How to dispose of a car? Instructions and conditions for deregistration with the traffic police

Many owners of modern vehicles are interested in the question of how to dispose of a car without documents and cars. There can be many reasons for this, from the buyer’s failure to fulfill obligations to register the purchased equipment to the unwillingness to pay tax deductions for it. They contact the traffic police with a statement to perform a certain action. It is not required to provide the transport itself, no matter what condition it is in; it is enough to follow the established procedure.

Key facts about recycling

On the “drome” (car sales website) there are cars without documents, sold for pennies, often in good condition. They attract buyers, allow them to save significantly on low prices and get good equipment. But for the most part they are vehicles that were once scrapped. This is done for a variety of reasons, the main ones being:

  1. The transport was sold on the basis of a written contract, and the new owner did not register it within the time limits established by law. Often they stop maintaining contact with the seller, and the former owner is forced to fulfill all stipulated obligations.
  2. Physical wear and tear of a passenger vehicle, preventing it from being fully used due to excessive damage. In this case, it is possible to scrap the car without documents and a car, which is a big advantage, as it allows you to save money on a tow truck.
  3. Expensive repairs are required or the car is temporarily idle due to deprivation of rights. This allows you to avoid paying tax on equipment gathering dust in the garage.
  4. Benefit for purchasing a new car when you hand over your worn-out car for recycling. The program is supported at the state level and aims to clear the highways of outdated equipment that is dangerous for the driver and other road users.

Many owners are looking for options on how to dispose of cars without documents and cars, and the reasons described above are not exhaustive. Regardless of them, the procedure is strictly defined by law and everyone who applies to a government agency must comply with it. It will have its own characteristics only if the car has encumbrances or a lien.

Why is car recycling necessary?

Free legal consultation

Most citizens do not understand why car recycling is needed, and some do not trust the program at all. At the same time, many have old vehicles in the garage that are not used in any way, but they have to pay taxes on them. For some, the car recycling program is an opportunity to purchase a completely new car, and for some, it is an opportunity to get rid of unnecessary vehicles and at the same time get more money.

Disposal is an optional procedure, but there are certain situations in which it is necessary:

  1. The car is too old. When disposing of such vehicles, there are two options: the first is to scrap them and get paid for the weight, and the second is to get a good discount on the purchase of a new domestic vehicle. The discount depends on how old the car is. However, this is the essence of the recycling program: getting rid of the old and unnecessary, while purchasing new models from domestic manufacturers at a discount.
  2. A vehicle has been stolen.
  3. Emergency condition of the vehicle.
  4. Factory models are also sent for recycling if a significant defect is found in them, which can interfere with the normal movement of traffic.

It is worth noting that in 2021 some adjustments were made to the recycling program:

  • funds (subsidies) are given to the regions, and they, in turn, give the car factories compensation for purchases;
  • Both legal entities and individuals, and even leasing companies can recycle cars (but leasing companies cannot use a new one);
  • In addition to passenger cars, minibuses, buses, trucks and other vehicles are subject to recycling;
  • the list of factories that participate in the recycling program has increased (now Nissan and, of course, Lada are also involved);
  • a “Trade-in” function has been added, according to which the car is handed over not only for recycling, but also for resale (however, if in the first case the car’s age must be more than 10 years, then in the second the car’s age must not exceed 6 years).

If you use the program correctly, you can only win. But the most important thing that interests car owners is how registration takes place, what documents should be prepared and where to apply.

Features of deregistration

As a rule, it is most convenient to dispose of a car without documents and a car at a geographically nearby traffic police department. For this purpose, a certain procedure has been established that must be followed. The process is provided for by current legislation, therefore it applies to all categories of citizens. Destruction of a vehicle, as an official procedure, has the following features:

  1. The registration can be carried out by the owners of the mobile vehicle or their legal representatives, with a power of attorney issued by a notary.
  2. During the process, you must provide all available documents for the car, or explain the reason for their absence.
  3. It is not allowed to scrap a vehicle until it is deregistered with the MREO. It is better to follow the established procedure to eliminate possible problems.
  4. You can simplify the procedure by using the State Services portal. In addition to the State Traffic Inspectorate, citizens apply to any multifunctional center that is closest to their place of residence.

