What is the new law about the “Disabled” sign?

This is not the law. That's an order. Its official name is “On approval of the Procedure for issuing the identification badge “Disabled” for individual use.” Number 443N. This order was developed on August 24, 2021 and came into force on September 4 of the same year. The regulatory act appeared against the backdrop of changes in the Federal Law “On Social Protection of Disabled Persons,” which also underwent changes.

The full official text of Order No. 443-N, current for 2021, is given below, and now we will explain what’s new with the entry into force of this legal act.

Who can receive the badge?

Disabled people of groups I and II, as well as, in some cases, disabled people of group III with a confirmed disability can hang a corresponding sign on their car.

If a disabled person does not have a car

In this case, he can still receive a badge - the Order does not link the receipt of this identification badge to a specific vehicle, but only to a specific person.

In this case, the person can simply carry it with him and hang it on any car that transports it. The order, of course, takes into account the subtlety when the “Disabled Person” sign can be equipped not only with a car belonging to this person, but also with any car transporting a disabled person (clause 1 of the document). This is especially true, for example, for disabled children.

Who is eligible for installation?

Not all categories of persons recognized as disabled have the right to install. If disability group 1 or 2 is registered, the person can install the appropriate sign on the car. Persons transporting disabled people and parents of children with disabilities also have this right.

It is worth paying attention that the person driving the car where the sign in question is installed must have the following documents:

• insurance policy;
• certificate confirming the registration of the car;
• documentation confirming the limitation of capabilities.

The rules regarding driving a car by persons with disabilities are enshrined in law. It is stated which vehicles are not affected by certain road signs.

Government Resolution No. 1990 indicates who has the right to install the sign in question. The act defines the conditions relating to the transportation of citizens recognized as disabled.

Which disability groups can drive a vehicle?

According to legal regulations, all persons with disabilities can drive a car. However, it is worth making a reservation that a list of diseases has been established, in the presence of which a person is deprived of the ability to drive a car. These diseases are associated with mental disorders, vision problems, etc.

Before a person is allowed to drive a car, he needs to undergo an examination at a medical organization, based on the results of which it can be concluded that he can drive.

When a person has a driver's license and has received the necessary certificate from a doctor, he can drive a car, regardless of the disability group.

According to the legal norms in force in Russia, the appearance of the sign installed on the cars of people with disabilities is described. Decree No. 1990 indicates which category of persons can install the sign in question on a car.

No special sign has been developed for children recognized as disabled. Law enforcement officials, if there is a minor in the car, recommend installing a “Child in the car” sign.

Special signs are attached to the car while it is being driven by a disabled person.

Technical parameters of the sticker

It is made in the shape of a square with dimensions of 15 by 15 cm. The background is painted yellow, where the figure of the Wheelchairman is depicted in color.

Where is it issued?

In the Russian Federation, the type of sign in question is not issued by traffic police officers. This means that a person has the opportunity to purchase a sticker for a car or make it themselves. Stickers are available for free sale; they can be purchased at any auto store; they can also be sold in supermarkets and other retail outlets.

You do not need permission to purchase. The cost of the sticker varies depending on the region of purchase, on average the amount is 100 rubles.

How to install correctly

The basic provisions for permission to operate a machine state that the plate must be located on the glass located at the front or rear. There is no specific location where the sign should be located.

Attention! Installing a sign is the right, but not the responsibility of the motorist. If there is no sign, the person will not be held accountable.

It must be placed in such a way as not to interfere with the driver. The Code of Administrative Offenses of the Russian Federation provides for punishment for those motorists who installed stickers on the front window in violation of the norms. The optimal places are:

• upper/lower corner of the rear window on the left;
• upper corner of the front window (to the right of the driver).

Regarding rear windows, specific instructions for sticking signs have not been developed, which means that they can be placed at the discretion of the driver. The main condition is that they do not block the view and other motorists can notice them from afar.

Types of yellow plates established by traffic regulations

The traffic rules provide for two types of signs that have a yellow background:

• "Deaf Driver";
• a sign that applies to persons with disabilities.

The latest type of plates is round in shape. According to the rules, the diameter of the circle should be 16 centimeters.

The legislator made adjustments in 2021, according to which the absence of a sign indicating that a deaf person is driving will result in a fine of 500 rubles.

In a special institution called the “Bureau of Medical and Social Expertise” (hereinafter referred to as the ITU Bureau). The institution itself is presented in the form of 3 specific organizations:

1. branches of the bureau in regions and cities, where on May 21, 2021 you can receive the identification badge “Disabled” in normal situations and where you should contact first,
2. the main bureau - contact here when appealing decisions by branches and if additional examinations are required,
3. Federal Bureau - here you can get a “Disabled Person” badge if you need to appeal the decision of the main branch of the institution, or in particularly difficult cases of establishing disability.

You can receive the badge at your place of residence - that is, at any branch, regardless of the place of registration.

How to get a?

To do this, as we mentioned above, you need to contact any branch of the ITU Bureau with a written application. The application contains all the standard information - from the full name of the disabled person and his residential address to the insurance policy number.

