To have financial protection from the consequences of an incident, you should take out insurance policies that will provide compensation payments.

To receive them, participants in an emergency need to prove the facts of its occurrence and provide a package of necessary documentation, among which special attention is given to a certificate from the traffic police about an insured event (accident).

In this article we will talk about existing document forms and provide samples of them. You will find out who and where to contact to obtain such a certificate, who fills it out and according to what rules.

Information about documentation details and possible refusals to provide it will also be important. Knowing all these nuances, you will be able to quickly and correctly make decisions in unforeseen situations.

What is a road accident certificate?

This is an official document that has a strictly specific form and is filled out according to clearly established rules. For insurance companies, it is indisputable evidence of the occurrence of an insured event, which is why motorists often call it a certificate of damage to the vehicle.

The said paper is filled out by the traffic police inspector who arrived at the scene of the accident, but all the information entered is not secret, so any of the participants in the accident can observe its preparation and completion in order to prevent distortion of information.

What does the certificate form look like?

Today, a certificate of an accident is filled out using Form 154 - on a special form approved by order of the Ministry of Internal Affairs of the Russian Federation No. 154 (hence the name) on April 1, 2011.

The list of required details in this form includes:

  • exact time and coordinates of the incident site (filled in in the upper right corner according to data received from the GLONASS or GLONASS/GPS navigation system);
  • contact details of each party - full names of drivers, their telephone numbers, residential addresses and driver's license numbers;
  • information about vehicles involved in an accident: their license plate numbers, a detailed description of all damage, the name of the insurance organizations in which they were insured;
  • information about the victims, if any, their medical examination and hospitalization;
  • a list of what is included in the application.

By the way, about the application. It is issued/filled out simultaneously with the main document and includes information about the victims, medical workers who arrived at the scene of the accident, and data received from these workers: the nature of the injuries, the cause of death, and other details.

Filling out the certificate - important points

If several vehicles collided, you need to fill out a notification together with the driver of the car involved in the collision. It is necessary to draw up another similar form if another car drove into the car from behind - with the driver of this vehicle as well. If the vehicle was “pushed” towards a moving car in front, this fact must be included in paragraph 15 of the notice.

It is imperative to indicate in each of the documents drawn up who exactly made such a “push”.

Don't forget to design the back of this form. In paragraph 4 you must indicate:

  • car model and make;
  • registration number;
  • Full name (name of the legal entity that is the owner of the vehicle, its mobile phone, registration data);
  • Full name of the car driver with address, telephone number, name of his insurance company, policy number and other information similar to that specified in paragraphs 1–18 of the issued Notice.

Road accidents with victims - what threatens the culprit?

If the second driver does not want to sign the Notice or fill it out together with other participants in the incident, you must complete this document yourself. In this case, you will need to indicate all possible details of the car of the second participant in the accident (color, number, make, etc.), and write in the notes that the second driver refused to sign the notice. You need to try to find witnesses, indicating their full name and contact information.

The fact that the other driver involved in the accident refused to fill out the form or sign it cannot affect the determination of insurance payments. You can confirm the circumstances of the accident with your own copy and documents issued by the traffic police.

In the event of the death of one of the drivers, the notice is not filled out.

If there is no disagreement between the participants regarding the accident that occurred, the completed notification form must be signed by both parties. If there are controversial issues, this document is not signed (signatures indicate the absence of disagreements). In this case, the police are notified about the accident, and a standard package of papers for such an incident is drawn up. If the circumstances of the case require, procedural documents may be drawn up.

What is Form 748?

In some sources, in addition to Form 154, you can find mention of Form 748. In order not to cause confusion, let us clarify: Form 748 is an outdated form that was used by traffic police officers to record an insured event (traffic accident) until 2012, i.e. before the introduction of Form 154 into practice.

It, like the 154th, contained data about the participants in the accident, their vehicles and the nature of the damage/injuries received, but was less informative, because did not include the exact coordinates of the accident site, the vehicle numbers of the ambulance teams called to it, and some other nuances, such as an additional category in the modes of transport section and a more detailed description of the wounded and dead, including their status - driver, pedestrian or passenger.

