categories of drivers.

The law says nothing about drivers of conventional vehicles.

Moreover, not a single traffic police inspector now has the right to even ask whether you have the coveted card confirming that you have taken measures to ensure that your vehicle can be considered operational.

It will be such if the following parts of the vehicle are in working condition on your machine and comply with the standards and specifications:

  • Brake system.
  • Windshield washers and wipers.
  • External lighting devices.
  • Signaling.
  • Engine.
  • Steering system.

Fine for lack of maintenance

Due to the fact that failure to undergo diagnostics becomes the reason for refusing to issue a compulsory insurance policy to a motorist, the primary punishment for him will be a financial penalty for driving without compulsory motor liability insurance - 425 rubles. But since the fine for technical inspection in Russia for 2021 is less than the specified amount, the State Traffic Inspectorate does not take it into account.

The second degree of liability, outside the administrative code, which awaits a driver with an expired diagnostic card and, as a result, with a missing insurance policy, is a traffic accident that may occur through his fault. Without a compulsory motor liability insurance agreement, all expenses of the affected persons will fall on his shoulders. And this amount is much more than 425 rubles.

The Code of Administrative Offenses also provides for a fine of 5 thousand rubles for repeated driving without a technical inspection within a short period of time. For evading the payment of financial penalties or in case of a long delay, the motorist risks losing his license for up to 3 months, with the subsequent sending of the car to the impound lot. Moreover, this applies to both ordinary citizens and legal entities issuing a maintenance ticket for commercial vehicles.

Situations that may result in penalties

Let's look at why and in what cases sanctions may be imposed on you for not having a compulsory motor liability insurance policy:

  1. The driver does not have an insurance policy with him.
  2. A Russian citizen is not included in the policy.
  3. The document is expired or missing altogether.
  4. The situation when an electronic document is issued.

Let's focus on these 4 positions and find out what the penalty is in each case.

  • The warrior does not have a policy with him.

If the document in question was left at home, tell the traffic police inspector about it. In a good situation, you can get off with a warning or, within the framework of the Code of Administrative Offenses of the Russian Federation 12.3 part 2, a fine of 500 rubles will be issued. In addition, the car may be placed in a fine/parking lot.

  • Not included in the document.

In this case, you face a fine of 500 rubles. We are talking about a person who, at the time of the stop, was not included in the document and was not the owner of the car.

  • Late or missing document.

Forgetting to renew your policy will cost you 800 rubles. (forgot to renew and/or did not apply for compulsory motor liability insurance, prepare 800 rubles). Renewal may not be earlier than 60 days before the expiration date of the document, which is issued for one year.

  • When preparing an electronic document.

If you do not have a printed electronic MTPL policy, the inspector has the right to issue a fine of 500 rubles.

Who should be afraid

According to current legislation, almost all motorists should be wary of fines for lack of technical inspection from January 1, 2021, regardless of the make, age and category of their vehicle. An exception in this case is:

  • Cars of the current year of manufacture;
  • Vehicles that have a CASCO policy.

The rest of the cars are required to undergo maintenance within the prescribed period (you can expire the current diagnostic card only if the compulsory motor liability insurance is issued for a period of more than one year). State Traffic Inspectorate employees show the greatest interest in the following types of vehicles:

  • Old cars whose age reaches 20-30 years;
  • Commercial vehicles designed to transport goods or passengers.

It is important to know! In both of these options, vehicles are most often in poor condition, and therefore problems with passing maintenance are quite normal for them. Traffic police inspectors take advantage of this by issuing fines to drivers for technical inspection.

Conditions for passing technical inspection for various vehicles

According to current legislation, the established period after which a re-inspection is required depends on the type of vehicle and its age. According to general rules, if less than three years have passed since the start of operation, no technical inspection is required. The next starting point is 7 years. If the vehicle is younger than this age, then repeated technical inspection is provided every two years, if older - every year.

