The main document regulating transportation is the “Road Rules”. Traffic rules 2021 were developed taking into account the shortcomings identified in previous editions. Compliance with them reduces the risk of traffic accidents, since uniform rules appeared in 1931. Since then, they have been supplemented and republished annually.
The fine for an excess passenger is established by the Code of Administrative Offences. This normative document approves the list of administrative crimes and regulates the procedure for bringing to justice for their commission.
Important! Violating the rules for transporting passengers easily leads to serious harm to health when involved in an accident, which threatens the driver with punishment in accordance with Article 264 of the Criminal Code of Russia.
Where to see fines for overloading a truck

To track a driver's fine, you need two documents - a vehicle registration certificate and a license. Write down their numbers on the appropriate lines.
The email field must be filled in so that notifications of new fines arrive on time
State Services website. Before paying, you must register on the site and make an electronic digital signature. The signature is made by certification centers - it costs from 1000 to 6000 rubles, depending on the purpose.
Official website of the traffic police. You need to fill in the fields with the license plate number of the car and STS number. If fines are found, click “Pay fine”. Then you need to decide on the payment system - the service will warn you that it is not responsible for the result of the operation.
Number of seats in the vehicle
As stated earlier in the article, the number of seats in the car is determined by its technical characteristics, or rather, indicated in the “Body” paragraph of the PTS.
Important! Recording in the “five-seater” format does not mean that it is allowed to transport five fellow travelers in a passenger car, since this number includes the driver himself, and the maximum number of passengers is 4 people.
Most passenger cars have exactly these characteristics, but the families of many Russian residents consist of a larger number of members, and everyone needs to be transported. It is possible to transport 6 or more people in one car even if the driver only has a category B license.

You can challenge a fine if the equipment or person made a mistake:

- There is accurate data that there is no overweight - the car and cargo were weighed before shipping.
You have 10 days from the date the resolution is issued to challenge the fine - the date can be viewed when checking on the Traffic Police Fines website.

Prohibition on the carriage of unnecessary goods in traffic regulations
The transportation of people in cars is regulated by Article 22.8 of the “Road Rules”.
It states that it is prohibited to move people:
- Outside the vehicle interior, except when using a body or trailer specially equipped for these purposes.
- In quantities greater than indicated in the technical specifications of the vehicle.
Please note that some vehicles allow the carriage of people standing and no fine will be issued for transporting excess passengers if their number does not exceed that specified in the PTS.
However, paragraph 3 of Article 22 of the Traffic Regulations indicates situations in which a person must be provided with a separate seat:
- When transported in the back of a truck.
- When the bus is driving in the mountains or on an intercity route.
- When transporting children in a group.
- When conducting excursions.
Truck overload
When permission is needed. According to traffic regulations, the weight of the cargo should not exceed that provided by the car manufacturer. For example, for a truck without a trailer and with three axles, the permissible weight is 25 tons according to cargo transportation rules.
If the weight of the car or the load on one wheel axle is 2% higher than permissible or more, the carrier must issue a special permit. The permit is issued by the local branch of Rosavtodor - road management in a certain area. Validity period: no more than 3 months.
This document is needed to record heavy loads on the road. If the permit was issued by mistake or forged and an accident occurs, it will be easier to find and punish those responsible.
Danger of overload. If an accident occurs, the consequences will be more severe than with a regular Gazelle. A heavy car has a longer braking distance. Even if the driver reacts in time and tries to brake, the car will continue to coast for a long time.
The guide on checking brake systems states that at a speed of 40 km/h, a truck should stop within 20 meters. A twenty-ton truck will slow down for at least 150 meters.
The greater the mass, the greater the danger the vehicle poses and the greater the impact on the road surface.
Rules for the carriage of goods. Before sending a car on a flight, transportation organizers need to consider:
- weight of the car with cargo - it is important not to exceed the permissible values. For example, for a three-axle KamAZ, the maximum loaded weight is 25 tons;
- the number of axles, their relative position and the load on them - the greater the distance between the axles, the more evenly the load on the road is distributed. There is also less weight on each axle. Almost all modern trucks have a sensor - it shows the axle load;
- road category and time of year - in winter the soil freezes and trucks with increased weight can drive onto most roads;
- distribution of cargo in the trailer. If the load is placed "at the tail" of the trailer, a measurement error may occur - the front will be light, but the tail will be overweight;
- the presence of road signs about axle load restrictions - 6, 10 or 11.5 tons. You can find out about these signs at your nearest Road Administration department. Departments are divided according to the “road section-department” principle, for example “Moscow-Volokolamsk”. You can find the department you need in a special list.
It should also be taken into account that regional authorities are introducing a seasonal ban on the passage of heavy trucks. You can find out this in the regional department of Uprdor.