How to get a certificate of an accident from the traffic police?

In fact, this document should be issued by the inspector at the scene of the incident immediately after the protocol is drawn up. True, exceptions are possible, for example, an inspector is urgently called to the scene of another accident/crime, or there are victims in an accident who were hospitalized - here, until the extent of the damage is determined, no one will give you anything.

What to do in such situations? – Do not panic and follow strictly the instructions described below.

  1. Before leaving the scene of the accident, check with the traffic police inspector about where and when you can pick up the paper you are interested in. Remember, it must be provided to you within 24 hours. This is regulated by the information letter of the State Traffic Safety Inspectorate of the Russian Federation No. 45-1468.
  2. Arrive at the appointed time at the appointed place with your passport, verbally state the purpose of your visit, receive the document in your hands and immediately check that it is filled out correctly:
  • the form must be filled out only in blue, black or purple ink (printing on a printer is allowed);
  • all empty columns (where there is nothing to write) must contain dashes or the word “absent”;
  • the list of damage contains only the names of elements/parts, without a description of the damage (for this, the insurer will conduct a special examination);
  • the number of applications corresponds to the number indicated on the main form;
  • if there are corrections in the form, they must be certified by the inspector’s signature, the date of the changes and a seal.
  1. If everything is in order, immediately submit the completed form No. 154 along with all the documents necessary to receive insurance payments to your agent.

Please note: the validity period of the certificate itself is unlimited, but this does not mean that you can delay submitting it to the insurer, because the deadline for filing an application for compensation is limited: for CASCO 5 working days, for MTPL – 15.

Useful tips.

  • If you notice the presence of inaccuracies in the circumstances of the accident reflected in the document, you can ask the traffic police officer to rewrite everything. In case of refusal, you have the legal right to appeal to higher management or to court.
  • If a traffic police inspector refuses to issue you a certificate of an accident on the spot without a good reason, including citing the lack of one “on hand,” you can safely complain about him to his superiors or to the prosecutor’s office, since this is illegal.
  • If you lose a certificate of damage to a vehicle within 3 months from the date of its occurrence, you can easily obtain a certified copy of it by simply contacting the traffic police with an advising statement and an identification document.

How to challenge a certificate of an accident?

Having identified deficiencies in the design or content of the road accident certificate, it is necessary to submit a written request for amendments (additions).

The following should be taken into account:

  1. The request must be motivated and justified.
  2. The petition is submitted to the traffic police inspector who compiled the certificate.
  3. The accident report is supplemented with the necessary information.
  4. All additions and corrections made to the certificate must be certified by an official.
  5. If this is not possible, it is necessary to draw up a new certificate of the accident.

Unfortunately, traffic police officers often refuse to satisfy this type of request. In this case, the law provides for the possibility of appealing against the inaction (illegal actions) of an official.

The complaint should be submitted to the concerned person or lawyer addressed to the director of the traffic police department.

The most effective way to protect a violated right is to file an application in court to challenge the actions of an official.

In what form does it come?

A certificate from the traffic police about an accident is an official document, so it has a form and is filled out according to clearly regulated rules.

Intended to inform the insurance company or legal proceedings about all aspects of the accident.

Certificate of road accident form 154

Drawing up a certificate is the responsibility of authorized traffic police inspectors, who can examine the causes of an emergency and issue official documents.

But the participants in the incident can also observe the process of creating and filling out the certificate in order to control the prevention of any inaccuracies.

This document is drawn up on a special form, which is determined by the order of the Ministry of Internal Affairs of the Russian Federation No. 154, and it is filled out manually by an authorized traffic police officer.

Let's consider all the details of the certificate in Form 154, which must be filled out necessarily and accurately:

  • the exact location and time of the emergency;
  • the circumstances under which everything happened (a list of all factors in force at that time);
  • information about the parties to the accident, their contact information;
  • information about the victims, their hospitalization and medical examination;
  • information about the damaged vehicle (detailed description of all damage from the collision);
  • recording an administrative offense, initiating a criminal investigation.