If the car is scrapped, then selling it on drom.ru or another similar Internet resource is considered illegal, since it is essentially a pile of scrap metal. The buyer will not be able to restore it without the participation of the seller, so this equipment is problematic and few people want to purchase it, only very inexpensively.

Public services

You can recycle your car using the State Services Portal (https://www.gosuslugi.ru/category). Select “Vehicle registration”, then “Deregistration”, “Deregistration due to disposal”.

The application is completed electronically. Enter the document data into it:

  • Russian Federation passports;
  • notarized power of attorney (for representatives);
  • vehicle passports;
  • certificate of registration or technical documentation of a motor vehicle or trailer;
  • a document certifying ownership of a vehicle or trailer.

The application should be printed out and taken to the traffic police along with the state registration plates of the car. You need to select a convenient traffic police department, date, time, and make an appointment.

Do not be late for the appointed time, otherwise you may miss the line. Do not forget to take the original documents, the details of which were indicated in the application.

After the employee checks the documents, the vehicle will be deregistered for subsequent disposal.

Required documentation package

Disposing of a car without a car at the traffic police without documents will be quite problematic. The applicant is usually required to provide the following documents:

  1. A completed application according to the established template. The form is issued at the branch itself or can be downloaded from the official resource.
  2. Passport of a citizen of the Russian Federation confirming the identity of the owner.
  3. Technical passport for the car.
  4. Registration certificate.
  5. Number, if the buyer has one.
  6. A notarized power of attorney, when carrying out activities by a representative.

After submitting the documents to the inspector, they are submitted for review. If there are no obstacles to completing the action, the car will be deregistered due to disposal. The applicant is issued a special certificate, which he can independently submit to the tax service to stop the accrual of the mandatory payment to the state treasury. The State Traffic Inspectorate itself transmits information about this within two weeks, but sometimes certain difficulties arise.

Restoring a Salvage Vehicle

There are situations when it is necessary to restore a scrapped car. For example, if the owner first arranged for disposal to avoid taxes, and then decided to sell the vehicle. Alternatively, you can sell such a car by proxy. But not every new owner is happy with this way out of the situation. Therefore, in order to successfully conclude a purchase and sale agreement, you should restore the car. It is worth noting that only the first owner, who handed over the car for recycling, can deal with all the paperwork.

First you need to prepare the documents:

  • technical passport for car maintenance;
  • vehicle owner's passport;
  • application with a request to register the car;
  • tax payment receipt;
  • car registration certificate.

application for car registration

The application must be written to the head of the traffic police. The paper should include the car's license plates, year of manufacture, body color, engine and body number.

After the application has been reviewed, the car will need to be delivered to the MREO (this can only be done using a tow truck). If all the documents are in order, the car will be entered into the database again, new license plates will be issued - and the owner will be able to use the vehicle as needed. Stages of registration

The owner himself has the right to write off the car - if there is no special clause in the power of attorney, even his representative, who has only been given the right to drive or sell the car, cannot do this. There is no automatic disposal due to high mileage; a mandatory desire and personal application of the owner to government agencies is required. The design sequence will be as follows:

  1. Come to the MREO in person or get an appointment pass through the State Services portal.
  2. Submit all available documents for consideration.
  3. Fill out the application form, indicating without errors or corrections all the data regarding the car.
  4. If there are no papers confirming ownership, you will need to write an explanatory note.
  5. Wait for the submitted application to be processed and receive a certificate of deregistration.

There is no need to deliver the old car to the site; a visual assessment by the inspector is not performed when decommissioned. This simplifies the procedure if the car is in another city or in an emergency, non-working condition. To date, payment of state duty for such actions is not provided. Only if an intermediary is involved will you need to pay for his services.

Recycling algorithm

Disposal of a vehicle means its safe destruction. Machines are made of metal, plastic, glass, and technical fluids. If you leave it and forget about it, over time, harmful substances will begin to enter the soil and atmosphere.

