Is it necessary to call an emergency commissioner in case of an accident?

An accident commissioner is a qualified specialist whose responsibilities include providing comprehensive assistance to a participant in an accident. It should be remembered that he does not have any rights or powers; he is not a witness. And it just provides assistance to drivers or one of them in registering the incident.

Emergency commissioners are divided into three types:

  1. Independent is a legal entity that provides its services independently of the insurance company. This is the most reliable and objective option, because such an emergency commissioner will only be interested in helping you file an accident. Of course, the cost of an independent expert will be much higher. But you can be sure of his impartiality and objectivity.
  2. Employees of an insurance company are individuals who are on the staff of the insurance company. It is beneficial for insurers to have such an employee. It is ]included in the CASCO policy[/anchor]. Moreover, depending on its cost, the package of servants provided by the avarkom will also differ. According to the law, such services cannot be included in the compulsory motor liability insurance policy, as this is regarded as poaching clients.
  3. Accident commissioners cooperating with an insurance company are legal entities that, in addition to independent activities, provide their services to the insurance company. Unfortunately, if the commissioner represents an insurance company, he may deliberately make errors and inaccuracies in the registration of a traffic accident in order to reduce the amount of insurance payment.

Is it necessary to call an emergency commissioner when registering an accident? No, if the participants have no disagreements about the culprit, if there are no victims, if there is an understanding of how the documents are filled out. This is just an additional service that is provided to help drivers. Only in some cases, if one of the participants has a CASCO insurance document, which stipulates the mandatory arrival of a commissioner at the scene of an accident, it is necessary to call this employee. Otherwise, the insurance company may refuse to pay.

How to call the unified emergency dispatch service

In Russia there is a single telephone number to call an emergency commissioner in case of an accident: 8-800-500-49-34. Operators on call work around the clock. They clarify the city, location of the traffic accident, details of the accident and tell you what needs to be done next. This call is free of charge.

Another option - without waiting for an accident, you need to find on the Internet the telephone number of emergency commissioners working in your city. The surest way to find a good commissioner is to choose him on the recommendation of drivers who have previously used his services and received a positive result as a result of cooperation. The phone number should be written down and placed in an accessible place, for example, in the glove compartment of a car.

The driver should take into account that the services of emergency commissioners can be provided either on a one-time basis or on the basis of a subscription for an unlimited number of calls throughout the year.

If the insurance company has prescribed in the CASCO insurance contract an option to call an emergency commissioner, then you need to call exactly the employee of the commissioner whose contact details are indicated in the insurance contract. You should not act arbitrarily and call an outside representative in such a situation; the insurer has the right to refuse to pay insurance compensation on this basis.

Procedure for registering an accident

When the emergency commissioner arrives at the scene of an accident, he must act according to a certain scheme, observing the procedure described below for registering an accident.

  1. Arrives at the scene of a traffic accident and carefully inspects the scene.
  2. Provides psychological assistance to drivers if necessary. He can also provide first aid and call an ambulance.
  3. Next, the emergency commissioner begins to record the details of the incident. Takes photos and videos, interviews witnesses, and, if necessary, looks for external surveillance cameras that could have recorded the accident.
  4. After collecting information, he assesses the amount of damage caused to the car and property. At the same time, he describes in detail all the damage in the accident with details.
  5. The emergency commissioner fills out the documents and issues an insurance certificate.

It should be noted that this extended plan applies to private commissioners rather than insurance company employees. The latter have a very limited plan of action. Their main goal is to record damage and reduce the amount of the rhinestone payment.

What practical actions does avarcom perform?

First, he makes an objective and comprehensive assessment of the situation that has developed as a result of the accident: he photographs the scene of the accident, dents and damage to the car and other objects related to the event; analyzes all registration and insurance documents for vehicles, and reconstructs the full picture of the incident. He also provides the necessary assistance to victims and facilitates the registration of notification of an accident. If necessary, the avarkom also provides medical assistance. You don’t need to ask him to call the traffic police, an ambulance or a fire truck - he will do all this without unnecessary reminders.

It should be noted that in some cases, namely if the emergency commissioner service has concluded an agreement with an insurance company whose client is the victim, then the latter will not have to pay for the call and for the work of a specialist.

Responsibilities of an emergency commissioner in case of an accident

Below is a list of activities that the emergency commissioner must carry out after arriving at the scene of an accident.

  1. Inspects the scene of the accident.
  2. If necessary, call the traffic police and a tow truck.
  3. Interviews witnesses.
  4. Takes photos and videos of the accident scene and damaged vehicles.
  5. Conducts an assessment of the amount of damage.
  6. Prepares the necessary documents, including an emergency certificate.

