Laws and Regulations Governing Driving School Licensing

Only two, but completely different, regulations regulate licensing activities in the field of training car drivers:

• Federal Law No. 196 of December 10, 1995 “On the safety of DD” (as amended as of July 15, 2016).
• Order of the Ministry of Transport of the Russian Federation No. 26 dated 05/10/94 (registered with the Ministry of Justice on 05/12/94 under number 558) “On licensing of educational institutions”.

That is, the owner of a driving school receives a license to train (educate) drivers and retrain them.

Registration documents for the car must also be present in the driver’s package of documents during the trip. Otherwise, the traffic police inspector may decide to prohibit further movement and place the car in the impound lot until the circumstances are clarified.

Many schools even now do not use digital technologies and their advantages; this is not pleasing and slows down many processes, both for staff and students. When independently registering and obtaining a license, the owner of a driving school will have to pay a standard state fee in the amount of 7,500 rubles. The amount is specified in the Tax Code of the Russian Federation 333.33. If the applicant is refused to issue a document, payment of the state fee will not be reimbursed.

When applying for help from a legal organization, the cost of obtaining this document will start from 65,000 rubles. This amount usually does not include pre-licensing preparation. Permits from the sanitation station will cost 40,000 rubles and a conclusion from a specialist from the Ministry of Emergency Situations from 75,000 rubles.

What are the penalties for absence?

There is a fine for the absence of each of these documents. They are small, but in addition to them, a costly security measure can be applied.

• For not having a driver's license with you, a fine of 500 rubles is imposed. It is subject to a discount, and you can pay 250 rubles in the first 20 days after the ruling is issued. Security cameras do not record this violation.
• For driving without an STS, the fine is small - 500 rubles. However, in this case, evacuation to the impound lot is provided if the document is not delivered before the tow truck arrives.
• There are as many as 3 fines for compulsory motor liability insurance in 2021:
  the same 500 rubles if you simply forgot this document at home,
• 800 – if the owner did not buy compulsory motor liability insurance for this car at all, or the policy has expired,
• 500 rubles if you are not included in the current insurance.

When preparing for inspections by the SES, fire inspection and police, the management of the driving school must first enter into an agreement with the service:

• Carrying out measures to destroy pathogenic microorganisms and their carriers (deratization, disinsection and disinfection).
• Dealing with the challenge of solid waste and waste disposal.

These contracts will be checked by the SES at the pre-licensing preparation stage.

Documents for obtaining a license

To obtain a license for a driving school, a standard package of documents is required:

• Statutory documentation (the Charter itself, minutes of the meeting of the founders with the decision to organize a driving school and an order for the appointment of the first person/director). All copies are certified by a notary.
• Certificates: state registration, registration with the Federal Tax Service, changes (if any), extract from the Unified State Register of Legal Entities.
• Documents confirming ownership of the premises and training ground or lease agreement.
• Conclusions: SES and Ministry of Emergency Situations.
• Program and plans for educational activities, including theory and practical exercises.
• Documents of employees confirming their education, qualifications, work experience and right to educational activities (certificate).
• Documents confirming the availability of educational literature and material and technical support (educational transport, own or rented, or agreements with drivers who have their own factor).
• Receipt/payment order indicating the transfer of state duty.

All documents that are provided in the form of copies must be confirmed by the signature of a notary. This package is accompanied by a corresponding sample application and a list of documents. The inventory is made in 2 copies. After submitting the documents, one copy remains with the applicant.

What documents are issued after training at a driving school?

Currently, after studying at a driving school, you must receive the following documents:

1. Certificate of completion of a driving school (Certificate of driver's profession) - This is essentially the most important document, which indicates that you have completed a full course of training at a driving school, for the appropriate category, and have successfully passed internal exams in theory and practice. It is important to remember that this must be a Certificate of Profession as a driver and no certificate or other document from a driving school can replace it.
2. Medical certificate - Now, according to the new regulations, you first receive a conclusion at the psychoneurological and narcological dispensaries, and then go through the main doctors at the medical center, where you are given a medical certificate. It is important to remember that the conclusion from the dispensaries is valid for one month and after receiving them, within a month you need to have time to see the main doctors, and the medical certificate itself is valid for one year.
3. Driver's card - Since 2014, this document has lost legal force and now serves for the convenience of traffic police inspectors, since it contains your personal data, data on the certificate of completion of a driving school and a medical certificate. It is important to remember that it is not required to schedule exams in the traffic police and there is no need for it, neither where, nor when, nor at any stages.
4. Traffic police examination sheet - Your full name and date of birth are entered on it, otherwise it is not filled out and is filled out by the inspector after passing the practical stages, site and city. 5. Confirmation certificate - It indicates your full name, date of birth and states that you actually completed the entire course of training at the driving school and received a certificate of completion of the driving school, indicates the series and number of the certificate, the start and end date of training. It is important to know that the traffic police may not accept this document, but rather send an official request to confirm your training to a driving school, or give you such a request in person. 6. Copies of a certificate of completion of a driving school and a medical certificate are just copies, and if they were not given to you or you lost them, the traffic police officers themselves will make copies from the originals of the relevant documents.

Requirements for employees and equipment

The number of hired workers is calculated based on the expected workload of the school. For a group of 30 people you need to provide:

• one theory teacher;
• three instructors.

The theory teacher must have a higher or secondary specialized education and at least 3 years of experience in a similar field.

Classrooms must be equipped and staffed with:

• vehicle control simulation system;
• visual aids for studying theoretical material (posters, diagrams, etc.);
• mock-ups of devices of main units (engine components).

All requirements for the practical training ground (autodrome) must be agreed upon with the traffic police. at the stage of pre-licensing preparation.

Is a professional standard mandatory?

Fines and penalties for operating without a license

Educational activities without a license are punishable by an administrative fine. You can be fined:
