Punishment for driving with a trailer without documents in a car

Fine for a trailer without documents

Trailer without registration. For citizens, the fine for such a violation is up to 800 rubles. Proof of registration is the license plate number and PTS.

No numbers. For this, the inspector will fine you up to 5,000 rubles or deprive you of your license for up to 3 months.

No required category. If there is no open category for driving a car with a trailer, the fine is up to 15,000 rubles.

The legal entity's trailer is not insured. In 2015, the Supreme Court decided not to apply the MTPL law to owners of passenger trailers. This is also written in paragraph “e” of Part 3 of Art. 4 laws on compulsory motor liability insurance. An insurance policy for a trailer is only required if the vehicle is registered to a company. The fine for not having an MTPL policy is 800 rubles.

What violations may there be?

Let's look at the situations you should be aware of on the road.

First of all, we note incorrect installation, violation of loading standards with its contents, or driving with a faulty trailer. The fact that this device is very simple and does not have an engine does not relieve the car owner of the obligation to carry out routine inspection and repairs.

There are also insurance related violations. We have already mentioned that the device must be included in the policy.

Things are more complicated if the trailer is completely devoid of numbers.

A violation is also possible in which the driver does not adhere to traffic rules when driving a car with a trailer. We will consider what fine for failure to keep the distance if the driver is driving a car with a trailer in the last section of the article.

The most unpleasant violation is the absence of category “E” on the driver’s license. What is the situation with the law if the device does not belong to the driver at all? Is it possible to drive with someone else's trailer? Everything is quite simple here: if you have category “E” open, and the device is included in your insurance, then you are allowed to drive the vehicle.

Fine for defective trailer

The rules for transporting goods were violated. If the cargo obscures the driver's view, sand flies from the trailer, or the weight of the cargo exceeds that allowed by the manufacturer - all this is a violation of the rules for transporting goods. The fine for this is 500 rubles.

The trailer is faulty. If one of the sides of the trailer is not secured or the coupling device is faulty, you may be fined 500 rubles.

Lights do not light up. The fine for a trailer without lights is 500 rubles.

General information

Driving a car with a trailer is clearly regulated by the legislation of the Russian Federation.
The rules include not only their classification, but also certain requirements for speed of movement and permissible dimensions. The presence of a trailer is documented, and a fine is imposed if papers are missing. It is customary to distinguish four types of trailers according to their total weight (load capacity plus dead weight):

  • up to 0.75 tons - for drivers with category B;
  • up to 3.5 tons - for drivers with category B (the weight of the vehicle must be greater than or equal to the weight of the loaded vehicle, and their total weight should not exceed 3.5 tons) and category BE;
  • up to 10 tons - for drivers with mandatory subcategory E;
  • more than 10 tons - cargo trailer.

Basic requirements for trailers and driver:

  • the trailer should not completely block the view of the road;
  • length, width and height should not exceed 12, 4 and 2.55 meters respectively;
  • the length of a road train of more than 18.3 meters is considered a violation;
  • Loads not exceeding the weight permitted by the manufacturer are allowed;
  • It is not allowed to exceed the speed limit of 70 km/h for highways and 90 km/h for highways;
  • availability of compulsory insurance or inclusion of the trailer in the vehicle insurance policy (for trucks or cars owned by legal entities);
  • working rear lights in red or orange;
  • The NTS must be entered into the traffic police registration database no later than ten days from the date of purchase and have its own license plate.

For failure to comply with the above requirements, a fine will be imposed on the motorist.

Trailer and its types

Unlike motorized vehicles, a trailer is not equipped with an engine, which prevents it from moving without a tow vehicle. However, the use of towed vehicles can pose considerable danger, both for other road users and for the driver of the towing vehicle.

There are several types of trailers, differing from each other in the number of axles or type of load distribution. For example, small trailers have one axle, cargo trucks and large semi-trailers have two or more.

In addition to a regular trailer, which can be considered a self-sufficient vehicle, there are semi-trailers in which the weight is also distributed over the wheels of the tractor. To transport cargo of non-standard length, a multi-axle road train or disbandment is used.

Category of rights for a car with a trailer

The categories of rights are described in Art. 25 of the Road Safety Act. Which category is needed depends on the weight of the trailer:

Car Trailer weight, kg Total weight, kg Category
passenger car up to 750 or vehicle weight up to 3500 B
from 750 from 3500 BE
cargo up to 750 C, C1
from 750 C.E.
from 750 up to 12,000 C1E
bus up to 750 D, D1
from 750 DE
from 750 up to 12,000 D1E

The BE category license is passed in the same way as the B license, only without the snake and overpass. For categories CE, DE, C1E and D1E, more than 3 years of experience is required, open category C or B and age - more than 21 years.

Is it possible to appeal or evade a fine?

Appealing fines for a homemade trailer or its other types is possible, but it is worth considering that you can count on a positive outcome of the case only if you are completely confident that you are right or that the law enforcement officers on the road are wrong.

Remember that the same penalties are imposed for driving with a trailer as for driving a regular vehicle.

If you have just purchased this unit, then you have a legal 10 days to install license plates on it , so issuing a fine during this period for the lack of license plates will be considered unlawful.

How to register a trailer

Collect documents. To register a trailer at the registration and examination department of the traffic police, you will need the same documents as for registering a car:

  • • citizen's passport;
  • • vehicle passport for the trailer;
  • • contract of sale;
  • • statement;
  • • MTPL insurance policy with a note that the car can be driven with a trailer.

