Features of customs clearance of motorcycles
Formally, the customs clearance procedure for a motorcycle consists of several stages:
- filing a declaration and other accompanying documents;
- checking the authenticity of documentation and the correctness of its completion;
- payment of customs duties.
The customs value of the motorcycle plays a big role in customs clearance. It includes:
- price;
- loading and transportation costs;
- insurance;
- brokerage services.
From this amount, customs duty, VAT, and customs clearance fees are calculated in the amount of 150 to 500 rubles (for individuals - 250 rubles). To confirm the stated price, you must present receipts or other documents that allow you to determine the costs of purchasing a motorcycle, such as bank statements. The customs broker independently determines the customs value of the motorcycle from the catalogue. For this purpose, specialized foreign catalogs are used: for motorcycles manufactured in the USA or Canada - NADA, for motorcycles manufactured in Europe - Schwackeliste ZWEIRAD, for other regions - other catalogs. But when determining the customs value from the catalogue, customs does not take into account the condition of the vehicle, and this is important for the buyer. It is clear that a damaged motorcycle is not worth the price indicated in the catalogue. What risks does a driver face when riding a pit bike without documents?
Let's talk about this in more detail: according to the law, if we look at the amendments of 2021, we can understand that there is no clear wording in the law that would allow a driver to be fined for driving a pit bike on roads for public use.
In life, everything happens a little differently. If you are stopped by a traffic police officer, he is trying to bring you to justice under Article 12 of the Code:

It was already mentioned earlier that according to the wording on the application of fines from the Code of Administrative Offenses, a driver when driving a vehicle must have the most important thing - the right to drive, and the Law “On Road Traffic Safety” states that this right is given only to vehicles used for the purpose of moving people and cargo, therefore it is not possible to apply these requirements and fines to sports equipment. The same can be said about the fine for the absence of a PTS and registration with the traffic police.
As for sanctions, in the form of impound parking, everything is also very simple here: impound parking is regulated by Article 12.13 of the Code of Administrative Offences. This article can only be applied if the driver is driving while intoxicated, if they stopped in the wrong place, and so on, and if fines have already been applied, and since it is not legal to fine, then it is not legal to evacuate the vehicle!
If, nevertheless, your “favorite” ends up in the impound lot, then you will need to eliminate the reason for placing the vehicle in the parking lot, obtain written permission from the traffic police department and convince the parking lot and traffic police officers that this is your vehicle. It is very difficult to do this without a PTS, but at least you need to have all the documents for the pit bike with you: a purchase and sale agreement, the driver’s personal passport and a passport for the equipment. Also, you can only pick up a pit bike on a trailer or a large car, since you will not be allowed to drive on your own.
Unfortunately, when communicating with a traffic police inspector, you are not always able to prove that you are right and then you need to appeal the decision in court.
Customs payments
Motorcycles are cleared through customs at the relevant customs authorities at the place of registration of the buyer. After crossing the border, a certain period is given to deliver the vehicle to the place of immediate customs clearance. A deposit is paid in advance, which is 41.6% of the catalog price of the motorcycle. It is a guarantee that the owner will be able to subsequently pay customs duties. After making the deposit, the customs authority issues a receipt, and the owner receives a guarantee certificate, which allows the vehicle to be imported and operated in Russia. The deposit is made in advance, because when crossing the customs checkpoint at the border, the amount should already be in the state treasury account, as well as all preliminary data concerning the owner and the vehicle. You cannot make a deposit at the border.
The amount of customs duty is calculated depending on the following parameters:
- customs value;
- engine volume and power;
- vehicle age;
- masses;
- engine type;
- subject of import.
Important! There is no recycling fee for motorcycles.
Most motorcycle imports are imported by individuals. If a motorcycle is imported by an individual who is a resident of the Russian Federation for personal use, then customs clearance is carried out in a simplified manner. And the customs duty is 30% of the customs value.
A resident is a person who lives on the territory of the Russian Federation for at least six months and complies with the laws of the country.
If equipment is imported for commercial purposes, then the STP is paid - the total customs payment: the import duty is 12-17% of the customs value. Additionally, 20% VAT on the customs value + customs duty and excise duty is paid (in cases where the engine power is more than 150 hp, a rate of 491 rubles per 1 hp is applied, in 2022 it will reach 511 rubles per 1 hp, and in 2023 – 531 rubles per 1 hp). Excise tax rates are established by art. 193 of the Tax Code of the Russian Federation (Part 2 was introduced by Federal Law of the Russian Federation of August 5, 2000 No. 117-FZ).
To the already mentioned payments, it is worth adding about 300 euros for additional expenses: temporary storage services, appraisal reports, etc.

There are nuances if the motorcycle is imported from a certain country. For example, if a vehicle is imported through Belarus, then all the same documents are presented (purchase agreement, invoice, technical documentation, receipts), except for cases where the vehicle delivered from European countries has already cleared customs in Belarus or was produced there. Even if you buy a motorcycle abroad yourself and then transport it to Russia, you will have to pay a significant amount for customs clearance. The procedure for customs clearance step by step