Recycling involves the safe recycling of vehicles. The car is disassembled by employees of a special organization, the materials are sorted and sent for further processing.

To recycle a car you must:

  1. Deregister the vehicle with the traffic police. Most scrap vehicle collection points require a certificate of deregistration of the vehicle.
  2. Drop the car off at a collection point. It is necessary to conclude a disposal agreement with the organization.

There are quite a lot of companies that deal with recycling. The service is provided free of charge. But sometimes a fee is charged for accepting a vehicle with a low mass (less than 800 kg).

To deregister a car you need the following documents:

  • Russian passport;
  • vehicle registration certificate, vehicle passport, license plates;
  • application in the prescribed form;
  • The vehicle is not provided for inspection.

Disposal conditions:

  • aging and wear and tear of the vehicle;
  • The vehicle was sold under a general power of attorney, but the new owner does not appear at the State Traffic Safety Inspectorate to re-register the car in his name (in order not to continue to pay transport tax, the seller of his car has to deal with an extreme measure - the disposal procedure);
  • car theft;
  • eliminating accidents on the roads due to the difficulty of moving an old car along them.

Remember: if your car has been deregistered by the traffic police, you no longer have the right to drive it. Transport the car only on a tow truck.

Next, you need to visit the traffic police department and get a certificate of deregistration of the car due to disposal.

Conditions for removing a car from state registration:

  • recycling according to the state program;
  • unlawful actions in relation to a car, theft;
  • if the car buyer has not registered the car and does not intend to do so;
  • leaving the country for a long time (then the owner registers the car in the country of residence).

Procedure for completing the procedure:

  • contact the traffic police in person, join the electronic queue;
  • there is no need to deliver the old car to the traffic police for inspection;
  • submit the completed application and documents;
  • The car owner is given the necessary certificate.

You can then dispose of the vehicle yourself (disassemble and sell for parts) or with the help of a private recycling company.

The conditions and cost of the service are specified in each company separately. Representatives will ask you to provide them with a certificate from the traffic police.

Sample application

Let's look at a sample of filling out an application for recycling a car at the traffic police:

  • indicate the exact name of the traffic police department where you are going to submit documents;
  • FULL NAME;
  • underline the appropriate wording of the reason for deregistration of the vehicle (in connection with disposal);
  • fill in the form from the vehicle passport with information about the make, model of the car, VIN number, state signs, year of manufacture;
  • enter the passport details of the car owner, fill out information about the owner;
  • rewrite the information about the vehicle in the required lines.

Power of attorney for disposal

A power of attorney is a necessary document for deregistering a car if the car owner cannot visit the traffic police department himself. The document must be drawn up correctly.

The power of attorney from a legal entity indicates:

  • number, date of compilation;
  • full name and address of the organization;
  • position, full name of the principal;
  • Full name, address, passport details of the authorized person;
  • the registration department of the traffic police to which you intend to apply;
  • car data (make, license plates, VIN code, year of manufacture, chassis number, body number, engine number);
  • car registration certificate, its passport;
  • validity period (valid for 1 year);
  • signature of the authorized person, principal.

A car owner who wants to scrap a vehicle can only submit a passport and a recycling application. But if for some reason he cannot carry out the procedure himself, he issues a power of attorney to his representative. Then the document is certified by a notary.

A power of attorney from an individual shall indicate:

  • place, date of compilation;
  • Full name, passport details, address of the principal and authorized representative;
  • traffic police registration office;
  • vehicle data;
  • car passport numbers and registration certificate;
  • validity period of the power of attorney;
  • signatures of the parties.

Let's look at how to scrap a car under a special program and what documents are needed.

Features of scrap without numbers and documents

Many owners are interested in how to scrap a car without documents. The lack of papers confirming ownership is quite easy to explain. The reason is sometimes that they are transferred for subsequent processing to the buyer, who, in turn, has not completed the task assigned to him. Not less often, their banal loss in a fire or during a move, theft or damage as a result of exposure to water or chemically active solutions occurs.

You can write off by performing the following steps:

  1. Come to the nearest territorial traffic police department with an application for vehicle disposal.
  2. Provide an explanation stating the reason for the loss of documents.
  3. Wait for the results of checking the information provided.

Attention! It is important not to forget to pay all penalties and possible debts; without this, you will not be able to obtain a certificate. If the reason was loss, then it will be possible to write it off faster; in case of theft, you will need to provide a document confirming this fact, for example, a resolution from law enforcement agencies.

How to return without the owner

Quite often you can hear the question “Is it possible to return a vehicle from recycling without the owner of the vehicle?” The answer is given by the norms of the procedure itself and the relevant legislation - no, such an operation cannot be carried out under any circumstances.

But the absence of an owner is not a death sentence. You can do three things:

  • Try to find the former owner of the car yourself in any way available to you;
  • Contact the traffic police with a request to find the owner of the car. You can contact any branch; a sample application to fill out will be given to you on the spot. The traffic police have 6 months to search; if it is not found, the applicant has the right to appeal to a higher authority;
  • Go to court. In order for you to be able to return a scrapped car, you will need to file a claim for assignment of ownership rights, as well as prove that the previous owner has not been found.

Also, if the owner is found, but he does not want to participate in the restoration procedure, then conflicts and problems can be avoided by issuing a special power of attorney for the right to restore the accounting. You can get it from a notary, the cost of preparation is up to 2,000 rubles. Having received this paper, you will be able to restore a car from scrap without the participation of its owner.

Scrap without the car itself

Quite often, car owners are looking for a way to write off a car for scrap without a car, since it may already be physically destroyed or is in the possession of an unscrupulous buyer. In this situation, you can use the service without presenting the vehicle itself for inspection. To do this, the applicant only needs to collect the following set of documents:

  1. Passport of a citizen of the Russian Federation or other identification document of the applicant.
  2. A completed application justifying the reason for write-off (in this situation it is “disposal”).
  3. Explanatory, explaining the owner’s lack of documents and license plates.

The downside of this action, which everyone who wants to dispose of without a car and documents needs to know about, is the cancellation of license plates. If the failed buyer uses such a vehicle in the future, then during a roadside inspection it will be confiscated and sent to a fine yard. In the future, recovery and return will take a lot of time and effort.

State vehicle replacement program

It is important to know! The application must include all information about the car without errors or typos. During the verification process, the specialist looks for the presence of debt and prohibitions on performing certain actions. After this, the car is deregistered, about which the applicant receives a corresponding certificate.

The procedure for recycling in the absence of vehicle documents and registration numbers

It happens that the documents for the car were lost, destroyed or severely damaged, but the car needs to be recycled. Restoring the documents of a non-working car in order to write it off is a pointless waste of time and money. The situation is deadlocked and unpleasant, but not critical.

If there are no appropriate documents for the vehicle, operation of the vehicle or sales transactions are prohibited.

According to information from the official website of the State Traffic Safety Inspectorate, if the owner has expressed a desire and submits a corresponding application to the department, the vehicle can be written off only if he has a passport of a citizen of the Russian Federation. The owner contacts the department, fills out an application, attaches all available documents and an explanatory note. The explanatory note indicates the reason for the absence of missing documents.

After checks, the department will confirm or deny the fact of ownership. Since copies of all documents were submitted when registering a car, information about the car and its owner is in the database. All documents for the car and its license plates are handed over if available.

Using the State Services portal

You can fill out an application form and send your idle vehicle for recycling without even leaving your home. The owner needs to register on the State Services portal. On the website, in the category for transport, select the “Vehicle Registration” menu, and in it there is an item about deregistering the car for further disposal. Next, select “Electronic format” and “Get a service”.

If everything is done correctly, an application form will appear to fill out. The application forms that are issued at the State Traffic Inspectorate office and on the State Services portal are the same. After filling out the application, select a branch and a convenient day and time for submitting documents.

Important! The completed electronic application form must first be printed for submission with the rest of the package of documents.

You must be at the branch at the specified time and submit an application out of turn with the documents that the owner has. The information is saved in your personal account on the State Services portal.