Pay your dues. In addition to documents, the owner of a car with a trailer pays:

  • • 1500 rubles for new signs,
  • • 500 rubles for a paper registration certificate. Can be ordered in plastic - 1,500 rubles;
  • • 350 rubles for changes to the PTS.

Payments are displayed quickly in the database - the inspector will see them when he registers your trailer. Just in case, take all paid receipts with you.

Sanctions for homemade construction

The punishment for a home-made design is no different from the sanctions for an unregistered factory-made trailer. Registering a handicraft will take a lot of time and effort from the owner. During the process, he will prove that the trailer complies with current standards, and he will also be required to provide certificates for materials. Otherwise, the makeshift mechanism operates on a general basis and the punishment is no different from a fine for an unregistered trailer.

So, any trailer requires registration with the traffic police. You should not ignore traffic regulations. It is better to find out in advance what documents will be needed to drive a trailer in a car or truck, and go through the necessary formalities. Often, employees purposefully monitor such vehicles, and the identified chain of violations will entail consequences. Registering a trailer is the very case when it is much cheaper for the driver to follow the rules, saving himself from fines, forced trips to the service station and deprivation of his license.

How to register a homemade trailer

If you bought a trailer in a store, the manager must issue a title to it. A homemade trailer does not have a PTS. It will be issued to the traffic police after special checks.

In addition, the trailer must have a vehicle type approval (OTTS) - it is issued by Rosstandart for a batch of trailers. For a homemade trailer, it is necessary to obtain an analogue of the OTTS for a piece product - a certificate of safety of vehicle design (SVKTS). Such a certificate is issued in a special technical laboratory. Here's what you need to do to register your garage-built trailer.

Select a laboratory. There are these in almost every city. How to choose a laboratory, read the article about auto tuning.

Agree on the planned changes. The application can be sent by email. Write in it the technical parameters of the future trailer. If everything is fine with the parameters, the laboratory workers will send a conclusion in response. This document must be taken along with the application to the technical supervision department of the traffic police.

Assemble the trailer. The owner has the right to manufacture the trailer himself or at any production facility.

Be tested at an accredited center and receive a protocol. Laboratory staff will compare what the owner planned to do with what he brought for testing.

Take the documents to the traffic police. Protocol, copies of certificates of conformity for used spare parts certified by a notary and a receipt for payment of the state duty - 800 rubles.

Bring the trailer for inspection by the traffic police. Service employees will check the documents with the trailer that the owner brought. If everything is correct, an SBTKS will be issued.

Take all documents to the registration department of the traffic police. After this you will receive a title for the trailer.

Before assembly, you can use GOST for trailers. This way you are more likely to get laboratory approval and register the trailer.

In practice, few people register a “garage” trailer - the traffic police do this with great reluctance and paperwork. It’s easier to buy a certified trailer from a dealership and easily register it with the traffic police.

Types of towbars

There is a lot of debate among motorists about whether they will issue a fine for a tow bar or not. Their opinion was divided into two sides. And both sides are right in their own way, but if you follow all the rules when installing and operating it, there will be no fine.

There are several types of towbars:

1. Removable - usually installed when necessary and then dismantled. It does not make any changes to the design of the car, but traffic police officers do not agree with this, and if the removable tow bar is unregistered , without documents on compatibility with the car, the owner will be issued a fine of 500 rubles or a warning.

2. Built-in by the manufacturer - in this case, the driver must show documents confirming this point, and no one will issue him a fine. Recently, many have begun to notice that the attention of traffic police posts to precisely this towbar has become more frequent, and this is not without reason. Some drivers do not install it for its intended purpose, but believe that it can be used to reduce the consequences of a collision. But this is a big misconception. A towbar will likely make the situation worse, and the car may suffer even more.

3. Welded. It can only be installed if it does not disrupt or change the design of the vehicle. But if you neglect the rules and do it without registration, the owner will suffer serious punishment in the form of a fine, the amount of which is 5,000 rubles. If the vehicle requires a towbar, and the owner constantly uses a trailer or trailer, then all the necessary documents are drawn up, and you can drive without fear of a fine. Otherwise, it is better to use a removable one, and there will be no problems.

Remember

  1. If you are using a trailer lighter than 750 kg, category B is sufficient.
  2. Register a trailer in the same way as a car: you give the inspector a PTS, a sales contract and receive license plates and a PTS with a mark.
  3. To register a homemade trailer, you will have to find a technical laboratory, get documents about the safety of the trailer there and take them to the traffic police.
  4. A technical inspection is only required for legal entities or if the weight of the vehicle with trailer is above 3.5 tons.
  5. The fine for a trailer is from 800 to 15,000 rubles, depending on the violation.

Using a homemade device

Let's look at three interesting situations that are often interpreted by traffic police officers as a violation.

Homemade trailer device: traffic police officers don’t know how good your welds are
Homemade trailer device: traffic police officers don’t know how good your welds are

  • Let's figure out whether it's possible to drive with a homemade trailer. This is allowed if the device is registered with the traffic police. Otherwise, the product of creativity will be recognized as the introduction of adjustments to the car.
  • Is it an offense to drive a vehicle with a towbar (a device used to secure a trailer)? On the one hand, such a harmless action cannot in any way be a violation. On the other hand, a towbar is considered as making changes to the design of the car.
  • If the car is higher than it should be. We are talking about overloading the roof of the car or an additional device.
