Information about the introduction of electronic PTS appeared back in 2015. However, there was a hitch in bringing the project to life. Differences between an electronic PTS and a paper one

The electronic car passport in 2021 differs from the classic version. First of all, the document includes significantly more information. It is impossible to lose your updated passport. Deadlines and requirements for the transition to electronic PTS

It was originally planned that the final transition to electronic PTS would take place on November 1, 2021. The Ministry of Industry and Trade of the Russian Federation gave the task to develop and implement an electronic passport. Access to it will be provided to employees of authorized bodies and vehicle owners. Car passports on paper will gradually be eliminated from circulation. This is done in order to eliminate the need to go through the process of restoring lost PTS.

However, it was subsequently decided to extend the deadline for the transition to an electronic version of the document. The decision of the EEC Board No. 122 dated December 29, 2015 was amended. In accordance with it, the period for issuing classic passports was extended until November 1, 2020. In this case, an electronic version of the document will also be issued. The reason for this decision was the need to provide the EAEU states with the opportunity to complete the creation and implementation of appropriate systems.

At the same time, the business community still does not have a clear understanding of how to fill out all the required fields of an electronic passport. Thus, Mitsubishi representatives report that their organization plans to preserve the paper version of the PTS for as long as is legally possible. The Chery car company plans to adhere to a similar rule, but will gradually switch to digital documents. Audi representatives report that their organization will adhere to the established rules. Nissan and Volkswagen switched to electronic PTS.

It is noteworthy that the deadline is postponed for the third time. It was initially assumed that the introduction of electronic passports would take place on July 1, 2021. However, at that time, Russian organizations asked to postpone the launch of the system. The reason for this decision was the varying degrees of readiness and financial problems that arose as a result of the recession in the car market.

Other things to remember

It should be remembered that disputes can drag on, which means you must be prepared to go to the last resort. Decisions can be appealed several times in different instances, so the first decision will not be final. Even if you lost in the district, this does not mean that it will continue to be so. What does EPTS look like?

Electronic PTS is a record in the database containing information about the car. After reading it, you can find out:

  • information about the owners;
  • other important information.

In 2021, access to electronic PTS information is provided only to the current owner of the car and representatives of regulatory authorities. All other persons also have the right to submit a request, but they will only be able to find out about the status of the document. He can be:

  • active;
  • disposed of as a result of the vehicle being declared unfit for further use;
  • being in the process of registration;
  • canceled - the car is located outside the territory of the Union countries or did not go through the customs procedure upon entry;
  • extinguished (the status is assigned if the vehicle structure has been altered).

Previously, owners received paper PTS. They contained limited information about the car. Access to complete information was provided to employees of the Federal Tax Service, Social Insurance Fund, police and a number of other organizations. The insurance company also had the right to receive information during the process of issuing a policy. With the introduction of electronic vehicle passports, information will become available to the car owner.

Where and how can I get acquainted with the electronic PTS?

For the convenience of users, an electronic passport system was created in 2021. It is a site through which you can search for information. To do this, you need to visit the resource and click on the login button. Two windows will appear in front of the user. One of them is for requesting the status of an electronic passport. The procedure can be carried out by its number or by Vin.

The second window is for requesting an extract. To receive information, a person will have to indicate the electronic PTS number and enter the code from the picture.

When is it necessary to apply?

The process of replacing and issuing vehicle passports will be regulated by the Procedure for the functioning of the electronic PTS system. The norm was approved by decision of the EEC Board No. 122 of September 22, 2015. Car owners will be able to independently decide when to switch from the old form of document to the new one. A paper passport is considered valid until it is possible to add new registration records or other changes to it.

A car owner can have only one title. Upon receipt of an electronic document, the paper form is invalid.

In 2021, the first EPTS will be issued for new cars. The preparation of documentation is carried out by Electronic Passport OJSC and the car plant where the car is produced. One institution will be responsible for replacing existing paper PTS and completing the necessary documentation for a car imported through customs.

How to get an electronic PTS?

