What documents are needed for a 125cc pit bike. Documents for a pit bike - sample

In our country, motorcycle vehicles made in Japan, Germany, Poland, the Czech Republic, Korea, the USA and other countries are in demand.
Import duties on motorcycles are high, but this does not discourage interest. Most of the motorcycles are imported from Europe, Japan, Germany and Italy. Moreover, these are often used motorcycles from the 90s and 2000s. The tax is lower on used equipment. In Europe and Japan, there is a more careful attitude towards vehicles, service is well developed, and the roads are different. In most cases, it is more profitable to independently purchase a motorcycle abroad and clear it through customs for your own needs. The possibilities of choosing a model and price when purchasing independently are much wider. The nuances of this procedure should be considered in more detail.

Where to buy a motorcycle

You can buy a motorcycle abroad in person or online, using photographs or videos. There are not many options:

  • private sellers and motorcycle shops on all continents;
  • specialized auctions in Japan (BSD, Aucnet, etc.);
  • main flea market Japanese Yahoo auction;
  • American insurance auction Copart + collateral sites throughout America;
  • international platform Ebay, etc.

When choosing a custom motorcycle, you must first decide on the model, and only then choose the market where you can buy it. For example, there are few Honda Hornet motorcycles in Japan, and it is very difficult to bring them from there. They should be purchased in Europe because they are made there. At the same time, Yamaha Drag Star motorcycles are produced for the domestic Japanese market, and accordingly, there are more of them in Japan. There are more large motorcycles like the Yamaha Stratoliner on the American market. Harley-Davidson is also better to buy in the USA.

There is a large selection on American sites. Motorcycles are sold on insurance websites (iaai.com, copart.com). This is a vehicle with some damage. Undamaged motorcycles for sale at npauctions.com, manheim.com. There are few motorcycles on the latter, but there are interesting examples. Or on message boards, for example, cycletrader.com, you can pick up something.

To determine the approximate cost, you need to look at the place where the equipment is sold. It is preferable to ship your motorcycle from New Jersey. The closer the motorcycle is to the place of shipment, the cheaper the transportation will cost. You can ship from Los Angeles, but delivery from there is more problematic.

To understand how much you can buy a motorcycle on insurance websites, you should look at sales statistics on specialized resources: bidfax.info, poctra.com, autoastat.com. You need to select a motorcycle model and sales period. The cost of the motorcycle will be shown, the cost with all fees, photos from which you can determine the condition. To this are added the auction fee, logistics in America, logistics in Russia, brokerage services and customs duties.

Motorcycles on the Japanese market can be viewed on the website 8190.jp. But the difficulty is that the interface is in Japanese. However, you can figure it out by looking at the instructions on the Internet. In the Japanese market, even used motorcycles are like new, but their cost is significant.

In Europe, motorcycles are purchased on the websites otomoto.pl, mobile.de (you can turn on the Russian language). Again, the cost of the product on the website is not the final amount you will have to pay. Delivery, brokerage services, and the cost of the certificate are added.

Delivery time from America is approximately 2-3 months, a motorcycle from Europe will be delivered to the recipient in 2-3 weeks.

Note! It is cost-effective to independently import motorcycles older than 5 years into Russia. New vehicles can ultimately cost even more than those from dealers, because customs payments to dealers are calculated based on the wholesale factory price, excluding VAT, at the net price.

Features of customs clearance of motorcycles

Formally, the customs clearance procedure for a motorcycle consists of several stages:

  • filing a declaration and other accompanying documents;
  • checking the authenticity of documentation and the correctness of its completion;
  • payment of customs duties.

The customs value of the motorcycle plays a big role in customs clearance. It includes:

  • price;
  • loading and transportation costs;
  • insurance;
  • brokerage services.

From this amount, customs duty, VAT, and customs clearance fees are calculated in the amount of 150 to 500 rubles (for individuals - 250 rubles). To confirm the stated price, you must present receipts or other documents that allow you to determine the costs of purchasing a motorcycle, such as bank statements. The customs broker independently determines the customs value of the motorcycle from the catalogue. For this purpose, specialized foreign catalogs are used: for motorcycles manufactured in the USA or Canada - NADA, for motorcycles manufactured in Europe - Schwackeliste ZWEIRAD, for other regions - other catalogs. But if the catalog value turns out to be less than the actual value, then the value indicated on the receipt will be used when calculating customs duties.