The authenticity of the completed information is certified by an authorized traffic police inspector, who, in addition to his signature, leaves his full name, job title and rank on the document.

Form 154 also provides an annex to the road accident certificate, which is issued at the same time as the main document.

It contains information about the injured participants; if their identity is not established, then a special mark is made and the category is indicated (pedestrian, driver or passenger).

Data from medical workers (nature of injuries to victims, causes of death) is also entered.

The form provides space for filling out information for 4 people; if there are more, additional forms are used.

For example, if a bus with passengers got into an accident, then the inspector will need more than one Form 154 form.

According to Form 748

Form 154 is a newer and improved analogue of a certificate from the traffic police in form 748.

But it contains all the important and irreplaceable details:

  • a field in which you need to indicate the exact coordinates (place and time) of the emergency;
  • a description of the circumstances that caused the incident or aggravated its consequences;
  • information about the participant in the accident (their number, about all injuries), the conclusion of a medical examination;
  • information about damage to vehicles;
  • recording an administrative violation under the articles provided for by law.

The certificate is considered legal and genuine when it is signed, as in the first case, by the inspector. This form is also provided for providing official and confirmed data on an insured event to the insurance company.

Procedural documents of the traffic police

After the new regulations came into force, police officers stopped issuing certificates using forms 748/154, and issued only procedural documents about administrative offenses, which are provided for by law:

  • Determination to initiate a case.
  • Protocol.
  • Resolution.

I fell into a pothole on the road - who is to blame and how to compensate for the damage?

All information that was previously indicated in Certificate 154 is included in the appendices to the procedural documents. They contain the following data:

  1. date of incident;
  2. make, model, VIN of each vehicle, their registration numbers;
  3. Full name of the participants in the accident with contact details, dates of birth and residential addresses;
  4. name of the insurance companies that sold MTPL contracts to drivers involved in the accident, series, policy numbers;
  5. the essence of traffic violations by the participants in the incident;
  6. on sending drivers to undergo a medical examination to determine their state of alcohol or drug intoxication.

Insurance policy holders can receive compensation upon presentation of these documents. Today, insurance companies issue compensation without any special problems without accident certificates, if the information contained in them appears in other documents provided by the driver.

Unfortunately, the new regulations, in force since October 2021, do not contain data on the insurance companies with which each participant in the accident was insured.

Now, in order to receive payments, the participants in the accident must independently fill out an accident notification directly at the scene of the accident. It does not indicate who is to blame for what happened. This information can be obtained from the decree, which, as before, is issued at the police department whose employees are registering this accident.

What does it look like

An important requisite for both forms of the traffic police certificate about the incident is not only the information accurately and reliably filled out, but also the presence of all signatures and stamps.

Like any other official document, in addition to information, the certificate also contains stamps that indicate the authenticity and reliability of the contents of the document.

It is drawn up on a standard A4 form, the fields on it are machine printed, and all information is filled in manually in legible handwriting.

Most of the fields are provided for entering numerical data (number of participants and victims in an accident, number of vehicles involved, time and coordinates of the incident).

An extended certificate of an accident includes an annex in which individual aspects of the accident can be described and explained in more detail.

How to get it and who to contact

Motorists often call this document a certificate of damage to the vehicle for the insurance company.

In almost all cases, the certificate is used to notify the insurance company of the occurrence of an insured event involving damage to the car.

To receive compensation, you must provide a complete package of documentation, which must include a certificate of the accident.

It can be obtained from the inspector even at the scene of the incident. The parties to the accident receive the document without fail.

If the traffic police officer for some reason did not issue it, then you should contact the traffic police department with a comment.

Any excuses that the forms have run out are considered unlawful, so those involved in an accident can appeal them to the prosecutor’s office. And the traffic police officer receives sanctions for disciplinary purposes for his incompetent actions.

Also, official participants in the accident can receive photographs from the scene taken by law enforcement officers. You can take copies of the diagrams and protocol from them to carry out the investigation in the future.