Gradually, electronic PTS will completely replace the classic paper form. In 2021, residents of the Russian Federation can obtain documents in the following situations:

  1. A car is being imported from abroad. In this situation, you will need to contact any authorized organization that has the rights to provide such documentation from the Ministry of Industry and Trade of the Russian Federation.
  2. The classic document is worn out, lost, or the space for entering information about the new owners of the car has run out. The citizen will have to submit a preliminary request to the authorized organization.
  3. A new car is purchased. The passport data is included in the purchase and sale agreement. During the registration and registration procedure, traffic police representatives will use the necessary information from the EPTS database.

The passport replacement process is regulated by EEC decision No. 122 of September 22, 2015. To take action, the owner of the car must prepare an application and contact the traffic police. The registration of EPTS is carried out by Electronic Passport OJSC. The updated document will be provided within 24 hours. The owner of the vehicle can receive a statement.

On what basis can compensation be claimed?

Article 456 of the Civil Code of the Russian Federation protects buyers from enterprising sellers. It states that when transferring the goods to the buyer, the seller must also transfer all documents for this product . There is also Article 23.1 of the Law “On the Protection of Consumer Rights”, which protects the interests of buyers.

Let us note once again that most often car owners wait patiently and patiently call car dealerships, listening to regular breakfasts. However, there are people who may suffer financial losses due to the inability to use a vehicle or simply panic, suspecting that they have become a victim of fraud. There is a fair desire to protect your rights in court and compensate for losses.

Buying a car at a car dealership is formalized by concluding a sales contract. According to the agreement, all documents are transferred; without them, the car cannot be registered, that is, it cannot be driven. If the car was sold from a showroom without a title, then this can be legally recognized as a product transferred with defects. Because the seller did not fulfill his obligations under the purchase and sale agreement. For this, compensation may be awarded under the Law “On Protection of Consumer Rights”. All this will have to be proven in court.

That is, for the fact that the salon does not give out PTS according to the law “On the Protection of Consumer Rights”, Art. 23.1 with reference to Art. 451 of the Civil Code must pay a penalty of 0.5%. It is determined by the price of the car and by day, and gradually the penalty increases to 50% and a separate case for compensation for damage is initiated.

There is no need to demand exorbitant amounts; the institution of compensation for moral damage is not developed in Russia. For 3-4 months (most often this is the maximum), moral damages can be estimated at 200-300 thousand rubles.

Registration of purchase and sale of a car with an electronic title

The transition to a new form of passports raises a number of questions. First of all, difficulties arise when completing purchase and sale transactions with an electronic vehicle title.

To change information about the owner of a car, you will first have to conclude a purchase and sale agreement. The document must be formatted correctly. The paper must contain the following information:

  • place of conclusion of the transaction and its date;
  • information about the person selling the car;
  • information about the person purchasing the car;
  • information about the car;
  • information about PTS (indicated on the basis of the extract);
  • car cost;
  • signature of the seller and buyer;
  • telephone for communication.

Next, you need to use the State Services platform, through which you can log in to the SEP. Registration of a vehicle with an electronic title through State Services is possible only if both parties to the transaction have personal accounts on the portal. The seller is obliged to add the new, now owner, to the electronic PTS. He receives a corresponding notification in the SEP system and confirms the action. A new entry is entered into the EPTS, and the date of the procedure is displayed with minute accuracy.

You must contact the traffic police and a representative of the organization with the prepared documents. The citizen will have to pay a fee. In 2021, 250 rubles will be charged for updating information about the owner. The payment has yet to be confirmed. For this purpose, a check is attached to the contract. So far, the amount of the duty appears only in Government Resolution No. 1212. No changes have been made to the tax code. Additionally, you may need to fill out an application.

Having received the documentation, a representative of the authorized body will check it, and the provided documentation will be checked for correctness. If there are no errors, the papers will be accepted. Based on them, changes will be made to the EPTS.

