In Moscow, not only traffic police inspectors can issue fines to drivers for traffic violations. There is also a MADI in the capital. To more fully understand the purpose of this structure, it is necessary to study the scope of its activities, powers and violations for which employees of the organization can issue a fine. All these issues will be discussed in detail in the article.

What is MADI?

The abbreviation MADI stands for Moscow Administrative Road Inspectorate. This organization was founded in 2013 to expand the capabilities of recording and suppressing violations of parking rules and the requirements of road signs or markings by the capital's executive authorities. MADI operates only in Moscow.

The organization operates in accordance with established regulations. In particular, the responsibilities and powers of this structure are outlined in the “Regulations on the Moscow Administrative Road Inspectorate” No. 679-PP, adopted on October 14, 2013.

According to this document, MADI is a government agency designed to identify vehicle parking violations. If the actions of drivers do not comply with traffic regulations, the structure has the right to impose punishment in the form of an administrative fine. In some cases, collection may be accompanied by towing of the car.

Methods for checking and paying fines

In order to check whether a driver has unpaid MADI fines, there are several ways. You can visit the nearest branch of this structure and personally clarify the information you are interested in.

Checking MADI fines using online resources is the most convenient and less time-consuming option to find out the necessary information. You can use:

  • MADI official website;
  • portal "State Services";
  • traffic police website;
  • page of the mayor of Moscow;
  • portal "Autocode".

Smartphone users can install the Moscow Parking application on their device, which allows them to detect collections and pay for them.

Why does MADI impose fines?

MADI imposes fines for non-compliance with parking or stopping rules in Moscow and some other offenses. The most common penalties are:

  • for stopping under signs 3.27 and 3.28 (“Stopping is prohibited”, “Parking is prohibited”) located on public roads;
  • for failure to comply with the requirements for the transportation of passengers and luggage by passenger taxis;
  • for parking on the lawn;
  • for violating the rules for loading/unloading goods at night in residential areas.

MADI employees are provided with official cars and the necessary technical equipment to perform their duties.

I received an official letter, but no photo - is it legal?

It is the mailing of a copy of the resolution, which comes to you by registered mail (in practice, often simple - to the mailbox) that is the official notification of the new fine.

But let’s be honest: if you received a resolution from a camera in an official paper letter without photographs, then this is a very rare situation. Make sure once again that this is indeed a decree on auto-fixation, and not a regular one sent to you by mail, issued in the traffic police office, or that this is not a protocol at all. And the photo in the fine from the camera is required by law.

Let us once again explain the logical chain of legislation for 2021.

All decisions sent to the driver regarding automatic fixation must necessarily include materials obtained using this method.

Code of Administrative Offenses of the Russian Federation Article 28.6.

Copies of the resolution in the case of an administrative offense and materials obtained using special technical means operating automatically are sent to the person against whom the case of an administrative offense has been initiated by registered mail in the form of a copy of the resolution on paper...

The fact that such indications must contain a photo is already indicated in GOST R 57144-2016 “Special technical means operating in automatic mode. General technical requirements".

For speeding, running red lights, stop lines and other immediate violations of the Rules, the following rule applies:

At least 2 consecutive photographic images of a vehicle in the control zone with an interval of at least 0.1 s, which record the moments of the commission of an administrative offense by the driver of this vehicle, with a fully recognized state registration plate.

For parking violations:

A photograph showing a vehicle stopped in a place where parking or stopping is prohibited.

A photograph showing a vehicle stopped in a place where parking is prohibited, more than 5 minutes after the first detection or the time interval indicated on road sign 8.9, but not more than 1 day.

But there is an important subtlety - the GOST indicated and cited above is not binding, but only advisory. But this changes practically nothing - the instructions for each device contain similar instructions, and they must be followed when installing cameras.

How to determine the structure that imposed the fine

There are many organizations in Moscow that are authorized to issue fines for non-compliance with traffic rules. In this regard, drivers often do not understand where to go when imposing a penalty. The answer to this question can be found in the executive document itself.

To do this, you need to study the UIN (unique identification number) of the resolution. Using this code, you can clarify the status of the penalty, the date it was assigned, as well as the organization that recorded the violation.

  • If the resolution number consists of 20 digits and begins with the combination 782, then the fine is imposed by MADI.
  • Also, decisions of this structure may have a 25-digit number starting with 03560430.
  • If the UIN begins with the numbers 780, then the collection was ordered by the AMPP service.
  • A number starting with combination 188 indicates a traffic police fine.

What to do?

