What new fines appear from November 20? Last news

So, according to information disseminated on the Internet, starting from November 2021, penalties for the most common as well as gross violations of traffic rules will be tightened. We are talking about the amounts of fines for speeding, tinting, driving without MTPL insurance, drunk driving and transporting children without a car seat.

At the same time, the Internet usually writes about what penalties are being tightened, in 3 different forms of amendments to the legislation:

  • supposedly new fines will increase from November 1, 2021 along with changes to traffic rules,
  • other sources indicate the date - the 20th day of the month,
  • still others write about the introduction of a fundamentally new, reformed Code of Administrative Offenses of the Russian Federation, in which all punishments take on a completely different form and composition.

Please note that even the sanctions before the changes in this list are not entirely correct. Thus, the period of deprivation of rights for driving while intoxicated is not exactly 2 years, but from 1.5 to 2 years. And for transporting children without a seat, drivers were fined not 500 rubles, but 3 thousand - that is, here we are allegedly not talking about an increase, but even a mitigation of the punishment!

But there is one new November penalty!

We indicated above that not a single new fine will be introduced for traffic violations in November 2021. And it is true. And yet, one penalty will appear for violating the tachograph law from November 1.

This new change is being introduced within the framework of Federal Law No. 216 of July 26, 2019 and reforms the content of Article 11.23 of the Code of Administrative Offenses of the Russian Federation.

How can you prove it?

Everything is very simple. The most useful knowledge that can be obtained about traffic police fines is how to correctly check the information and where to look for it. And you can check which new and old fines are in effect today in the following most reliable way (you will understand why “the most reliable” below). Although, this is not the easiest way.

  1. All fines, as well as terms of deprivation of rights, administrative arrests and other punishments and security measures for drivers and others are contained in the Code of Administrative Offences. Yes, there are also regional Codes of Administrative Offences, but we will not consider them here, simply because the vast majority of sanctions are contained in the Federal Code.
  2. If we are talking about new traffic police fines and changes to current ones, then they, accordingly, should be made by appropriate amendments to our Code of Administrative Offenses. The Code itself was introduced by the relevant law more than 18 years ago. And it is precisely its Article 1.1 that indicates that all changes to this legal act are made by federal laws.
  3. What is federal law? First, its draft is developed by some deputy or group of deputies. For example, once the LDPR proposed in a bill to abolish the fine for tinting completely.
  4. Then the project is registered in the State Duma and submitted for discussion.
  5. Then there are 3 readings by other deputies and, accordingly, voting for or against its adoption. If at least one of the readings the majority of votes are against, then the project will be rejected, and the new fine will never come into force.
  6. If the draft is approved in all readings, then several more formal stages will pass before the new law comes into force. We are interested in one of them. According to Article 6 of Federal Law No. 5, the entry into force of changes occurs after some official publication.
  7. We go to Article 4 of the same Federal Law and see that such publication is considered to be the placement of a new law on official legal information portals, including Pravo.gov.ru.

And it's all! Now we just have to try to find the relevant law on changes to the Code of Administrative Offenses of the Russian Federation on this portal. And you will not find a single one that would introduce new traffic police fines either from November 1 or from November 20, 2021. That is why all these new punishment tables are nothing more than fakes.

Yes, this is not the easiest way to verify the veracity of information about the November sanctions. There are also simpler ones, but conditionally less reliable.

But they also have some problems. So, you can look at the current penalties, but knowing when any penalty will come into effect in the future (even tomorrow) can be a challenge. New fines - 2021: what will happen to +20 km/h and what will they start depriving of rights for?

Few city residents who have not traveled outside the region understand that somewhere in the neighboring region, conditions on the roads may be completely different. The unpleasant traffic jams in Samara and the drivers forced to languish in them with their restraint cannot be compared with the rudeness on the roads in the Krasnodar Territory and the Republic of Adygea. Here, drivers simply ignore many rules, not turning on their turn signals, not allowing pedestrians to pass, brazenly driving through a red light, or turning around through a double line. Kazan drivers also feel differently - the quality of roads and the internal policy of the republic are changing behavior on the roads for the better.

There is currently no opportunity to buy a traffic rules book and use it for years - the rules change very often. Recently, the maximum number of changes concerns the introduction of all kinds of penalties and increasing the size of existing penalties for motorists who have violated the rules.