How to avoid mistakes when buying a car at a car dealership

Lack of PTS Even seemingly serious car dealerships can cause serious troubles for the buyer. Mechanical, electrical and appearance problems are usually the result of a manufacturing defect, and the seller is only indirectly to blame for these problems. But problems with car documents are a direct consequence of the store’s uncleanliness. Recently, cases of cars being sold without a vehicle passport (PTS) have become more frequent. Or rather, the car dealership is selling the car now, and asking you to pick up the title in a month, two, three... a year, etc., explaining that the document was delayed at the factory or customs. Know that you are being lied to. The fact is that cars prepaid by the salon come with a title, and those purchased in installments come without it, since the title is pledged to the dealer who provided the salon with an installment plan, and will remain there until the salon pays off its debt.

As a result, you cannot register the car or at least obtain transit numbers, as a result, there is no insurance (MTPL), and most importantly, you do not have the opportunity to use the car for its intended purpose, since the first traffic police officer you come across will be happy to issue you two reports according to Part 1 of Art. 12.1. and part 1 art. 12.3 of the Code of Administrative Offenses of the Russian Federation and will send your new thing to a special parking lot (penalty parking lot). While the car is in the special parking lot, the cost of storing it, depending on how quickly the title is given to you, can be comparable to the cost of the car itself. So draw your own conclusions about whether it’s worth buying a car with a missing title.

Car with defects Let's say a car arrived at the dealership with a hidden defect detected. Well, don’t send the car back to the factory to the dealer or spend money on repairs because of this! It is much easier to sell this car to a buyer ignorant of such matters. Sales managers in salons understand the psychology of the buyer no less than specialists, and if they see that the client is a “mug,” then they will try to push the product with a “surprise” to him, and then, you see, when the trick is revealed, the client will not make a fuss, and will do the repairs at his own expense. If you don’t like the role of a “burdock”, then do not hesitate to complain to the salon. Let us remind you that in accordance with Art. 18 of the Law “On the Protection of Consumer Rights”, if defects are discovered in a technically complex product (which also includes cars), you have the right to demand either termination of the purchase and sale agreement with a refund of the amount paid, or replacement with a similar model, if this defect is revealed within 15 days from the date of delivery of the goods to you. Moreover, we are not talking about significant shortcomings - fatal, difficult to eliminate, or recurring. That is, even if your rear view mirror falls off within this period, you have the right to terminate the contract.

Outside this period, you may request termination of the contract or replacement with another product if a significant defect is discovered, repairs are delayed, defects are repeatedly eliminated, as a result of which you cannot use the machine for 30 days or more during each year of the warranty period. In all other cases, the seller is obliged to eliminate defects free of charge within the warranty period.

A car with a story How to turn a grandmother into a girl? It’s very simple, you need to take her to a plastic surgeon and give her a new passport. Much the same thing happens with used cars that the dealership sells as new. To do this, used, but quite decent-looking cars are purchased, washed thoroughly, and cosmetic repairs are made if necessary. The old title is “lost”, and in return you get a new one marked “duplicate”, in which the car dealership is naturally indicated as the first and only owner. Possible questions about why there is a duplicate are answered with excuses about its loss by a careless employee or theft by intruders. What can you advise in this case? Firstly, it is better to immediately refuse to buy such a car. Secondly, if you really can’t wait to buy this particular car, then to be on the safe side, look for people you know with connections in the registration departments of the traffic police, through whom you can “break through” the real fate of the car.

Four contracts The deception scheme is built on the impudence of the seller and the legal illiteracy of the buyer, as well as his carelessness. By the way, here is a real case. In the salon you are asked to sign 4 copies of the purchase and sale agreement, but nothing is given in your hands, citing the fact that the documents will be issued along with the car. After paying the cost of the car to the cashier, you wait until they finally give it to you. After some time, when you run out of patience and you begin to wonder where your car is, you are informed that when you pay the full amount, then you will receive it. You rightly begin to be indignant and shake the cash receipt, in response to which they begin to shake the contract in front of you, seemingly the same, but with “slightly” changed conditions relating to the price, payment procedure and your responsibility for refusing to fulfill the terms of the contract. Are your signatures? Yours! Either pay the full amount, or take the advance payment minus the penalty. In any case, the salon gets money out of thin air. To avoid getting into such a stupid situation, remember that:

