How to restore documents if the car is scrapped

  • maintenance ticket.

Next, you need to pay the state fee and, attaching the receipt received from the bank to the rest of the documents, visit the traffic police again to receive a PTS and a registration certificate. What to do if the car is scrapped, but you didn’t know about it when you bought it

To avoid problems, it is better to check the car in advance using the traffic police database for disposal. If a scrapped car has already been purchased, there are several ways to resolve the situation.

First option

Find the owner and demand that he restore the registration. The former owner's lack of time is not an argument. Let him write out a general power of attorney for you. And then the procedure is the same as described in the previous section of the article.

Second option

Applicable in the case when the owner of the car declares that I am not me, and the house is not mine, and refuses to do anything to restore the registration of the car. If there is a purchase and sale agreement, the seller can be safely sued. Article 451 of the Civil Code of the Russian Federation provides that a gross violation of the rules of the monetary policy may serve as grounds for termination of the transaction and return of funds. Your claim will most likely be successful, but legal proceedings may take a long time.

Third option

If you were unable to find the old owner on your own, contact the traffic police with a request to find the owner of the car. In this case, you can, for example, indicate that you simply found the car in the middle of the road. If the owner is found, use one of the two methods described above.

What to do if the car is scrapped?

According to letter No. 13/5-229 of the Main Traffic Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation dated October 18, 2011 and order No. 139 of the Ministry of Internal Affairs of the Russian Federation dated March 20, 2017, it is possible to restore the registration of a junk car if there is no confirmation of this:

  1. certificate of disposal;
  2. a certificate from a center that dismantles cars;
  3. a statement from the car owner that he independently dismantled and scrapped the vehicle.

The main condition is the presence of the owner of the car included in the title. If the car was received after the execution of a purchase/sale or donation agreement, its new owner can initiate the restoration procedure if he has a notarized power of attorney with the right to restore registration from the previous owner.

If the location of the real owner of the car is unknown, it will not be possible to restore the registration of a car, even if it is formally scrapped. In this case, you will need to submit an application to the local traffic police department to search for the owner of the vehicle.

If the State Traffic Inspectorate officers cannot find the person, then they will have to apply to the court to recognize the ownership of the specified car. It takes 6 months to find a person. After this period, the previous car owner is considered missing, and the new owner is considered the owner of the car.

Is it possible to drive a scrapped car?

The Code of Administrative Offenses of the Russian Federation does not provide for any special punishment for driving a scrapped car. However, for a number of reasons, such a ride can cost a pretty penny. Including, in accordance with Art. 12 of the Code of Administrative Offences, driving an unregistered car will cost 500 rubles. Repeated violation will increase the fine to 5 thousand rubles. Also, traffic police officers will have every right to send the car to the impound lot. There it will remain until the violations are eliminated (that is, until you register it).
