Fine for riding without a helmet on a scooter or motorcycle

How much is the fine

According to traffic rules, the driver is required to wear a helmet when driving a motorcycle, moped and other motorized equipment. The helmet must be fastened. This requirement also applies to the passenger - the driver does not have the right to transport him without a fastened helmet.

The fine for driving a motorcycle without a helmet is 1,000 rubles. A motorcyclist may be given the following fine for any of the following violations:

  • driving without a helmet or with an unfastened helmet,
  • transporting a passenger who does not have a helmet or whose helmet is not fastened.

This is stated in Art. 12.6 Code of Administrative Offences. This fine for violations has been in effect since June 2015; before that it was half as much.

If the driver and his passenger are not wearing a helmet, only one fine will be issued. For violation of one article of the Code of Administrative Offences, the law prohibits punishment twice.

If a minor is driving, the fine will be paid by the parents according to the law. At the same time, until the age of 18, you can only drive a moped, otherwise the child will be fined for driving without a license; read more about this in the article on driving a motorcycle without a license.

Do drivers really need a helmet?

Typically, drivers do not plan to wear a helmet when driving. Often, this may even be due to the fact that a person does not have the necessary funds to purchase all the necessary equipment. But its absence immediately calls into question the safety of the scooter rider, because in the event of a possible accident, it is its absence that becomes the cause of death.

Moreover, according to the Traffic Regulations and the Administrative Code, a person may even receive a fine for driving without a helmet. This is stated in two articles that provide for a fine:

1. According to Article 24.9 of the Traffic Regulations, driving a power-driven vehicle (which includes scooters) without the necessary protective elements (helmet) is prohibited.

2. In addition, according to Article 12.6 of the Code of the Russian Federation on Administrative Violations, it is regulated to punish road users who travel without any seat belts on vehicles or protective helmets on motor vehicles.

  • for serious harm to the health of a passenger - restriction of freedom for up to 3 years, forced labor for up to 2 years, arrest for up to 6 months, imprisonment for up to 2 years;

Some people believe that 2 fines will be issued at once, but this is not the case. The official will draw up one protocol, after which the driver will have to pay 1000 rubles. Today, the Code prohibits issuing two fines for the same violation. If a citizen under the age of 18 is driving a motorcycle or moped, the fine for him will be paid by his legal representatives. Note that until adulthood, a person can only drive a moped. Otherwise, you may receive another large fine for driving without a driver's license.

However, among the worst consequences can be not only a fine, but also the risk of serious injury. Over 6 years, the number of drivers who did not use a helmet increased from 18% to 40%. Perhaps there would be many fewer deaths on the road if people learned to follow the established rules. The driver can be punished under Article 264 of the Criminal Code of the Russian Federation if the passenger was not wearing a helmet and was injured or died as a result of an accident. If a motorcyclist without a helmet gets into an accident

Unfortunately, in addition to the obvious consequences of an accident, the driver of a motorcycle or scooter may face criminal liability. The fact is that according to the law, if an accident occurs, then the culprit is the one who violated the traffic rules. Therefore, if the “racer” is used to driving without a helmet, then by default he will be the only one or one of the culprits of the road accident.

Even taking into account the fact that the driver of the vehicle also violated traffic rules, this does not relieve the motorcyclist of responsibility. In this case, according to Article 264 of the Criminal Code, the owner of the motorcycle may suffer a more severe punishment. According to the Criminal Code of the Russian Federation, he can even go to prison for up to 2 years.

If, as a result of an accident, a motorcycle passenger was injured, then, according to Article 1079 of the Civil Code, the driver of the “bike” is also responsible for this, since he is well aware of the dangers of moving on the road surface without a protective helmet. Therefore, he is obliged to control the actions of passengers and prohibit them from getting on the “bike” without the appropriate “uniform”.

general information

The circumstances and amount of the fine for a helmet are regulated by the Administrative Code and the Traffic Rules. In them you can find two articles that prescribe the details of such an offense - 24.9 of the Traffic Regulations, which prohibits riding bicycles, mopeds, motorcycles without a fastened helmet, and 12.6 of the Administrative Code of the Russian Federation, which implies types of punishment for not wearing a seat belt and riding without a protective helmet on a motor vehicle.

The State Duma established a number of amendments to Article 12.6. Based on them, in 2021, if this rule is violated, traffic police officers draw up a protocol and a receipt for payment of a fine for riding a moped without a helmet, the amount of which is 1000 rubles. Since the adoption of the law (June 19, 2015), it has doubled.

Driving without a helmet is one of the most common offenses

Traffic police inspectors may impose a fine in the following cases:

  • When driving without a helmet at all;
  • When wearing a helmet that does not have the fastening strap fastened.

The possibility of paying a fine without a helmet on a scooter also applies not only to the driver himself, but also to his passengers, who must also wear a helmet. Article 12.29 part 1 of the Code of Administrative Offenses of Russia prescribes the cost of collection at five hundred rubles.

Note! The lack of protective helmets does not give the right, in the event of an accident due to the fault of another driver, to hold him accountable under Article 264 of the Criminal Code of the Russian Federation.

A motorcycle passenger risks his health, because the driver - be it a motorcyclist or a scooter rider - takes responsibility for it. If a passenger is injured during a traffic accident, Article 1079 of the Civil Code of the Russian Federation comes into force, according to which it is necessary to compensate for the damage.

Even ignoring the possibility of an accident, there are a lot of small stones, debris, and dust on the road that will definitely fly into your face and eyes, which can be quite traumatic.