  • The number of copies must always correspond to the number of sides. Options for reasons for signing additional copies: for the traffic police, for the archive, etc. – are unacceptable because they are obviously false. If a deal is concluded by only one seller and one buyer, then in nature there should only be two copies of the agreement, with “living” signatures of both parties.
  • Always ask for your copy of the contract. Feel free to return only one copy to the seller - his.
  • It is highly advisable to familiarize yourself with the contents of the contract in advance. If you are denied this under any pretext, then it is better to look for another salon.
  • If you have been “ripped off” of a penalty, then you should go to court to demand its return.
  • Before signing the contract, do not forget to find out from the seller whether the final cost of the car was announced to you, so that VAT and other “fees” with “state duties” and “tips” do not start to appear later.

Formally, the seller has complied with the quantitative component of the package, but it is not necessary to comply with the qualitative component - it is not provided for in the contract. The conclusion follows: require a detailed description of the car’s equipment either in the contract or in a separate annex to it, which must be signed by both parties.

Registration of donating a car with an electronic title

The process of donating a car with an electronic title follows a similar scenario. First of all, you need to correctly draw up the contract. The citizen must indicate:

  • the date of the transaction, the full name of the donor and the donee;
  • complete information about the vehicle;
  • vehicle delivery address;
  • information about additional items and things that the owner transfers along with the car;
  • passport details of the parties to the transaction;
  • signatures of the parties to the transaction.

The agreement is drawn up in 3 copies. The parties to the agreement are required to sign in the appropriate field. When the donation has taken place and the car keys have been handed over, the recipient once again signs in the box indicating receipt of the car.

It is not necessary to show information about the cost of the car. However, sometimes traffic police officers recognize contracts that do not contain price information as invalid. In this situation, the parties to the transaction have the right to immediately file a complaint with a higher authority or simply add the cost to the document.

Notarization of the deed of gift for the car is not required. Drawing up a contract yourself is not difficult.

When the deed of gift has been drawn up, you must contact the traffic police. Based on the document, additional data will be entered into the electronic PTS.

Judicial review

After filing a claim, a case is initiated in court against the car dealership with a requirement to issue a title or terminate the sales contract with the return of the car and money, compensation and a penalty under the contract in favor of the buyer. This is done with reference to the provisions of Art. 456 of the Civil Law , which is important to read. For major questions, you can consult a lawyer.

Initially, according to the law, the claim will be considered in the district court. District courts may side with the defendant, but the decision can be appealed to a higher authority. First, you can demand a review of the decision in the Regional Court, but if it sides with the seller, you can safely go to the Supreme Court.

Litigation will take time to prove the case. The trial will not take a whole year, but you will definitely have to wait a few months. The main thing is to arm yourself with references to the law, listen to the recommendations of a competent lawyer and be mentally prepared for disputes, court hearings and debates.

Who can check the EPTS?

The list of persons entitled to request data from the electronic PTS is set out in paragraph 12 of the Procedure. The legal act states that this opportunity is available to:

  1. Authorized bodies and documentation producers. Moreover, information about a passport with an unfinished status is available to them in full. If a document is assigned a valid status, authorized persons will receive all information, except for data on state registration and changes made.
  2. Companies engaged in the manufacture of cars and other vehicles. They have access to information that is in documents with the “valid” status, but only for cars that have not been registered with the state.
  3. Representatives of government authorities of the countries that have concluded the agreement. The information is available in full. Persons have the opportunity to obtain information about a policy of any status.
  4. Car owners. The information is provided in full.
  5. Other persons. Upon their request, the system will provide an identification number, as well as a chassis and body number. No other information available.