Also, when applying, a disabled person will need:

• passport or birth certificate,
• certificate of disability.

After submitting the application, a sign is produced and issued, according to the regulations, no more than within one month. But it also takes time to register the application itself.

What does the new “Disabled” sign look like?

Just like the old one, but with a number of changes. So, now the sign is written in handwriting on the front side:

• sign number,
• the date of expiration of the disability,
• region of issue.

And on the back:

• Full name of the disabled person to whom the badge was issued,
• date of birth,
• disability certificate number,
• group,
• period of disability,
• date of issue of the sign.

Communication with inspectors

To use the benefits of disabled drivers, a citizen must confirm his right to belong to this narrow category of beneficiaries. Moreover, you need to be ready to confirm this at any time while driving, since at any moment the car can be stopped by traffic police officers.

There are some peculiarities. Thus, the traffic rules do not provide specifics regarding what documents should be provided by a disabled driver for inspection by an inspector.

Therefore, experts point out that when resolving this issue, one should be guided by the section in the traffic rules, which outlines the main responsibilities of the driver:

1. If there is a sticker on the car indicating that a person with disabilities is driving, the inspector may require documentary evidence of the disability.
2. If a disabled person drives a vehicle himself, he must have the appropriate medical documents with him.
3. If a disabled person is a passenger, he must also have appropriate medical documents.

Having doubts about the authenticity of the submitted documents, the inspector exercises the right:

• check documents if there is information about a violation or illegal use of them;
• the inspector can make a corresponding request to the medical institution that issued the documents.

Modern driver's licenses do not include a clause indicating a person's disability. After passing the medical and social examination, the corresponding decision of the commission and a certificate are issued. They can be shown to inspectors.

The main document for benefits today is considered to be a pension certificate. If there is an existing disability group, a corresponding mark is placed there, according to which the pension will subsequently be established and assigned.

Inadmissibility of using a mark without supporting documents

Unfortunately, not only real disabled people get behind the wheel, but also scammers who unlawfully use this sticker to receive benefits. Any auto store offers to purchase this sign to any person without specifying its status. Sellers simply do not realize that additional benefits are provided only to disabled people, which means that the use of the mark by other persons is impossible and illegal.

By law, a driver does not have the right to affix a sticker if he is not disabled and does not carry one on his vehicle. For violating this rule, a fine may be imposed on the driver. To avoid a crime, you need to be careful about what signs you put on your car.

Traffic police officers carry out special checks and raids on permitted signs. For illegal installation of a sign, the violator will be held administratively liable. A protocol is written against him and a fine is issued for payment. The decision to prosecute can be appealed to the relevant authorities. But it makes sense to appeal the inspector’s actions only if the driver has documents confirming his disability group.

What are the risks of illegal use?

Those who installed the plate in question on the car without any reason to do so face liability. The Code of Administrative Offenses of the Russian Federation contains three articles that are applicable in the situation under consideration:

1. Article 12.5 provides for penalties in the amount of 5 thousand rubles for a driver driving a car on which a sign is illegally installed. The sticker is removed.
2. Article 12.4 provides for liability for those who unlawfully installed the sign in question. The amount of punishment varies depending on the subject of the offense. Citizens will pay within 5 thousand rubles, legal entities - within 500 thousand, officials - 20 thousand. The sign will be removed.
3. Article 12.9 deals with cases of violation of the rules regarding parking and stopping in places intended for people with disabilities. The fine is 5,000 rubles.

Fines for violation

If the inspector reveals the unlawful use of the “Disabled Person” sign, the driver will be held accountable, in accordance with clause 2 of Article 12.4 of the Code of Administrative Offenses of the Russian Federation. The driver will be fined.

However, its size depends on the driver’s status:

1. An individual faces a fine of 5 thousand rubles.
2. For an official - 25 thousand rubles.
3. For a legal entity – 500 thousand rubles.

In this case, the sticker is confiscated by traffic police officers. As a result, the offender cannot reuse the sticker unless he buys a new one.

As for parking, the driver who parked the car in a parking space for disabled people is also subject to administrative liability. This is considered illegal parking, because in a place where only disabled people have the right to park, parking of other road users is prohibited. In this case, penalties will also be imposed on the driver, but in accordance with clause 2 of Article 12.19 of the Code of Administrative Offenses of the Russian Federation. Thus, a driver who commits a violation will have to pay a fine of 5 thousand rubles.

It should be noted that the system for monitoring and recording violations is not fully debugged. Photography and video recording devices do not recognize front signs, and verifying the fact of illegal parking in the absence of a driver nearby is also an almost impossible task.

If a disabled person has been fined, but the fact of holding them accountable is illegal, then you should take the necessary documents with you and apply to challenge the fine at the address indicated on the form.

If you lose your sign

Nothing will happen. The current legislation for 2021 does not provide for a penalty for loss. In this case, the bereaved person should contact the ITU Bureau for a duplicate of the “Disabled Person” sign. Then, in the corner of the new sign, replacing the lost one, the signature “Duplicate” is placed, and the old one is declared invalid.

Also, a new sign will have to be obtained if the disabled person changes his place of residence.