Separately, it is worth noting such categories of transport as:

  • Taxi;
  • trucks weighing more than 3.5 tons;
  • buses (if it seats more than eight people);
  • special transport.

For these types of transport, passing a technical inspection is valid for six months. However, in any case, the form of operation of a particular vehicle plays a decisive role.

Innovations in legislation

It was previously said that the algorithm for the maintenance procedure has become significantly stricter due to the adopted innovations in the legislation of the Russian Federation. This is expressed in the following facts:

  • Improvement of video recording of technical inspection (when receiving a diagnostic card at private service stations). From now on, motorists will be required to provide traffic police officers with a complete film of the vehicle diagnostic process, which clearly shows the car’s license plates;
  • Change of supervisory authority. Previously, the Russian Union of Auto Insurers monitored the maintenance. But due to the frequent sale of coupons, the state decided to shift responsibility for routine inspection onto the shoulders of Rostransnadzor;
  • Development of a new program for assessing the technical condition of a car. In addition to general information about the vehicle, the following will now also be taken into account: statistics on road accidents involving it (including those under the influence of alcohol), and statements from the service station on the frequency and quality of maintenance performed.

Otherwise, the maintenance procedure will not change. And the introduced innovations, according to the State Traffic Inspectorate, should reduce the likelihood of purchasing a diagnostic card for money.

What does the law say?

When considering the issue, it is important to know the following definitions:

  • Technical inspection is a set of measures aimed at checking the technical condition of the machine. During the maintenance process, the serviceability of the components is checked, as well as the compliance of the elements with current legal standards. In 2021, you will not be able to apply for compulsory motor liability insurance without a diagnostic card.
  • A diagnostic card is a special paper in which the results of the technical inspection are noted. In recent years, it has been a common practice in the Russian Federation for drivers to receive a diagnostic card without checking the car. Today, all measures are being taken to avoid such a problem and eliminate the possibility of processing documents without maintenance.

The punishment for a violator for driving a car without a diagnostic card is specified in the Code of Administrative Offenses (Article 12.1). It stipulates that in the absence of a technical inspection, the driver pays a fine of 500-800 rubles. The situation gets worse if the car owner ignores the requirements of the traffic police and is caught by the inspector again. In such a situation, you will have to part with a larger amount - 5,000 rubles. An alternative to punishment is deprivation of the right to drive a car for a period of 30-90 days.

This article stipulates responsibility for the lack of technical inspection, but does not stipulate the right of a traffic police officer to check the diagnostic card. Against this background, you need to figure out what the car owner should do if such a requirement is received from the inspector.

General concepts

The purchase of an MTPL policy and its regular technical inspection are necessary not only after purchasing a car, but also as a result of acquiring it by inheritance or receiving it as a gift.

The owner of the car, its driver and the policyholder may be different persons.

Diagnostic card

Previously, there was a vehicle inspection ticket that every driver was required to carry with them when traveling and present it to the traffic police inspector who stopped them upon his first request.

In 2021, according to the changed rules, a representative of the State Traffic Safety Inspectorate does not have to demand to show him a document confirming that he has passed a technical inspection.

The concept of a vehicle inspection ticket has lost its meaning. A new thing has appeared - a diagnostic card.

The diagnostic card is an A4 form, filled out on both sides.

The main side reports vehicle data:

  1. Category.
  2. Brand.
  3. Year of issue.
  4. Registration number.

The front side of the form indicates the registration number of the vehicle in the traffic police database, consisting of 15 characters, as well as the validity period of the card.

On the reverse side is the inspection report. It is necessary to make sure that the signature and seal are present.

It is not necessary to have this document with you when traveling, since now the traffic police inspector has no right to demand its presentation.

The presence of a valid diagnostic card is included in the list of documents required for issuing an MTPL policy.

The frequency of inspection depends on the type of specific vehicle and its operating conditions.