An emergency certificate is a report on the work done by the emergency commissioner. It includes: a diagram of the accident, photographs, comments, full of information about the situation and the participants in the accident. Thus, the commissioner carries out the actions that the driver involved in the accident is required to perform, in accordance with paragraph 2.6 of the traffic rules. The law does not prohibit third parties from helping a participant in an accident in registering it.

Step-by-step instructions for action in case of an accident

The first actions of a driver in an accident

The first thing to do is stop the car, turn off the engine and remain calm. At the same step, you need to turn on the alarm.

Government Decree No. 907 of September 6, 2014 states that the roadway must be cleared in order to remove obstacles to the movement of other cars. Failure to comply with this rule will result in a fine. On the other hand, moving the car from the scene of an accident can distort the picture of what happened and prevent the drawing up of a fair diagram of the road accident.

Before moving the car from the scene of the accident, you must:

  • call the traffic police officer on duty and find out whether this should be done;
  • if he “gave the go-ahead”, do not rush: think about how much this will interfere with drawing up a true picture of the emergency situation;
  • if you decide to move the car, take several photos and video reports from the scene of the collision, and enlist the support of witnesses.

Remember! It’s better not to move the car and pay a fine than to do it thoughtlessly and be charged with a criminal offense!

Installation of an emergency sign

To warn drivers of passing cars about an emergency situation on the road and prevent the occurrence of another accident, it is necessary to install a special sign. It should be placed at a distance of 15 m from the vehicle in a populated area and 30 m on the highway. The fine for ignoring this requirement is 1000 rubles.

Providing assistance to victims

  1. If passengers were injured during an accident, they must be given first aid. Attention! It is forbidden to take independent measures to provide first aid if you are unable to do this, because such attempts are fraught with complications of the general condition and death!
  2. If serious complications occur, hospitalization is required. To do this you need to call 103 . If dialing fails, number 911 or 112 .
  3. If the arrival of an ambulance in the near future is impossible, it is permissible to transport the victim to the hospital in a passing vehicle.

Sometimes circumstances are such that a road accident ends in injury and even death. If this happens, you need to wait a long time for an ambulance, and it is impossible to send the wounded to the hospital by passing transport; it is permissible to transport the patient in a car that was involved in the accident. This measure will relieve the driver from responsibility for moving the vehicle from the scene of the accident and hiding from the scene of the accident. An important condition is that you need to provide your name and information about the car at the emergency room, and then return to the scene of the accident.

Calling the traffic police

You need to remain calm when calling the traffic police and provide the person on the other end of the line with detailed information about the scene of the accident. After you called the traffic police and began to wait for the arrival of traffic police officers, you should begin to resolve organizational issues. For example, if you work with an insurance company that has a free one, you can use it.

Waiting for the arrival of traffic police officers

This process can take a long time. Instead of tormenting yourself and being nervous, you should do useful things.

  1. Talk to witnesses to the accident and write down their phone numbers. Passengers can act as them.
  2. Remember the make, model and license plate number of the vehicle of the second party involved in the accident.
  3. Turn off the recorder, remove the memory card from the device and hide it in a safe place: the recording can become valuable evidence in the process of identifying the culprit.
  4. Inspect the damage to the car and record it with a camera. Additionally, you can shoot a video to more accurately capture the circumstances of the accident.
  5. Inspect the scene of the incident and pay attention to the following details:
  • the section of the road where the accident occurred (width, quality, signs, presence of nearby bus stops, buildings, lawns);
  • position of the machines, marks from braking, dragging, location of broken parts, fragments, if any;
  • the directions in which the vehicles involved in the traffic accident were moving;
  • weather conditions at the time of the collision;
  • the presence of video cameras on nearby buildings.
  1. Inspect the car of the second participant in the accident, paying attention to the following points:
  • is there tinting on the windows, headlights, brake lights;
  • color of side lights;
  • differences in wheel diameter and tire tread;
  • is there a child seat;
  • damage.
  1. Try to communicate with the other participant in the accident and determine whether he is intoxicated. It is not recommended to be rude to each other and sort things out.

Arrival of traffic police officers

When traffic police officers arrive at the scene of the accident, you need to assist them in drawing up a true picture of the accident. Describe as many details as possible that will help in identifying the guilty parties, express your suspicions about the state of alcoholic intoxication of the other driver, if any, provide information about witnesses and anything else that seems significant to you.

After drawing up the accident diagram, you need to carefully study it and confirm the correctness of the entered data. If inaccuracies are found, you need to report them to the traffic police officer and make adjustments. Documents drawn up at the scene of an accident must include detailed information about all participants in the event. That is, it is important to describe their full names, addresses, and telephone numbers.