Every year there is talk about depriving people of their license for a long period for speeding twice as high as the speed limit on a given section of the road. Current rules only allow for a fine or deprivation of the right to drive a vehicle for up to 6 calendar months. This does not scare all drivers - they continue to regularly exceed the speed limit. Probably the increased period of deprivation of a driver's license will have a stimulating effect on them.

Officially, information on the new amounts of financial punishment for drivers is still under consideration. At the same time, drivers should not expect that as a result of the review, fines will become smaller - they will definitely increase. Moreover, it is already obvious that additional types of punishments will appear for previous offenses, as well as new ones will be introduced, in particular, for dangerous driving.

Plans to introduce such a system have been announced several times. In 2016, the corresponding law was adopted in the first reading, but since then nothing has changed in this area. Now, in addition to the fines received for this or that offense, the offenses themselves will accumulate. If a driver commits 3 violations of the same type of rules, then in addition to the corresponding fine, he may be deprived of his license for up to 1.5 years.

Currently, this rule applies to the following violations of the rules committed three times:

  • running a red light;
  • Unreasonable driving into the oncoming lane;
  • exceeding the speed limit by 60 km/h;
  • driving in reverse in prohibited places;
  • ignoring the advantage of pedestrians while driving;
  • turn/turn around in places marked with a prohibitory sign;
  • failure to provide passage to a vehicle having priority;
  • crossing railway tracks with a closing barrier/forbidden signal.

It is noted that new clauses regarding the use of tires will appear in the traffic rules at the beginning of 2021. Thus, according to the law, citizens of the Russian Federation will not have the right to drive cars that are driven on tires that are inappropriate in size and category.

In addition, some other amendments will come into force. From 2021, vehicle owners will not be able to drive on winter tires in the summer, and vice versa, use tires for the warm season in December, January and February.

At the same time, as representatives of the Russian Ministry of Internal Affairs noted, members of the governments of individual regions, depending on the climate, will change the validity period of certain traffic rules.

What about traffic rules?

No amendments to the traffic rules are expected from November 1 and November 20, 2021. But here, unlike the Administrative Code, changes are made in a slightly different way. Since the Rules are formally a Decree of the Government of the Russian Federation, they are updated by the same PPRF. Therefore, we will refer to official sources, although the traffic police website actually has nothing to do with it. And what does it have to do with it?!

There are 2 ways to check whether this information is myth or truth:

  1. check for new fines from November 1 on the official website of the traffic police, as well as new laws from November 20, 2021 in legal information databases - that is, more authoritative sources,
  2. look for changes on the government website, where new traffic rules must be published.

So, let's look at more authoritative resources:

  • on the website of the State Traffic Inspectorate, all the above amounts for administrative fines, including speeding, tinting, driving without compulsory motor liability insurance and others are the same as at the beginning of the year and even in the past,
  • Let’s also look at the Consultant Plus website - here there are all new editions of the Administrative Code, depending on the dates of changes that come into force; You won’t find any new traffic police fines here either, which come into force in November.

Deputies intend to implement a long-standing intention to increase the fine for driving a vehicle without an MTPL policy. The bill has not yet been developed, however, at the State Duma working group on improving the law on compulsory motor liability insurance, this issue was considered and an initiative was put forward to increase the sanctions sevenfold. If the fine is greater than the established one

Fines remain at the same level, and the responsibility of motorists does not change. But if a traffic police officer determines the payment of a different amount than indicated in the Code of Administrative Offenses of the Russian Federation, you should contact the traffic police for clarification. To receive information, the driver fills out an application in any form, making sure to include in the text:

  • information about the traffic police department - name and address of location
  • own details
  • the essence of the problem is the excess of the imposed penalty
  • date of application
  • list of accompanying documentation

Along with the application, a protocol on the imposition of a fine must be presented.

Some changes really await motorists in the fall of 2018. However, they apply exclusively to drivers driving on the roads of the capital. From November 1, the procedure for checking the availability of a compulsory motor liability insurance policy will be tightened.

Such a check was made possible by linking automated video surveillance systems to existing lists of MTPL holders. They include not only Moscow drivers, but also motorists throughout the country. The authorities tried to minimize the possibility of error. The number is checked twice. The first is on the day the photo is received, the second 10 days later.