If you have not yet received an official copy of the resolution, and you saw a traffic police fine without a photo on any service, then you need to wait for the paper letter.

If the paper copy does not contain photographic materials, then it is illegal. But, as we indicated above, there were practically no such cases.

In the latter case, the fine is subject to appeal. But at the same time, formally request photographic materials from TsAFAP, MADI or another body that issued this decision. Perhaps you will receive an answer that there are none. Or they will send you materials, and then there will be no point in challenging the fine.

In any case, before responding to your request, file a complaint against the decision, since while waiting for a response you may miss the appeal period, which on May 24, 2021 is only 10 days from the date of receipt of a copy of the decision.

Appealing a punishment without a photo

The grounds for appeal are exactly the same as those indicated above in the form of references to legislation, and the sequence of arguments in the complaint should be as follows:

  1. photographic material is required, according to the instructions for the measuring instrument (it is highly advisable to find such instructions on the Internet and quote the paragraph on the availability of photos) and according to paragraph 5.6.1 of GOST R 57144-2016,
  2. the materials must be sent to the person in respect of whom the decision was made, on the basis of Article 28.6 of the Code of Administrative Offences,
  3. evidence of an offense, based on the above, was obtained illegally, and within the meaning of Part 3 of Article 26.2 of the Code, such evidence cannot be used,
  4. Part 2 of Article 1.5 indicates that a person is considered innocent until his guilt is proven in the manner prescribed by law.

Arbitrage practice

But the point is also that the judge can evaluate evidence based on personal beliefs, giving it a certain weight subjectively. And if, for example, the decree with a fine does not contain only a photo, but contains an address with the coordinates of the offense and other data, then the complaint may be refused.

However, in judicial practice, neither in 2021 nor previously, there have been cases of attempting to challenge a fine that does not contain a photo of the car. There are only decisions and resolutions with low-quality photographs or unrecognized vehicle license plates on them.

For example, in one of the decisions of the Kostroma court, the person considering the case did not take into account the fact that the Cordon auto-fixation tool provided for 2 photos, but only one was taken.

In accordance with Part 4.2.2 of the “Regulations on the Moscow Administrative Road Inspectorate”, MADI employees are authorized to impose fines for non-compliance with the norms of the Code of Administrative Offenses of the Russian Federation or the Code of Administrative Offenses of the city of Moscow. MADI fines imposed for violations of the Code of Administrative Offenses of the Russian Federation can be paid with a 50% discount. To do this, you must make a payment before the expiration of 20 days from the date of drawing up the resolution. Penalties imposed by MADI for violation of the requirements of the Code of Administrative Offenses of the MSK are not subject to repayment at a discount. They must be paid in full.

If, upon recording a violation, the MADI inspector decided to assign the car to impound parking, then the owner’s first step to return the vehicle should be to call the help desk at +7. The operator will provide the address where the evacuated vehicle is located, and will also provide a list of documents that will be required to return it.

As a rule, MADI takes the violator’s vehicle to one of the AMPP parking lots located at the following addresses:

Appeal procedure

In case of disagreement with the penalty imposed by MADI, the motorist can appeal the fine within 10 days from the date of registration of the decision. To confirm that you are right, it is recommended to obtain evidence of the legality of your actions. The most compelling arguments are photo or video materials.

A decision on an administrative offense can be appealed directly to the structure that imposed the punishment, or in court. The motorist can independently determine the most suitable option for himself. To do this, you need to file a complaint against the actions of MADI employees and express your disagreement with the imposed fine. You will need to attach the available evidence of your case to the complaint and personally transfer the materials to the selected structure.

It is also possible to appeal MADI fines via the Internet. To do this, you will need to use one of the available Internet resources, for example, the Autocode portal. After authorization in the system, the driver must go to the “Appeals” section and select the “Appeal MADI fine” menu item.

Next you will need to indicate the resolution number. After discovering a fine, you must indicate the reason for the appeal, attach the available evidence, provide personal information and send the appeal. The applicant will be notified by email of the outcome of the case.

How to appeal a MADI fine

The surest way to appeal an administrative offense is to go to court. In addition, the motorist can challenge the decision directly to MADI. To do this, you can use the Autocode website by filing a complaint online. To increase the chances of success, the driver must support his words with documentation, for example, by attaching photographic materials to the application. Sometimes fines are formed by mistake, and by correctly arguing his position, a motorist can challenge such a decision. It should be understood that systemic failures in the functioning of MADI are not uncommon.

If everything remains unchanged, you will have to go to court. The claim will be accepted only if the applicant can provide documentary evidence. Unfounded statements remain without consideration.