Following actions

After registering a road accident, each participant must receive a copy of the Protocol. After the traffic police officers leave, you need to pick up the fallen parts of the vehicle and take them with you to present to a representative of the insurance company. Within three working days from the moment of the traffic accident, you must contact the insurance company of the person responsible for the accident, presenting a photocopy of the protocol, resolution (if there are traffic violations), and notification of the accident.

Advantages of registering a traffic accident with an emergency committee

The participant in the accident decides whether it is worth calling an emergency commissioner to the scene of the accident. What are the benefits of such actions?

  1. The wait for traffic police officers sometimes lasts more than one hour. The emergency commissioner will arrive on site as soon as possible and begin the registration process.
  2. Many drivers or passengers receive serious psychological trauma during an accident or simply begin to get lost in an unfamiliar situation. The Commissioner can provide psychological support and reassurance.
  3. Before the inspectors arrive, he will inspect the accident site, take photographs and video, interview participants and witnesses, and draw up a diagram of the accident.
  4. The emergency commissioner will record and document all damage in detail, unlike inspectors who only note damaged parts without a detailed description. This will be very useful when contacting an insurance company.
  5. He will communicate with traffic police representatives on your behalf, representing your interests.
  6. In the future, an independent commissioner will be able to represent your interests in court, if necessary.
  7. In the event of a fake accident, he will be able to counteract the scammers.

In what situations can you do without an emergency switch?

If there are no victims in the accident, and its participants have the same assessment of the scale of the incident, drivers have the right to independently draw up a diagram of the accident, put their signatures on it and present the document to the traffic police officer at the nearest post. Naturally, there is no need for emergency services. However, not all car owners are competent in this matter.

As already emphasized, the emergency commissioner is a professional who knows all the intricacies of the legal registration of an accident. In certain cases, he performs work that falls within the competence of a traffic police officer. He will take measurements, photograph the scene of the incident and draw the correct diagram. Then he will document all this and record in writing the testimony of the participants in the accident. The entire procedure lasts approximately 45 minutes. Agree, this is not a very long period of time. At the final stage, all documentation compiled by the emergency committee is sent to the administrative practice department of the traffic police.

Features of registration of an accident

As a rule, the emergency commissioner arrives at the scene of the incident after 10-20 minutes. The exact time will depend on the region, traffic conditions and the specialist’s availability. The average time for a professional to register an accident is from 20 to 40 minutes.

Despite the fact that the emergency commissioner is a highly qualified specialist, you cannot count on him to do everything for you. There is no point in following on his heels and interfering in his work, but you will have to monitor his actions. If, in your opinion, he missed something or did something wrong, pay attention to it. Of course, if the commissioner represents an insurance company, he can easily ignore your comments. But if you called the emergency commissioner yourself to register an accident, then demand that he fully comply with the entire registration procedure.

It should be remembered that the commissioner in no case replaces the traffic police officer. He only helps the participant in the accident to register a traffic accident in accordance with the legislation of the Russian Federation. It is possible to do without the police only if the participants in the incident decided to draw up a Europrotocol.

Who is he and who does he work for?

So who is he? This is a qualified specialist who is engaged by the insurance company to record the fact of an accident, determine the causes of the insured event and the amount of damage caused. A certain part of car owners mistakenly believes that the accident commissioner is an employee of the insurance company. In reality, this is a representative of a private company that cooperates with insurers under a service agreement.

It should be emphasized that the activities of the avarkom are regulated by Russian legislation, and it does not imply licensing.

The accident commissioner has registered the accident, what next?

After the accident is registered, the participants must have the following documents in their hands from the traffic police inspectors: a certificate of the accident, a protocol and a resolution. The accident commissioner must issue an insurance certificate. The victim must contact the insurance company within 15 working days. You must take the following documents to the insurance company:

  • statement;
  • certificate of accident;
  • protocol;
  • resolution;
  • passport;
  • STS and PTS for a damaged car;
  • driver's license;
  • insurance certificate filled out by the emergency commissioner.

If the accident was registered by the insurance commissioner, then no additional inspection of the car is required. If the registration was carried out by a private commissioner, then the insurance company may assign you an inspection date, which will be carried out by an appraiser. Moreover, if the car is running, you are obliged to provide it for inspection on the agreed day. If the car is not running, then the appraiser goes to the place where the car is stored.

In accordance with the new law on compulsory motor liability insurance, which came into force on April 27, 2017, monetary compensation can only be obtained as a last resort. In most situations, cars will be sent to an authorized car repair shop for repairs. Within 20 days from the date of submission of documents to the insurance company, they are obliged to issue a referral for repairs or reimburse the amount of damage if the situation falls under certain conditions.