Registration of compulsory motor liability insurance with electronic PTS

Earlier, information appeared that car owners who have issued digital passports for cars may encounter difficulties in acquiring a car title. The reason for this was the fact that the owner column in the document is not required to be filled out. This means that you can confirm the fact of ownership of a vehicle only with the help of a purchase and sale agreement. However, it is not one of the papers that is acceptable for use when registering a motor vehicle license.

In 2021, the problem with issuing compulsory motor liability insurance with an electronic PTS has been resolved. An agreement was reached between RSA and Electronic Passport JSC on an information exchange mechanism. The process of registration of compulsory motor liability insurance has also been agreed upon. However, in order to start the information exchange process, a transition period will be required. To apply for compulsory motor liability insurance, you will need to provide an extract from the EPTS. It will be added to the list of basic documentation. It will replace the classic car passport required for insurance. Otherwise, the process of purchasing a policy will not change.

Is it possible to pick up a car from the dealership without a document?

A new car must be registered with the traffic police within ten days , and this can only be done if you have the original PTS in hand. You have the right to drive a car without state registration and license plates only for the specified period if you have the original PTS and the purchase and sale agreement. A copy of the car passport, which is usually issued at the dealership upon purchase and conclusion of a contract before receiving the original from the manufacturer, is not an official document.

By picking up a car from the dealership without the original title, you assume full responsibility for compliance with the laws in the field of driving a vehicle. If there is a delay in issuing a PTS, you will not be able to register the car in a timely manner and will be held administratively liable for violating the registration deadlines. In addition, when checking on the road, traffic police inspectors will hold you accountable for driving a car without documents and may take your car to an impound lot.

Pros and cons of EPTS

In 2021, the use of electronic PTS is associated with a number of advantages and disadvantages. The main positive features of abandoning paper media are:

  1. Individuals and organizations will not be able to enter data into the electronic PTS on an individual basis. Only specialized organizations will be given the authority to carry out the action. All this will help reduce the risk of fraud in this area.
  2. The document cannot be stolen or lost. As a result, the need to replace the document will disappear, which in turn will reduce the workload of traffic police officers.
  3. The vehicle owner has the right to receive an extract from the electronic document at any time and to perform any actions.
  4. Any number of owners can be entered into the electronic PTS. There is no need to obtain a duplicate when empty graphs run out.
  5. With the help of an electronic passport, you will be able to find out the entire history of the car from the moment of its manufacture to disposal.
  6. All restrictions that were imposed by any services are included in the electronic document. Information about the pledge is also displayed here. Obtaining all information about the car will reduce the risk of fraud and reduce the likelihood of vehicles being sold using fake documentation.

However, there are also disadvantages of electronic PTS. And the main one today is citizens’ distrust of the electronic system. In addition, electronic PTS cannot be used as collateral in a bank when obtaining a car loan. This means that new conditions for cooperation with financial organizations will be introduced. The changed nuances of cooperation may be unacceptable to many potential car owners.

How to recognize your ownership?

The supplier, in turn, conducted an audit of the dealer’s warehouse and removed all of its vehicles from there, and a little later terminated the contract.

Buyers began to demand through the court either to give them a car (those who had all the documents in their hands) plus a title, or a title to an existing car, or simply return the money. Moreover, all the anger began to pour out on the supplier.

In this situation, one can only wonder why no one thought (and lawyers know about this practice) to file a claim for recognition of property rights!

For owners of cars without a title, such a solution to the issue would be the most effective and fastest, because they have already paid the seller, they have documents confirming this, and the relationship between the supplier and the seller should not concern them.

First, the court, by its decisions, ordered the supplier (or dealer) to issue a car with documents or a title. Two individuals even got their money back. However, later the regional court overturned all decisions, indicating that it was the dealer who should solve all these problems. And the dealer declared himself bankrupt, although he did not escape punishment. The managers were accused of fraud and misappropriation of money.

Receipt and content of an extract from the electronic PTS

After the vehicle owner replaces the title with an electronic document, he will be provided with an extract. It is issued on paper. You can obtain an extract using the following methods:

  • by personally visiting the traffic police;
  • submit an application through the MFC;
  • send an application through government services;
  • using the capabilities of the electronic passport system.