What does the fine consist of?
The penalty for transporting passengers in the cabin in excess of the norm is regulated by Article 12.23 of the Code of Administrative Offenses of the Russian Federation and is 500 rubles. The fine for overloading a passenger car with people transported outside the passenger compartment (trunk, hood, etc.) is 1,000 rubles.
Important! The amount of fines issued in accordance with Article 12.23 of the Code of Administrative Offenses does not depend on the number of passengers transported incorrectly, that is, for transporting four or five people in the back seat, the fine is the same.
Please note that the penalty for violating paragraph 8 of Article 22 of the Traffic Regulations is not limited to a fine. After all, the extra passenger carried in the rear is not wearing a seat belt, since the car simply does not have such an additional device. This means that the driver receives a punishment in accordance with Article 12.6 of the Code of Administrative Offenses, which imposes a fine of 1,000 rubles on the driver for an unfastened passenger.
Thus, the final amount of punishment could be:
- 1500 rubles for exceeding the limit of people on seats.
- 2000 rubles for incorrectly transporting passengers outside the vehicle
- 2500 rubles for transporting extra people simultaneously inside and outside the cabin.
Please note that if you are fined for having an extra person in the car, this does not mean that you can continue driving with overload; traffic police inspectors have every right to issue the order again, since the violation has not been eliminated.

To increase safety in road transport and non-compliance with traffic rules relating to passenger transportation, bill No. 902547-6 proposes to introduce additional liability for the following types of offenses:
- failure to comply with established requirements aimed at the safety of passenger transportation;
- failure to comply with special conditions of passenger transportation developed for certain groups;
- allowing drivers to drive passenger vehicles without first undergoing detailed instruction;
- carrying out transportation of passengers in violation of other rules, for example, non-compliance with the driver’s work and rest schedule.
It is recommended that traffic police officers monitor compliance with the established rules.
If this bill is adopted, the amount of administrative fines will be increased from 500 - 2,000 rubles currently in force to 1,500 - 200,000 rubles .

- instability of the vehicle. Significant overload and uneven weight distribution can cause the vehicle to roll over, especially when maneuvering, at high speed or during sharp turns;
- deformation of the vehicle and its further unsuitability for transporting passengers. Excessive load, especially on vehicles, can lead to deformation of the chassis, body and other components of vehicles, which in the future will be the reason for failure to pass technical inspection and restrictions in use;
- deterioration in the well-being of passengers when the vehicle is overfilled due to lack of oxygen. This factor is especially often reflected in young or elderly passengers and can cause serious health problems;
- difficulty moving. Overloaded vehicles, due to the impossibility of developing normal speed, cause traffic congestion and lead to a critical or emergency situation;
- if a regular bus or minibus traveling along a certain city route is overloaded, the doors of the vehicle may not close tightly, which will lead to passengers “falling out” of the vehicle and causing significant harm to health.
The driver of a vehicle overloaded with passengers may also be subject to administrative punishment in the form of a fine or deprivation of the right to drive a certain type of vehicle.
Permissible number of passengers in different modes of transport
Passengers are transported in strict accordance with rules that do not allow overload.
How to determine the number of permitted passengers on a particular type of transport?
When determining this parameter, you should consider:
- number of seats available in the cabin;
- technical characteristics of the vehicle.
The number of seating areas determines the capacity:
- passenger car;
- intercity or international bus;
- trains;
- water vessel;
- aircraft.

The passenger capacity of a railway train is determined by the capacity of a particular carriage and the number of carriages in the train.
