This issue can be clarified by simply referring to the legislative level of amendments to the Code of Administrative Offenses, and in this article we will do just that!

    The joke is that to date, since the beginning of this year, not a single fine has increased in size. And this is the only truth! But is there an increase expected from November 20, 2021? Also no. The fact is that every year there is information on the Internet about a possible increase in fees for certain traffic violations, and this year was no exception.

    Thus, among the information floating around on social networks and on some websites, the following traffic police fines are expected to increase in price (the actual tax rates are indicated in brackets):

    • for speeding 1000 rubles instead of the old fine of 500 rubles - if you exceeded by 20 to 40 kilometers per hour,
    • for a speed of more than 40 km/h from the permitted speed - 5,000 rubles (and it was 1,000-1,500),
    • for a speed over 60 km/h from the permissible limit - as much as 10,000 rubles (2000-2500 before changes),
    • for failure to give way to a pedestrian at a zebra crossing – 5,000 rubles (2,000-2,500),
    • for driving on red – the same 5000 (1000),
    • for driving in the oncoming lane – already 8000 (fine 5000 or deprivation of rights),
    • for driving a car for which a compulsory motor liability insurance contract has not been concluded - 5,000 rubles or impound lot by decision of the traffic police inspector (800 without impound lot),
    • for driving a car without a driver’s license or vehicle registration certificate – 8000 (500).

    If you believe such sources, then for the first time in the Code of Administrative Offenses, a car impound was used as an alternative to a fine. This, of course, is absurd, because the first is an additional measure of security, and the last is a measure of punishment, and they complement each other, but cannot in any way exclude each other.

    Are new fines possible without changing legislation?

    • Article 12.3 2. Driving a vehicle by a driver who does not have documents for the right to drive it, and in cases provided for by law, a waybill or shipping documents, entails a warning or the imposition of an administrative fine in the amount of five hundred rubles.
    • Article 12.9 2. Exceeding the established speed of a vehicle by more than 20, but not more than 40 kilometers per hour shall entail the imposition of an administrative fine in the amount of five hundred rubles. 3. Exceeding the established speed of a vehicle by more than 40, but not more than 60 kilometers per hour shall entail the imposition of an administrative fine in the amount of one thousand to one thousand five hundred rubles. 4. Exceeding the established speed of a vehicle by more than 60 but not more than 80 kilometers per hour entails an administrative fine in the amount of two thousand to two thousand five hundred rubles or deprivation of the right to drive vehicles for a period of four to six months.

Driving through a prohibiting traffic light signal or a traffic controller's prohibiting gesture, except for the cases provided for in Part 1 of Article 12.10 of this Code and Part 2 of this Article, entails an administrative fine in the amount of one thousand rubles. 3. Repeated commission of an administrative offense provided for in Part 1 of this article shall entail the imposition of an administrative fine in the amount of five thousand rubles or deprivation of the right to drive vehicles for a period of four to six months.
    • Article 12.12 2. Failure to comply with the requirement of the Traffic Rules to stop in front of a stop line indicated by road signs or road markings, when there is a prohibiting traffic light signal or a prohibiting gesture from a traffic controller, entails the imposition of an administrative fine in the amount of eight hundred rubles.
    • Article 12.15 4. Driving, in violation of the Traffic Rules, onto a lane intended for oncoming traffic, or onto tram tracks in the opposite direction, except for the cases provided for in Part 3 of this article, shall entail the imposition of an administrative fine in the amount of five thousand rubles or deprivation of the right to drive vehicles. for a period of four to six months.
    • Article 12.37 2. Failure by the owner of a vehicle to fulfill the obligation established by federal law to insure his civil liability, as well as driving a vehicle if such compulsory insurance is known to be absent, entails the imposition of an administrative fine in the amount of eight hundred rubles.

    Many motorists who are aware of how legislative acts are adopted sleep peacefully. They are not disturbed by news about increased fines.

If there is no valid policy, then a decision is made under Part 2 of Art. 12.37 of the Administrative Code, which provides for a fine of 800 rubles, 10 days after recording.