Such directories provide information on the purchase and sale of vehicles of a specific model and year. Moreover, the older the equipment, the lower the cost. But when determining the customs value from the catalogue, customs does not take into account the condition of the vehicle, and this is important for the buyer. It is clear that a damaged motorcycle is not worth the price indicated in the catalogue. In such cases, it is necessary to undergo an independent appraisal examination, which is paid for by the buyer. Sometimes this does not help to significantly improve the price. For example, due to the fact that all this time the motorcycle will be at the customs temporary storage warehouse, the services of which are paid additionally and are not cheap.

What risks does a driver face when riding a pit bike without documents?

Let's talk about this in more detail: according to the law, if we look at the amendments of 2021, we can understand that there is no clear wording in the law that would allow a driver to be fined for driving a pit bike on roads for public use.

In life, everything happens a little differently. If you are stopped by a traffic police officer, he is trying to bring you to justice under Article 12 of the Code:

  • Part 1 of Article 12.7 – driving a vehicle without a driving license and punishment for this violation may include a fine of five to ten thousand rubles.
  • Part 2 of Article 12.3 – lack of a driver’s license of the appropriate category – a fine of 500 rubles.
  • Part 1 of Article 12.1 - lack of a vehicle title, or rather, for failure to fulfill this obligation - a fine of 500 rubles.

But all these sanctions can only be applied to ignorant drivers who do not know their rights, since the application of these sanctions is NOT legal!

It was already mentioned earlier that according to the wording on the application of fines from the Code of Administrative Offenses, a driver when driving a vehicle must have the most important thing - the right to drive, and the Law “On Road Traffic Safety” states that this right is given only to vehicles used for the purpose of moving people and cargo, therefore it is not possible to apply these requirements and fines to sports equipment. The same can be said about the fine for the absence of a PTS and registration with the traffic police.

are there any documents for the pit bike?

As for sanctions, in the form of impound parking, everything is also very simple here: impound parking is regulated by Article 12.13 of the Code of Administrative Offences. This article can only be applied if the driver is driving while intoxicated, if they stopped in the wrong place, and so on, and if fines have already been applied, and since it is not legal to fine, then it is not legal to evacuate the vehicle!

If, nevertheless, your “favorite” ends up in the impound lot, then you will need to eliminate the reason for placing the vehicle in the parking lot, obtain written permission from the traffic police department and convince the parking lot and traffic police officers that this is your vehicle. It is very difficult to do this without a PTS, but at least you need to have all the documents for the pit bike with you: a purchase and sale agreement, the driver’s personal passport and a passport for the equipment. Also, you can only pick up a pit bike on a trailer or a large car, since you will not be allowed to drive on your own.

Unfortunately, when communicating with a traffic police inspector, you are not always able to prove that you are right and then you need to appeal the decision in court.

Customs payments

Motorcycles are cleared through customs at the relevant customs authorities at the place of registration of the buyer. After crossing the border, a certain period is given to deliver the vehicle to the place of immediate customs clearance. A deposit is paid in advance, which is 41.6% of the catalog price of the motorcycle. It is a guarantee that the owner will be able to subsequently pay customs duties. After making the deposit, the customs authority issues a receipt, and the owner receives a guarantee certificate, which allows the vehicle to be imported and operated in Russia. The deposit is made in advance, because when crossing the customs checkpoint at the border, the amount should already be in the state treasury account, as well as all preliminary data concerning the owner and the vehicle. You cannot make a deposit at the border.

The amount of customs duty is calculated depending on the following parameters:

  • customs value;
  • engine volume and power;
  • vehicle age;
  • masses;
  • engine type;
  • subject of import.

Important! There is no recycling fee for motorcycles.

Most motorcycle imports are imported by individuals. If a motorcycle is imported by an individual who is a resident of the Russian Federation for personal use, then customs clearance is carried out in a simplified manner. And the customs duty is 30% of the customs value.

A resident is a person who lives on the territory of the Russian Federation for at least six months and complies with the laws of the country.