A certificate of an accident for the insurance company and applications in the general documentation package will increase the chance of receiving monetary compensation from your insurer as quickly as possible.

And without it, the insurer has every right to refuse payments for the insured event.

Option to solve the problem

Drivers also need to know that Order No. 664, which approved the administrative regulations, contains a list of forms that it cancels. This list does not include Order No. 154, which introduced the certificate of road accident. The absence of a requirement to formalize it in the administrative regulations of the traffic police does not mean that police officers are prohibited from issuing it.

What to do after an accident to avoid being “extreme”?

You can ask the traffic police inspector present at the scene of the incident to issue a certificate, or make such a request to the police department involved in registering the accident. But this does not mean that the traffic police will agree to provide it; this authority does not like unnecessary paperwork.

It is important to remember that the insurance company does not have the right to refuse to pay compensation for an accident to the policy owner if certificate 154 is not presented.

This document was informational, it did not belong to strict reporting forms, so it can be replaced with an alternative. If the insurance company nevertheless refuses to pay due to failure to provide a certificate, you can confidently go to court, which will most likely defend the rights of the insurance company’s client.

Police officers are required to prepare documents regarding road accidents under Art. 12 Federal Law “On the Police...”. Obviously, certificate 154 was not included in the list of canceled ones in order to have the opportunity to return to this form if difficulties arose with resolving issues of payment of compensation by insurance companies in case of an accident. The police have the right, at the request of the driver involved in a traffic accident, to prepare this document for presentation to insurers.

Validity period and submission to insurance

There are unspoken regulations regarding the deadlines for submitting documentation about a traffic accident to the insurance company.

It is in the interests of the victims themselves to notify the insurer on the same day when the insured event occurred. But the exception is situations when injured victims are taken away by ambulance.

Statistics show that the time frame for submitting a certificate of an accident to the Investigative Committee is 2-7 days, although the parties receive it immediately after the accident is registered.

Please note that the document itself has no restrictions on its validity period. This means that the certificate is issued for an indefinite period.

The document contains all the key facts about the accident necessary for the investigation. There are exceptions when not all damage sustained by the vehicle is included in the certificate.

Therefore, the insurance agent will compensate for the recorded damage, and not for what actually exists. After all, only legally substantiated facts are taken into account.

All other consequences will be regarded as hidden damage that existed before the accident.

For those involved in an accident, you should pay attention to the completeness of the information on the certificate rather than worrying about the deadlines for filing or the validity period of the document.

You can delay submitting a certificate to the insurance company in some cases, especially when the accident occurred at night.

The examination is allowed to take place at a later date, although victims are taken to a medical facility for emergency treatment immediately.

And the insurer will not be able to accept the entire package of documentation without this certificate, which is regulated by the law “On Compulsory Motor Liability Insurance”.

Making changes when there is an error

A certificate is drawn up and issued immediately after the accident and at the same place.

If, for some reason, errors were made in the execution of this document or important aspects were not filled in that would be useful for further investigation of the case and contacting the insurance company, then it is possible to make changes if the traffic police inspector did not include all the damage in the certificate or on The culprit was not found at the crime scene, but was done later.

Read the rules for filling out a notification of an accident under compulsory motor liability insurance here.

If damage is not indicated

In most cases, the accident report is intended to be submitted to the insurance company.

The main factor for determining the amount of compensation payment is the scale of the damage, and each injury to the vehicle is recorded without fail, because it will then be impossible to prove to the insurer the fact that it occurred during an accident.

Insurance companies are very skeptical and vigilant about such details because there are many cases of fraud on the part of their clients.

The document is filled out exclusively by the traffic police inspector, so he must immediately at the scene of the incident with his colleagues carefully inspect the vehicles and describe all the damage.

If all the action takes place at night, traffic needs to be cleared on the freeway, then there will be no time for daytime inspection of the scene.

It happens that under such circumstances, law enforcement officers make mistakes during registration, or overlook some important details.

If an error is discovered, you should contact the traffic police with a statement to report violations.