The time interval between queries to databases was not chosen randomly. In accordance with the law, a motorist can drive a purchased car without insurance, but for no more than 10 days. Therefore, if the cameras come across a driver who recently made a purchase and applies for compulsory motor liability insurance within the allotted time, the last request will remove him from the list of violators. In practice, however, difficulties are possible. The RSA admits that the available list is not complete, and information may also be entered with a delay. Therefore, insurance holders who have received a “letter of happiness” will have to contact the traffic police to have their fines cancelled.

In the future, such measures may indeed lead to tougher fines. But you definitely shouldn’t expect anything like this in November 2021.

What changes are true?

And we repeat once again that in November there is not a single new traffic police fine introduced - neither for speeding, nor for tinting, driving without compulsory motor insurance, drunk driving, red traffic lights and others. But Russian car enthusiasts can expect changes a little later. Here are the main ones.

  • In fact, the amounts of fines in the table above are not taken from the head, although they are not true. The fact is that the authorities have long been preparing an adjustment to the Code of Administrative Offenses in the form of its complete reform - most penalties will change upward. However, this innovation has not yet come into force and is still in the draft stage.   • The Ministry of Health also came up with an idea to increase the cost of a medical certificate for drivers by increasing the number of tests for fitness to drive. This is also still a project and it will definitely not come into force in November 2021 - most likely, closer to the second half of 2021.
  • But what will definitely come into force are amendments to increase the fine for lack of technical inspection and recourse from the insurance company for compulsory motor liability insurance in the event of an accident without a valid diagnostic card. The effective date is March 1, 2021.
  • From the same date, the rules for passing technical inspection change.

Table of traffic police fines for 2021 and 2021

For leaving a crossing with a closed or closing barrier or with a prohibiting traffic light signal, stopping or parking at a crossing, crossing a railway track outside the crossing - the fine increases immediately five times, from 1 thousand rubles. up to 5 thousand rubles or deprivation of rights for up to six months. If the violation is repeated, deprivation of rights for up to one year is applied; if such a violation was recorded by a video camera, the fine will be 10 thousand rubles.

Deprivation of rights for a period of up to one and a half years is introduced if the driver has committed the following violations three times or more:

  • Exceeded the speed by 60 km/h;
  • I drove through a red light;
  • I drove into the oncoming lane;
  • Made a turn or U-turn in places prohibited by signs;
  • Did not give the right of way to a pedestrian;
  • Driving through a railway crossing when the barrier was closing or at a red light;
  • Refusal to give way to a vehicle having the right of way;
  • Made a U-turn or reversed in a prohibited place.

The cumulative system takes into account only violations registered by traffic police officers. If a violation is recorded by an automatic camera, such violation is not taken into account!

Initially, a promotion was indeed planned, and a very serious one at that. Many fines, including those for violating the speed limit, could increase by one and a half, two, or even three times. Such a measure would be extremely beneficial for the government, providing an increase in the flow of funds into the country’s budget and an excellent chance to get rid of financial holes.

However, the public sharply criticized these measures, which in no way fit into the current conditions of the crisis. State Duma deputies also opposed such an increase. Therefore, the amount of most fines will not change in 2021. However, some articles have expanded and gone into more detail.

Most fines will remain unchanged in 2021. The amendments will apply to fines for:

  • repeated violation of tinting standards (3,000 rubles instead of 500 rubles for the first violation);
  • driving at a speed exceeding the permitted speed by 60 km/h (2000-5000 rubles instead of 2000-2500 rubles);
  • transportation of a child without restraints (driver: 5,000 rubles instead of 3,000 rubles; official: 30,000 instead of 25,000; legal entity: 150,000 instead of 100,000; individual entrepreneur: 350,000).

The liability for driving with a confiscated driver's license will also change (previously: a fine of 30,000 rubles or 100-200 hours of compulsory work; now: a fine of 30,000 rubles or 40-60 hours of compulsory work).

There will also be separate fines for:

  1. Driving while intoxicated with children under 16 years of age in the car.
  2. Refusal of a medical examination if there were children in the car (fine in the amount of 50,000 and deprivation of rights for a period of 2-3 years).

The Ministry of Justice officially promised that in 2021 it will still be possible to pay fines with a fifty percent discount if paid within the first twenty days after the offense. There will also remain the possibility of appealing the deadline for issuing a fine if a copy of the fine sent by mail does not reach the offender within twenty days. Moreover, in 2021, a discount will be available when paying fines for approximately two-thirds of administrative offenses, although previously this promotion applied only to traffic police fines “arriving” for violating traffic rules.