Failure to comply with insurance legislation will result in a fine being imposed on the vehicle owner.

When undergoing a technical inspection, if faults are detected, the issuance of a diagnostic card may be refused.

Within three weeks, the detected faults should be repaired at a repair shop and re-tested by the same technician.

During the secondary inspection, only the faulty areas will be checked. You will be charged proportionately less for this.

During a full technical inspection, the following is checked:

  • availability of a first aid kit;
  • presence of a fire extinguisher;
  • proper operation of mechanisms;
  • the presence of additionally installed equipment in addition to the factory equipment;
  • action of the braking system;
  • serviceability of electrical wiring;
  • lighting;
  • tire wear;
  • no backlash;
  • reliability of fastening seat belts.

When installing additional equipment, you must provide factory documentation for it.

Passing a technical inspection is not tied to the place of registration of the car and can take place in any region of Russia.

To carry out a technical inspection, you will need two documents - a passport of the owner of the vehicle and a certificate of registration of the car.

In 2021, cars, motorcycles, trailers, and trucks weighing up to 3.5 tons are exempt from fines for lack of inspection information.

For legal entities using transport for profit - taxis, buses, trucks for cargo transportation, the fine for absence or expiration of validity is 5 thousand rubles.

In this case, the characteristics of the transport used are important - the engine volume of the car must be more than 50 cm3, and the maximum possible speed must be more than 50 km/h.

The fine for driving these categories of vehicles is paid by the driver. The owner of this vehicle is not responsible.

The database in which all information about the results of completed technical inspections is stored is a unified automated maintenance information system, abbreviated as EAISTO.

What it is

The MTPL policy insures the liability of the car owner for damage caused during an accident to other participants who are not at fault.

The presence of an MTPL policy shifts the responsibility to pay financial compensation to the insurance company with which the policy was issued.

The law obliges car owners to purchase an MTPL policy. Absence is punishable by administrative fines.

If an accident occurs due to the fault of the driver, if the policy does not exist or the validity period expires, he will have to pay compensation himself.

Who does it apply to?

All owners and drivers of vehicles are required to comply with legal requirements.

There are categories of car owners for whom these rules have their own characteristics. The situations that influence the amount of punishment may also be different.

Responsibility for lack of technical inspection in accordance with Art. 12.1 of the Code of Administrative Offenses is assigned to the owners of vehicles.

Preferential categories of citizens

For beneficiaries in 2021, passing a technical inspection is a free procedure.

Preferential categories include:

  1. Pensioners.
  2. Disabled people.
  3. Heroes of Russia.
  4. Organizations providing care for disabled people with vehicles to serve them.

To conduct a technical inspection, preferential categories and organizations should provide the following documents to the service station employee:

  • car owner's passport;
  • pensioner's ID;
  • vehicle registration certificate;
  • disability certificate or registration documents of the organization providing care for the disabled;
  • power of attorney if the car is provided for inspection by another person.

The presence of disability or retirement age does not exempt you from complying with technical inspection rules. This only applies to the payment for it.

Dependence of technical inspection on the vehicle

The need for frequency of inspection depends on the category and age of the vehicle. Cars less than three years old do not need to undergo technical inspection.

Accordingly, a diagnostic card is not needed. In addition to passenger cars, this benefit applies to motorcycles, trailers, and trucks weighing less than 3.5 tons.

If more than three years have passed since graduation, it will no longer be possible to obtain an MTPL policy without a diagnostic card.

Safety inspections must be carried out every two years, and for vehicles older than seven years – every year.

Sometimes you have to undergo a technical inspection before the end of the period specified in the diagnostic card. Such a case is traveling abroad when some reserve is needed.

A prerequisite is to enter reliable information into the OSAGO policy. Otherwise, it will not be recognized as genuine, which will result in sanctions and refusal to pay compensation.

Therefore, the accuracy of the information entered is a prerequisite for the competent execution of an insurance policy.