As a rule, changes are allowed, but a re-inspection of the vehicle is required in order to detect the causes of these damages.

If the culprit is not specified

This aspect is also important, because it is impossible to receive compensation under compulsory motor liability insurance if the culprit is not identified. At the time the certificate is issued, the name and coordinates of the potential culprit are entered into it.

With this document, the victim applies to the insurance company of the guilty party and demands compensation payment, and the insurer makes it.

If his guilt is not proven after a judicial investigation, then the money is returned to the insurer. But before demanding them, the victim is required to provide a certificate of the accident, which must contain the name of the culprit.

Cases cannot be excluded when the culprit is hiding, then he cannot be identified and recorded in the certificate immediately.

Russian legislation provides for the possibility of amending the certificate if the culprit is discovered later. But to do this, you should contact law enforcement agencies with a request to amend the document.

After its confirmation, you can add new facts to the document form, namely, information about the person responsible for the accident.

Help notice

Since the certificate is no longer issued, instead, a notification about the accident must be provided to the insurance company (Order No. 449 of the Ministry of Internal Affairs of Russia dated May 23, 2008). A blank form of this document is attached to the insurance company's policy when it is issued. It is a double-sided self-copying sheet. You can also download it from the RSA website.

Liability for leaving the scene of an accident – what does the culprit face?

It is advisable that the notice always be in the car in two copies. During an accident, this document is drawn up by the participants in the incident themselves before the police arrive. In order for it to have legal force, after filling it out, each of the participants in the incident puts their signature on it.

The party innocent of the accident may write in paragraph 15 of the notice: “I do not consider myself guilty of this accident.” The second participant has the right to express his disagreement with such a verdict. In this case, you need to wait for the traffic police inspector and establish the truth together.

It must be remembered that the completed notification form signed by the parties involved in the accident is not a document that recognizes the guilt or innocence of the participants in the accident.

It must be filled out for every accident if:

  1. damage was caused to the property of other persons or to the vehicle;
  2. harm was caused to the health or life of passengers or other citizens involved in the vehicle accident.

The notification is issued regardless of whether the traffic police inspectors compiled any documents regarding this case. After registration, you must send the completed form to your insurance company within 5 working days.

Is a seal required?

Both forms of road accident certificate require two official seals - a round seal and a corner stamp. They are considered mandatory details because they confirm the accuracy of the completed information. And it is certified by an authorized traffic police inspector.

The insurance company may refuse to accept the documents, arguing that the facts are not authentic. Without this, payments will not be made under both OSAGO and CASCO insurance.

Such measures are provided in order to prevent cases of fraud and falsification of documentation.

Any insurance company is skeptical and treats with special care all the documents provided, as well as the facts that they indicate.

Therefore, they will check them with special care. When registering an accident, make sure that all stamps are in place, otherwise the insurance company will not accept the document provided, citing the lack of authenticity of the certificate.

Re-issuance deadlines

There are times when for some reason the certificate was lost or damaged. There is no need to despair in such situations, because re-issuance of the form is provided.

Sometimes it is even enough to make a photocopy of the sample from the traffic police inspector, because during an incident several copies are filled out.

In order to receive a copy of the certificate, you need to confirm your identity by providing a passport.

But since 2009, an order of the Ministry of Internal Affairs of the Russian Federation allows considering the request of motorists to obtain a copy of a certificate of a traffic accident.

How to obtain a certificate of an accident from the traffic police and what is the time frame for issuing it.

By order of the Ministry of Internal Affairs of the Russian Federation dated April 1, 2011, number 154, the form of a certificate of a traffic accident was approved. In short, this document is called certificate-154. The traffic inspector who registered the accident is responsible for issuing certificate No. 154. In accordance with letter No. 45/1468 of the State Traffic Safety Inspectorate, a representative of the traffic police must issue the said document to interested parties without delay. If, immediately after registering an accident, the inspector cannot, for some reason, immediately issue a certificate, for example, you urgently need to go to the next accident, the document must be handed over to the victims no later than 24 hours after the accident.