An extract requested online will be sent to the citizen’s email in 2021. The document can be printed. The extract from the electronic PTS will contain brief information about the car. After reading it, a citizen will learn:

  • category, model and make of the car for which the passport is issued;
  • engine information;
  • body and engine number;
  • car registration area.

Unlike the paper version, the electronic document does not contain information about the month in which the car was released. This information can play a significant role in determining the cost of the car. The country in which the vehicle was issued is also missing. Information about previous owners is available only to the current owner of the car and representatives of authorized bodies.

Will STS change?

STS is a certificate confirming the fact of registration. It is provided by representatives of authorized bodies. The document is issued when the car owner registers the car. The STS is a document that contains information about:

  • type of machine and its category;
  • year of manufacture;
  • engine models and their numbers;
  • body and its color;
  • engine power and displacement;
  • PTS data;
  • permitted weight;
  • owner.

You must always carry the document with you. It has several degrees of protection. Its counterfeit is prosecuted by law.

There are no changes to the STS in 2021. However, it is possible that in the future this document will be translated into electronic form.

Is it legal to drive a new car without a title?

After purchasing a car without mileage and before registering it, we have only 3 documents on hand:

  1. PTS, which is given, but not always, along with a new car,
  2. contract of sale,
  3. our driver's license.

That is, in fact, if you agreed at the dealership that the passport for the car will arrive later than you receive the car, you may only have the last 2 documents.

But what documents we are required to submit to the traffic police inspector for verification are listed in clause 2.1.1 of the traffic rules. And their exhaustive list is as follows:

  • v/u,
  • certificate of registration (CTC), and this is not a PTS at all, but pink plastic, which is issued by the traffic police when registering,
  • compulsory motor liability insurance policy in cases established by law.

There are also a number of special documents: a waybill, a license for taxi drivers, documents for dangerous and heavy cargo, an access card. But all this does not apply to drivers of ordinary cars.

Documents to be presented to the traffic police officer

It turns out that out of all of the above, we only have a driver’s license. Does this mean that we can’t drive a new car, even if the title were available? Not at all!

In fact, to purchase insurance, the 2021 legislation gives us 10 days from the date of purchase of the car. The same applies to registration. Although the traffic rules do not directly state that it is necessary to have an STS only in specified cases, yet since we have the right not to register a car for some time, we are not to blame for the absence of a document that is issued only after registration, so we should involve unlawfully held accountable.

But the main thing is that the PTS as a document that must be carried with you in the car and presented upon request to the traffic police inspector is not in the Traffic Rules or in other regulations. As of 2021, there is no obligation to carry a vehicle passport. Thus, you can drive a car without this document. But you have an obligation to register it with the traffic police within 10 days. And without PTS it is impossible to do this. And then and only then can problems begin, including the deprivation of rights and the evacuation of the car to the impound lot for repeated driving of an unregistered car.

Nuances

The transition to electronic PTS in 2021 will lead to a number of nuances that you need to know about in advance. Thus, everyone will be able to get acquainted with basic information using the electronic passport system. To do this, you need to know the EPTS number or VIN. Information is provided free of charge. However, information about the owner of the car will not be available to persons other than authorized bodies and the owner of the car.

The potential buyer has access to the same information as other persons. After reviewing the extract, he will be able to find out that the car really exists, and also find out the status of the electronic PTS. In addition, information is available about the presence of restrictions on legal actions with the car.

In 2021, the electronic PTS does not display information about all previous owners. The document reflects only their number, status, region of residence and the date of completion of the registration action. Only the owner of the car and the seller who has access to this version of the electronic PTS can demonstrate complete information to the buyer.

Paper PTS will continue to be used until all the fields intended for entering owners are used or the document is lost. From November 1, 2021, the issuance of classic passports will cease. Until this moment they can still be issued.

A car can only have one passport. You cannot be the owner of both a paper and an electronic PTS. After the new document is issued, the old one is invalidated.