Registration of an accident without the traffic police

If the participants in a car accident cannot wait for the traffic police to arrive for some reason, then it is possible to draw up a European protocol, i.e. the incident is registered without the traffic police. The best option is to do this with the help of emergency personnel.

In accordance with Art. 11.1 Federal Law No. 40-FZ, registration of an accident without the involvement of representatives of the traffic police is permissible if the following conditions are met in total:

  • no people were injured in the accident;
  • no more than 2 cars were involved in the accident;
  • there was a car collision. If one of the participants in the road incident managed to avoid a collision, and as a result of an emergency maneuver crashed into another object, then calling the traffic police is mandatory;
  • all parties to the incident have a valid MTPL policy;

  • the participants in the accident have no disagreements regarding the circumstances of the accident, and from June 1, 2018, residents of Moscow, St. Petersburg, the Moscow and Leningrad regions will be able to draw up a European protocol even if there are disagreements, if the amount of damage does not exceed 100 thousand rubles (amendments made by the Federal Law (FZ) No. 448-FZ dated December 29, 2017 (Article 1, Part 1, Clause “a”) in Article 11.1 of Federal Law No. 40-FZ);
  • the amount of damage caused does not exceed 50 thousand rubles, and from June 1, 2018 - 100 thousand rubles (amendments introduced by Federal Law No. 448-FZ dated December 29, 2017 (Article 1, Part 1, Clause “d”) in Art. 11.1 Federal Law No. 40-FZ).

Avarkom will record the testimony of the parties to the accident, witnesses, draw a diagram of the incident, and draw up a statement to the traffic police department of the territorial region where the accident occurred. Then the commissioner will deliver the completed package of documents to their destination, i.e. to the nearest stationary traffic police post or directly to the traffic police department if the accident occurred in the city. The amount of losses is recorded by an emergency certificate, which is also issued by the emergency committee.

Why and how an accident commissioner carries out registration of an accident

From the moment of the incident to full compensation for losses, there is a long path that consists of many stages. Not every driver understands them. And if there is an emergency commissioner, you just need to follow his instructions, he will help you complete all actions as quickly as possible. But it's not that simple. Whose interests does Avarkom protect? An accident commissioner, working on the staff of an insurance company, protects the interests of the insurer, since he is paid for this. The main responsibility of such a commissioner is to reduce the amount of insurance payment. In this case, the rights of the insured driver are not openly infringed. Avarcoms are well versed in all the legal subtleties of the registration process and can do everything necessary for the insurance company efficiently and unnoticed by an inexperienced motorist.

The damage is significantly underestimated, and the culprit may be a completely different driver.

How much will the work of an emergency commissioner cost?

The price for the services of such a specialist directly depends on the amount of work that he must perform. Usually the cost of the insurance policy increases by this amount. If the work of an emergency responder is included in the insurance policy, then for visiting an accident and describing all the circumstances and a diagram of the accident site it will cost 12-20 thousand rubles. If you need the commissioner to collect a package of documents for insurance payments, you will need to pay more for his services - 20-35 thousand rubles. If you want to receive a full range of services, including calling a tow truck and arranging for the vehicle to be placed in an emergency parking lot, you will need to pay 45 thousand rubles.

Calling an emergency dispatcher from a specialized service will cost less: about 2 thousand in Moscow and the region, in St. Petersburg - from 1.5 thousand rubles. Registration of all documents and organization of vehicle evacuation will cost another 2-3 thousand. Subscription for a full package of services and an unlimited number of trips – 7-10 thousand.

How to call a commissioner to the scene of an accident

A person responding to a call to the scene of an incident may be:

  • an employee of the company that insures the client’s car;
  • a specialist from a law firm that provides such services;
  • individual entrepreneur.

Depending on this, there are different options, since the customer (and, accordingly, the payer) can be either an insurance company or a driver. If the car is insured under CASCO, you should carefully study the contract. Perhaps his (the commissioner's) services are already included in the cost of the policy. Then you need to call the insurance company, report the incident, call the emergency response officer and follow his instructions.

A call to the insurer (if you have CASCO insurance) is mandatory. To avoid subsequent problems with payment processing.

In the case of an MTPL policy, the commissioner’s visit is carried out on a paid basis.

There are also accident commissioner services, what are they - commercial organizations (not insurance, but related to the auto business) that provide services for registering road accidents and respecting the interests of the car owner when communicating with the traffic police.

A service agreement can be concluded in advance (by purchasing a subscription), or one-time payments can be made. A company or individual providing such services can easily be found on the Internet. Usually, the commissioner (if we are talking about network companies that have their employees in all areas) arrives within half an hour. Naturally, everything depends on the road situation.