Disposal methods

You can get rid of your old car in different ways - hand it over as regular scrap metal or use the government program.
If you dispose of a car according to the first scenario, the benefit to its owner will depend on the tariffs of the collection point, according to which the cost will be calculated taking into account the weight of the vehicle. This method is suitable for very old cars that have not been fully preserved or have already been deregistered with the traffic police. If the car is registered with the state, then it can only be handed over to a recycling center that issues a certificate (act) of its actual disposal. Without this document, it will not be possible to deregister the vehicle from July 10, 2017. As a rule, such recycling points do not give money for a returned vehicle. Often these companies even offer free transportation of your old car.

A fairly profitable option to get rid of your old car is to participate in the state recycling program. Especially if you are going to buy new. In this case, you will receive a certificate for a discount from 20 to 350 thousand rubles for the purchase of a new vehicle, the size of which will depend on its category, make and model. It can be used not only to pay part of the cost of a new car, but also when applying for a car loan.

How not to buy junk

A truck is accepted for recycling in the same manner as a passenger car. The only difference is the amount of compensation under the certificate. The amount of the discount that can be received today when purchasing a new truck under the recycling program ranges from 90 to 350,000 rubles.

The program includes any trucks - from light-duty to heavy-duty models, including those equipped with special equipment and commercial ones.

The state program for recycling old vehicles can be used not only by individuals, but also by legal entities. The conditions are the same for everyone, with the exception of paying a recycling fee. A higher rate is provided for companies. Consequently, the price of recycling cars imported from other countries for legal entities will be significantly higher.

Car thieves are trying to sell the car as soon as possible. After the real owner’s application for disposal or deregistration, the sale and operation of the car officially becomes impossible. Any car must be checked for recycling upon purchase. Otherwise, when you try to register your car with the traffic police, you will be in for an unpleasant surprise. The car is simply confiscated. If the car is reported stolen, it is placed in the parking lot and a notification is sent to the owner.

Check the seller's documents, they must match the registration documents of the car owner. Do not buy a car second-hand if the seller is in too much of a hurry, assures you that he has a line of buyers, is ready to provide a huge discount on the car, but only if you buy it immediately, you risk losing money and getting into serious problems with law enforcement agencies.

What kind of car can I rent out?

Anything that is outdated, faulty, or its restoration and maintenance will cost more than a modest remuneration when it is sold or scrapped.

Typically, vehicles over 20 years old, as well as cars damaged in an accident that cannot be restored, are handed over for recycling. It is also possible to hand over dismantled vehicles, but in this case it will not always be possible to receive a discount on recycling under the state program.

What can and cannot be recycled

Recycling to get a discount when buying a new car

Since 2010, the car recycling program has gained increased popularity, under which citizens who scrapped their old car received a substantial discount of 50 to 110 thousand rubles on the purchase of a new domestically produced or assembled car.

Officially, at the moment, the document for this program is not valid, however, a number of car dealers still provide a discount when scrapping an old car through dealerships or specialized centers. However, not every car can be traded in under this program to receive a discount - the car must meet a number of requirements. You can write off a car simply so that it is not registered as a citizen in any condition.

Recycling a car to get a discount

Basic conditions for recycling an old car to receive a discount:

  • the owner of the car is a citizen of the Russian Federation, and the car has been owned for at least a year;
  • the vehicle is at least 10 years old and the total weight cannot exceed 3.5 tons;
  • all documents are in perfect order, there is a title, there are no discrepancies in unit numbers;
  • the vehicle meets the technical condition requirements that apply when handing over a vehicle for recycling.

What are the technical requirements for the car?

To hand over an old vehicle under the recycling program, it is not at all necessary that the car be able to move independently. There are also no requirements for its good condition, but the car must have all the main components and assemblies, including:

  • engine;
  • transmission,
  • glazing and body elements,
  • dashboard;
  • battery and electrical equipment;
  • wheels;
  • technical fluids.

Such requirements are established mainly by dealers in order to avoid formal disposal of auto junk, consisting of a body frame and a pair of wheels. But the program itself does not resolve the issues of completing the scrapped vehicle.