If equipment is imported for commercial purposes, then the STP is paid - the total customs payment: the import duty is 12-17% of the customs value. Additionally, 20% VAT on the customs value + customs duty and excise duty is paid (in cases where the engine power is more than 150 hp, a rate of 491 rubles per 1 hp is applied, in 2022 it will reach 511 rubles per 1 hp, and in 2023 – 531 rubles per 1 hp). Excise tax rates are established by art. 193 of the Tax Code of the Russian Federation (Part 2 was introduced by Federal Law of the Russian Federation of August 5, 2000 No. 117-FZ).

To the already mentioned payments, it is worth adding about 300 euros for additional expenses: temporary storage services, appraisal reports, etc.

It is convenient to use a special calculator for calculations. We suggest calculating customs duties here. This calculator is constantly updated, the data is updated, so the result will be as accurate as possible.

Note! Regardless of the country of import, the cost of the motorcycle and other fees are first expressed in US dollars and then converted into rubles.

Generalized information on customs clearance duty rates and excise duty rates is presented in the table:

There are nuances if the motorcycle is imported from a certain country. For example, if a vehicle is imported through Belarus, then all the same documents are presented (purchase agreement, invoice, technical documentation, receipts), except for cases where the vehicle delivered from European countries has already cleared customs in Belarus or was produced there. Then there is no need to go through the procedure again at the Russian border. Moreover, the motorcycle must be imported into Belarus no earlier than 2010.

It is worth mentioning separately about customs clearance of motorcycles from Germany. If the motorcycle costs more than 2,000 euros, then the export declaration must be completed in the region where the seller operates. It is difficult to do this on your own; it is advisable to do it through an accredited company. The cost of such a service is around 30-40 euros. Then you need to go to the regional customs office with the motorcycle. From there, after reconciliation, all data is sent electronically to the specified border crossing. There, the data is entered into the system, after which the motorcycle is considered imported.

What documents do you need to take with you for a pit bike?

In the modern world, a pit bike is a very popular form of transport among young people and fans of extreme sports. Since you cannot ride a pit bike around the city and highway without documents, in order to get to the motocross you will need a large car or a trailer.

If you are transporting a pit bike to motocross in a special vehicle or in a trailer, then it is advisable for the owner to carry the purchase and sale agreement with him so that the traffic police officers, in the event of a stop, do not have a question: Is this your vehicle?

You can drive a pit bike only if you have a driver’s license of the appropriate category, insurance, a document certifying the passage of a technical inspection, state license plates for the equipment and a document confirming the registration of the vehicle with the traffic police. If the driver ignores these rules, if you are stopped by a traffic police inspector, you may face fines and be sent to a parking lot.

Features of customs clearance of spare parts for motorcycles

Particular attention should be paid to the import of spare parts for motorcycles. This is a huge, actively developing market. Let's take, for example, an internal combustion engine. It is prohibited for individuals to import gasoline internal combustion engines, and no tricks, such as presenting the title of the equipment on which the engine will be installed, are allowed. It is forbidden! You can import diesel engines and gasoline outboard motors. If there is an urgent need: just disassemble the internal combustion engine and import it in parts, in accordance with the classification codes of the Commodity Nomenclature of Foreign Economic Activity and current customs duties.

In the same way - transportation in disassembled form - a motorcycle is imported for spare parts. It is important that a motorcycle cannot be assembled from spare parts from a single imported batch. In two steps, separately, it is worth transporting the numbered units - the frame and the engine. Customs clearance is carried out at the border, without paying a deposit. And it is advisable to transport it through Finland. Difficulties may arise when importing through Belarus.

Difficulties of customs clearance

Even if you buy a motorcycle abroad yourself and then transport it to Russia, you will have to pay a significant amount for customs clearance. Sometimes it is actually equal to the cost of the vehicle. In addition to high rates, the importer will have to deal with the bureaucratic customs clearance procedure, which also often causes problems. To avoid delays at customs, we advise you to contact a customs representative who can clear the vehicle through customs without your direct participation. Contacting a customs broker significantly reduces the waiting time for a vehicle, increases the reliability of the transaction, and helps to avoid pitfalls during registration.