What to do next after receiving

Let us repeat that in most cases, a certificate from the traffic police after an accident is intended to prove the fact of the accident to the insurance company.

Therefore, after receiving this document, the parties to the accident have a three-day period to contact the insurer.

In addition to the help, you should have the following in your documentation package:

  1. Passport of a citizen of the Russian Federation and photocopies of its completed pages.
  2. Taxpayer code.
  3. Driver license.
  4. Technical passport for motor vehicles.
  5. Directly the certificate itself about the accident from law enforcement officers.
  6. OSAGO policy.
  7. Conclusion of a medical examination of the victim.
  8. Receipts for tow truck services.

Further actions

So, after an accident you were given a determination and a certificate, what to do next? You must contact your insurance company immediately to receive compensation for the damage. It must be attached to the application for insurance compensation.

In addition to the certificate, you must provide the following documents:

  1. Passport of a Russian citizen and its photocopies.
  2. Driver license.
  3. Taxpayer code.
  4. Technical passport for the car.
  5. OSAGO policy.
  6. Receipts for tow truck services.
  7. Conclusion of the medical examination of the victim.

The form must have only one corner stamp in the upper left corner, made by imprint or by printing on a printer. Any other type of stamp on the form is not necessary, and if the insurance company requires them, it is illegal.

Also make a photocopy of the document for your archive . If you lose it, you can contact the traffic police for a certified copy of the certificate.

When is a refusal to issue possible?

Initially, we note that the participants in the incident (the culprit and the victim) must receive a certificate of the accident in order to be able to immediately contact the insurer for compensation.

If traffic police officers refuse to issue an application, then the reason must be legitimate and explained.

If the inspector does not justify it, then there is already a reason to contact law enforcement agencies with a complaint about his work. The explanatory statement must be submitted in writing.

Order No. 185 of the Ministry of Internal Affairs of the Russian Federation regulates the provision according to which certificates of road accidents are issued immediately at the scene of the accident.

If the issuance is delayed or transferred to the traffic police department, then such actions are not lawful on the part of the traffic police officers.

A certificate of an accident involving motor transport is not always in demand. Do you need a certificate of an accident with a European protocol?

No, because in the event of a minor accident, this document is completed without the presence of a traffic police inspector, and the certificate can only be filled out by a law enforcement officer.

If a traffic police inspector, without legal justification, refuses to issue you a certificate of the incident, then his actions can be appealed to the prosecutor's office, as a result of which disciplinary sanctions may be taken against him.

For example, it will be illegal to refuse to issue when the reason is the lack of document forms, or the law enforcement officer claims that the case requires another form, but it is temporarily not on hand, and the use of another analogue is strictly prohibited.

If a traffic police officer does this in your case, then it is recommended to immediately contact his department (from where the squad went to the scene of the traffic accident) in order to appeal the actions.

Thus, it is clear that law enforcement officers do not have the right to refuse to issue this document to the parties to the incident; at each scene of the incident, if a European protocol is not issued, they issue a certificate.

To receive monetary compensation after the occurrence of an insured event, the participants in the incident provide a package of official documents that legally confirm the fact of the incident.

One of these important components is a certificate of an accident from the traffic police. All insurance companies, without exception, do not provide financial compensation for insured events if there is no such document. This is especially true when receiving payments under compulsory motor liability insurance.

There are a number of situations when you don’t have to provide a certificate: if the damage was caused only to the components of the vehicle, if there are no claims between the participants in the accident, if the culprit admitted his guilt and assumes the right to provide financial compensation to the victims from his own funds.

But still, in most cases, the certificate is intended to receive an insurance premium under the compulsory motor liability insurance policy from the guilty party.

The parties to the incident must be vigilant in completing documentation so that the insurer can objectively assess the situation and provide funds to resolve the situation.

Insurance companies find something to complain about, so you should be vigilant in filling out all documentation, including the traffic police certificate.

Remember that refusals to issue this document are practically excluded, because their mandatory availability is provided for by the legislation of the Russian Federation.