Please note that various tricks, the purpose of which is to reduce the amount of customs duties, are fraught with problems that will arise later.

For example, there are several ways to save:

  • import under the guise of scrap metal;
  • registration for a person living abroad;
  • import without customs clearance.

However, a successful outcome cannot be guaranteed. And the last option is generally illegal.

The procedure for customs clearance step by step

So, first of all, during customs clearance, the estimated amount of customs duties is deposited into the customs account in advance. This is the so-called deposit. It is entered at the customs post at the place of residence. In this case, it is advisable to have on hand the original or a copy of the PTS for this vehicle. Based on this document, the amount of payments is calculated. This can be done either independently or with the help of a broker. The customs representative will also help you deposit money quickly, bypassing the queue. There are times when making a deposit takes several days.

Having received the documents at the cash desk, you need to take them to the customs inspector, who will issue a customs certificate (for legal entities - a guarantee certificate) indicating the exact location of the border crossing (border crossing). This is where you will need to go. Be sure to check all data. There should not be a single error in the information. On the way back, this certificate must be presented to the customs officer after passing through passport control. He checks the data with the electronic data and sends a delivery control document (DCD) to be drawn up, after which he also puts an o and indicates in the document the delivery time when the motorcycle should arrive at the point where the deposit was made. For violation of this deadline, fines and sometimes more serious sanctions are imposed. Next, the motorcycle is transported to a temporary storage warehouse at the place of residence, and all documents are presented to the local customs officers. Parking at the temporary storage warehouse is paid for every day. Further processing will take approximately two more days, excluding weekends and holidays.

You need to submit a declaration to customs. There is a fee for filing a declaration. It is submitted electronically, and an individual will not be able to do this on their own, because for this you need to have specialized software from Alta-soft and an electronic key.

In addition, it is necessary to issue a SBCTS - vehicle safety certificate in a specialized laboratory. They do not work with individuals and for this you need to resort to the services of an intermediary. You can do it at customs. But the procedure will cost more.

buy documents for a pit bike, do you need documents for a pit bike 125

As we have already found out above, according to traffic regulations, the driver of a pit bike with an engine power of 51 cm3 or more needs a driving license. To do this, you need to undergo training at a driving school and pass exams at the traffic police for a category “A” license, but registering the transport itself with the traffic police is very difficult, because To do this, you need a document from the manufacturer - a vehicle passport, which is obtained during the production of the equipment.

Manufacturers do not provide for the issuance of such a document, and in order to resolve this issue on your own, you need to spend a lot of time, effort and finances, namely, you need to obtain an expert opinion on transport.

Registration with the traffic police

Driving an unregistered vehicle, even if it is cleared by customs, is prohibited. Therefore, you will still need to register with the traffic police.

All motorcycles undergo maintenance at a specialized technical control station, during which steering, brakes, lighting equipment and more are checked. After this procedure, a maintenance coupon is issued, with which you need to come to the insurance company and apply for compulsory motor liability insurance. With these documents you can go to the MREO.

Note! The motorcycle must be registered within 10 days from the date of purchase, otherwise a fine will be imposed.

Documents required:

  • Russian Federation passport of the owner;
  • confirmation of ownership;
  • PTS;
  • OSAGO;
  • application for registration;
  • checks confirming payment of state duties.

State duties are established for:

  • registration certificate;
  • issuing numbers;
  • making changes to the PTS (in this case not required).

Next, on the observation deck, the inspector will check the frame and engine numbers. Now you need to submit documents for registration and wait for the certificate and license plates to be issued.

The fine for late registration is 1,500-2,000 rubles for individuals and 10,000 for legal entities. The starting date for delivery of a motorcycle by a transport company is the date of shipment in the invoice.

Why do you need to register your vehicle?

In accordance with the legislation of the Russian Federation, registration of movable property is necessary so that equipment can be operated on public roads. This procedure is considered mandatory for both motorcyclists and car drivers. It must be carried out regardless of the reason why the vehicle passed into the hands of the new owner:

  • Purchase (including used vehicles);
  • Inheritance;
  • Deed of gift.

If the purchased car or motorcycle is not registered, then the penalty will be a fine. In the worst case, inspectors can confiscate the driver’s license for up to 3 months.
